HomeMy WebLinkAboutRES CC 1993 970 1993 0908RESOLUTION NO. 93 - 970 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, SETTING FORTH POLICIES AND PROCEDURES FOR THE ESTABLISHMENT OF PERMIT ONLY PARKING ZONES WHEREAS, the residents of certain areas of the City have expressed concerns regarding overcrowding and the negative impacts upon their neighborhoods posed by the effects of overcrowding; and, WHEREAS, one of the negative impacts of overcrowding is the parking of an excessive number of vehicles on the public streets in the affected neighborhood; and, WHEREAS, the City Council wishes to set forth certain policies, procedures and guidelines to allow for 1) the establishment of PERMIT ONLY parking zones in said neighborhoods, and 2) the issuance of PARKING PERMITS to address certain hardships posed by such restrictions; and, WHEREAS, Section 22507 of the California Vehicle Code authorizes the City to restrict parking, between certain designated hours, upon certain designated streets, for all vehicles except those displaying a permit exempting said vehicles from the provisions of such parking restrictions. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That a PERMIT ONLY parking program is hereby established pursuant to the provisions of Section 22507 of the California Vehicle Code. SECTION 2. That said program shall become applicable to certain specified areas or neighborhoods of the City when said areas are designated a PERMIT ONLY parking zones by adoption of a resolution of the City Council. SECTION 3. That whenever any such action is taken, the City Manager is hereby directed to provide for the installation and maintenance of signs and markings giving notice of said PERMIT ONLY parking restriction. SECTION 4. That parking shall be prohibited in any such PERMIT ONLY parking Zones between the hours of 2:00 a.m. and 6:00 a.m. Resolution No. 93 - 970 Page 2 SECTION 5. That the said parking restriction shall not apply to vehicles displaying a permit issued by the City exempting said vehicles from this parking restriction. SECTION 6. That the City Manager shall establish and maintain policies, procedures and guidelines for the designation of PERMIT ONLY parking zones and for the administration of the issuance of PARKING PERMIT exempting certain vehicles, from said parking restrictions. SECTION 7. That said policies, procedures and guidelines shall include certain provisions including, but limited to, the following: a. The pre- designation of areas or neighborhoods to be considered for such parking restrictions. b. Criteria and procedures for submitting petitions to the City requesting that this program be made applicable to any such area. c. Except for Guest Permits, no parking permit shall be issued to any vehicle which is not registered to an individual residing at a residence within a PERMIT ONLY parking zone. d. A Parking Permit may only be issued to a vehicles when the registered owner of said vehicle demonstrates that there are in excess of four (4) vehicles registered to individuals legally residing at the domicile of the applicant. Exceptions shall be made for residences which cannot accommodate four (4) vehicles in the garage and driveway as originally approved and constructed. e. The payment of a Parking Permit fee to recover all or a portion of the administrative costs of the program. f. Criteria for the waiver of any such fee due to demonstrable economic hardship. ATTESTED: Zti Cf City Clerk Mayor, City oY Moorpark, lifornia Policies and Procedures For the Issuance of Parking Permits to Vehicles Registered to Residents of a Designated PERMIT ONLY Parking Area PURPOSE To establish guidelines and procedures for 1) the designation of PERMIT ONLY parking zones; and, 2) the issuing PERMITS exempting certain vehicles from the parking restrictions established in any such zone. A. The City Council of the City of Moorpark has adopted Resolution No. 93 -970 which states the intent of the City Council to establish PERMIT ONLY parking zones in specified areas of the City. Said Resolution directs the City Manager to develop and maintain these policies, procedures and guidelines for the administration of that program. B. Resolution No. 93 -970 states that PERMIT ONLY parking shall be made applicable to certain specified areas or neighborhoods upon adoption of a Resolution of the City Council. It is the intent of the City Council to only enact such restriction upon receipt of a request to do so from the residents of the area to be affected, unless otherwise determined necessary for the public health, safety or welfare of the Community. In order to be considered, any such request shall be in the form and shall meet the minimum requirements of the applicable Procedures set forth herein. C. Whenever a PERMIT ONLY parking zone is resolution of the City Council, the parking forth in Resolution No. 93 -970 shall apply except those vehicles which properly display issued by the City of Moorpark in acco applicable procedures set forth herein. A. Establishment of a PERMIT ONLY Parking Zone established by restrictions set to all vehicles a PARKING PERMIT rdance with the 1. Pursuant to the provisions of Resolution No. 93 -970, the City Council may adopt resolutions designating certain areas as PERMIT ONLY parking zones. Policies and Procedures Permit Only Parking Page 2 2. Said Resolution provides for the pre- designation of the areas or neighborhoods to be considered for PERMIT ONLY parking. Those areas [hereinafter referred to as "area(s)] are identified on the map attached hereto as Exhibit 'A'. 3. Upon receipt of a request that an area be designated a PERMIT ONLY parking zone, the City Council may consider adoption of a Resolution so designating said area. In order to be considered, such request must have been presented by a group duly representing the owners and residents of said area. For the purposes of these Procedures, a group deemed to be duly representing the owners and residents of an area shall be defined as one of the following: • the Board of Directors of the Homeowners Association for the area; or., • the holder(s) of a petition signed by the owners and /or residents of at least ten percent (10 %) of the lots within said area. 4. Upon receipt of any such request, City staff shall prepare a mailing list of all of the property owners and residents within the area. A public hearing shall be scheduled before the City Council to consider any such request and to consider adoption of a Resolution designating the area in question a PERMIT ONLY parking zone. Public Hearing Notices shall be mailed to all of the owners and residents within said area, advising them of the proposed action. 5. In order to be considered, any such request must be accompanied by a fee equal. to the number of lots in the area multiplied by fifty cent ($0.50) to cover the cost of evaluating the application and the administering the public hearing. Any such application filed within sixty (60) dais of the date of the adoption of Resolution No. 93 -970 shall be exempt from said fee. Public Hearing administrative costs may include, but may are not limited to the following: • compiling the public hearing mailing list; • preparation of the Public Hearing Notice; and, • postage, paper and envelopes. 6. Subsequent to the receipt of written and /or oral testimony at or prior to the public hearing, the City Council may take action to adopt, or not to adopt, a resolution designating the subject area as a PERMIT ONLY parking zone. Whenever any such resolution is adopted, the City Manager shall place signs giving notice of the parking restriction established by Resolution No. 93 -970, and advising that vehicle properly displaying PARKING PERMITS are exempt from said parking restrictions. B. Issuance of Parking Permits 1. Whenever a PERMIT ONLY parking zone [hereinafter referred to as "zone(s) ] is established pursuant to applicable provisions set forth herein, property owners and /or residents of said zone may apply for one or more Parking Permits to exempt their vehicle(s) from the parking restrictions applicable to said zone. 2. Whenever a parking permit is issued pursuant to these provisions, the vehicle to which said permit is issued shall be exempt from the parking restrictions set forth in Resolution No. 93 -970, and /or any amendment thereto. Whenever the term "permit(s) is used in these policies and procedures, said term shall mean a permit issued to a particular vehicle for the permit period as defined herein. Said term shall not apply to Guest Permits. 3. Permits shall only be issued to vehicles registered to the owner or resident of property located within a zone. 4. Permits shall only be issued subsequent to the City's review and approval of the information set forth in a Parking Permit Application [hereinafter referred to as "Application(s)]. 5. In order to be approved, an Application must state, contain or be accompanied by the following information: a. the license number of the vehicle to be exempt; b. documents which sufficiently prove that the address of the registered owner of the vehicle is within a zone; c. documents and /of information which clearly demonstrates that there are at least four ( 4 ) other vehicle registered to individuals residing at the address of the registered owner of the vehicle to he issued a permit. d. a permit application tee equal to twenty -five dollars ($25.00) per permit. A permit may only be issued to a vehicle when and if there are at least four (4) other vehicle registered to individuals residing at said address. Exceptions: The requirement that there must be at least four (4) other vehicles registered at the subject address may be reduced when it is demonstrated that the dimensions of the garage and driveway at said address, as originally approved and constructed, are not large enough to accommodate four (4) vehicles. In such case the number of other vehicles registered to said address may be reduced to the number of vehicles which can be accommodated by the garage and driveway as originally approved and constructed, provided that said number shall not be less than two (2). 7. No more than two (2) permits may be issued to any one address. 8. Permits may only be issued to specific vehicles. The Application shall clearly indicate the license number of the vehicle to be issued a permit. Permits are non - transferable and shall be affixed to the vehicle at the left rear bumper of the vehicle, or at another suitable location subject to the approval of the City. 9. At the sole discretion of the City, an applicant may be required to present documents which clearly verifies the information required by the Application (i.e. vehicle registration, proof of residency, etc.). 10. Permits shall be valid for the period specified on the approved Application. The permit expiration date shall be 30th day of June of the permit period stated on the Application. Applications for permit renewal should be submitted to the City by April 30 of said year, in order to allow adequate time for the processing and issuance of renewed permits. 11. A Permit issued pursuant to these procedures shall not be effective unless said permit is attached to the left rear of the vehicle. 12. Issuance of a Permit to a vehicle shall not exempt said vehicle from any provision of any other City regulation or any provision of the California Vehicle Code. Policies and Procedures Permit Only Parking Page 5 13. Permits shall not be issued to any over weight vehicle as defined by City Ordinance or the California Vehicle Code. Permits shall not be issued to commercial vehicles or to vehicle with business identification on said vehicle. 14. Prior to issuance of any permit, the applicant shall pay a $25.00 permit fee for each permit issued, except that there shall be NO CHARGE for the first permit issued to the subject address. 15. The permit fee may be waived upon documentation of economic hardship by the applicant. The applicant shall qualify for said fee waiver upon demonstration that his or her family income is equal to or less than two - thirds of the current figure for the median family income for the County of Ventura, for his /her family size. 16. The procedures for the issuance of Guest Permits is as follows: a. All of the requirements of Paragraph B -6 shall apply. b. No more than one (1) Guest Permit may be issued for any given period of time_ c. The length of time approved for a Guest Permit shall not exceed fourteen (14) days. d.
