HomeMy WebLinkAboutRES CC 1993 919 1993 0303RESOLUTION NO. 93- 919 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, CERTIFYING THAT THE CITY OF MOORPARK HAS NO AT -RISK "ASSISTED HOUSING DEVELOPMENTS" PURSUANT TO GOVERNMENT CODE SECTION 65583(a)(8) WHEREAS, Government Code Section 65583(a)(8) requires local jurisdictions to perform an analysis of existing "Assisted Housing Developments" that are at risk of having affordability control subsidies terminate within the jurisdiction's ten -year analysis period; and WHEREAS, the City of Moorpark's ten -year analysis period is between July of 1989 and July of 1999; and WHEREAS, the City of Moorpark has analyzed the existence of "Assisted Housing Developments" and has prepared the attached checklist confirming the lack of at -risk multifamily rental units pursuant to Government Code Section 65583(a)(8); and WHEREAS, the Inventory of Federally Subsidized Low - income Rental Units at Risk of Conversion, 1991, does not identify any multifamily rental housing units in Moorpark that are at risk within the City's ten -year analysis period; and WHEREAS, the City of Moorpark has no multifamily dwelling units subsidized with Farmers Home Administration (FmHA) Section 515 Rental Housing Loans; and WHEREAS, the only federally subsidized low - income rental units in the City, the Tafoya Terrace Apartments (30 total units), are owned and managed by the Ventura County Area Housing Authority, supported by the federal Housing and Urban Development (HUD) Agency conventional low -rent public housing program, and are not at risk; and WHEREAS, the Annual Summary: The Use of Housing Revenue Bond Proceeds, California Debt Advisory Commission, 1991, does identify that a multifamily housing bond was issued for the Moorpark Le Club Apartments (370 total units), but no conversion date is given; and WHEREAS, there is a 30 -year density bonus agreement for the Moorpark Le Club Apartments which requires that 20 percent (74 units) of the total apartment units be reserved for low- and moderate - income tenants through thE' year 2015; and WHEREAS, no Community Development Block Grant funds have been used within the City of Moorpark to subsidize multifamily rental units; and Resolution No. 93- 919 Page 2 WHEREAS, no redevelopment funds have been used in the City of Moorpark to subsidize multifamily rental units; and WHEREAS, the City of Moorpark does not currently have a housing trust fund (in -lieu fee) or Lnclusionary zoning program; and WHEREAS, the findings of no at -risk dwelling units, as described above, will be reevaluated and discussed in the next five -year revision of the Housing Element of the Moorpark General Plan, due in July 1994; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: The Moorpark City Council certifies that the City of Moorpark has no multifamily rental units at risk of having affordability control subsidies terminate under the provisions of Government Code Section 65583(a)(8). State and local multifamily revenue bond programs no bond - financed units eligible to terminate affordability controls within the next ten years were reported in the following publication: 1990 Annual Summary: The Use of Housing Revenue Bond Proceeds, California Debt Advisory Commission, and local housing authority staff indicate there are no such units within the community. 6.
