A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, INITIATING
PROCEEDINGS, DIRECTING THE PLANNING COMMISSION
TO STUDY, SET A PUBLIC HEARING, AND PROVIDE A
RECOMMENDATION TO THE CITY COUNCIL PERTAINING
TO PROPOSED AMENDMENT OF ORDINANCE NO. 189,
CITY OF MOORPARK ZONING ORDINANCE, INCLUDING
REVISIONS TO ARTICLE 18, ZONING MAP, FOR
GENERAL PLAN AND ZONING ORDINANCE CONSISTENCY
PURPOSES
WHEREAS, on May 13, 1992, the City Council adopted an updated
General Plan Land Use Element; and
WHEREAS, the land use plan adopted as part of the 1992 Land
Use Element update included new Public Institutional and Open Space
designations for properties; and
WHEREAS, the City Council subsequently adopted Ordinance No.
155, approving Zoning Map revisions which were intended to be
consistent with the land use designations in the Land Use Element;
and
WHEREAS, the Open Space zone designations approved by
Ordinance No. 155 did not include an acreage designation consistent
with the intent of the Land Use Element update; and
WHEREAS, the Zoning Map should be revised to show an
Institutional Zone designation for properties designated as Public
Institutional in the General Plan Land Use Element for consistency
purposes; and
WHEREAS, Section 65860(d) of the Government Code requires that
in the event that a zoning ordinance becomes inconsistent with a
general plan by reason of amendment to such a plan, or to any
element of such a plan, such zoning ordinance shall be amended
within a reasonable time so that it is consistent with the general
plan as amended; and
WHEREAS, Ordinance No. 189 adopted a new Zoning Ordinance and
was approved by the City Council on March 2, 1994; and
WHEREAS, the City's Zoning Map currently includes a Trailer
Park Development (TPD) Zone designation, and that designation is
not consistent with the City of Moorpark Zoning Ordinance, No. 189,
and should be revised to Residential Planned Development (RPD); and
WHEREAS, Section 8115 -1.1.a of Ordinance No. 189 provides that
an amendment of the Zoning Ordinance may be initiated by the
adoption of a Resolution of Intention by the City Council
requesting the Planning Commission to set the matter for study,
hearing, and recommendation within a reasonable time.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council does hereby initiate
consideration of amendments to revise Ordinance No. 189, City of
Moorpark Zoning Ordinance, including Article 18, Zoning Map, to
achieve consistency with the General Plan Land Use Element,
consistency between all Articles of Ordinance No. 189, and to make
other minor changes or corrections that are determined necessary.
SECTION 2. That the Planning Commission is hereby directed to
study, set a public hearing, and "provide a recommendation to the
City Council pertaining to necessary Zoning Ordinance revisions,
including revisions to Article 18, Zoning Map.
SECTION 3. That the City Clerk shall certify to the passage
and adoption of this resolution, and shall forward a certified copy
of said resolution to the Planning Commission.
