HomeMy WebLinkAboutRES CC 1995 1103 1995 0222RESOLUTION NO. 95 -1103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTENT TO VACATE LASSEN AVENUE AND OTHER RIGHTS -OF -WAY AS SHOWN IN EXHIBIT "A" WHEREAS, Lassen Avenue and other rights -of -way has been dedicated to the City for public street purposes via the recordation of Parcel Map 21PM35; and WHEREAS, subsequent to said recordation, the design of the circulation system for the properties to be served by said street have been significantly amended; and WHEREAS, the circulation system no longer requires and does not include the public street identified on Exhibit "A ". NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the public interest, convenience and necessity so requiring, it is the intention of the City Council of the City of Moorpark to vacate the rights -of -way as identified on Exhibit "A" which rights -of -way are in the City of Moorpark, California. Further particulars with reference to said proposed street and rights -of -way vacation may be obtained from certain maps and reports on file in the office of the City Clerk of the City of Moorpark. Section 2. That the Planning Commission of the City of Moorpark has determined that said street and rights -of -way vacation is in conformance with the Moorpark General Plan as required by Section 65402 of the Government Code of the State of California. Section 3. That the City Council of the City of Moorpark hereby elects to proceed with said vacation pursuant to the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California. Section 4. That 7:00 p.m. on the 15th day of March, 1995, in the Community Center at 799 Moorpark Avenue in the City of Moorpark, California, is hereby fixed as the time and place at which a hearing will be held before the City Council, at which time and place all persons interested in or objecting to the proposed vacation may appear and be heard. Section 5, The City Clerk is authorized and directed to post notices of said proposed vacation conspicuously along the line of the street to be vacated at least ten (10) days before the date of said hearing. Such notices shall be prepared and posted pursuant to Section 8322 of the Streets and Highways Code of the State of California. Section 6. This resolution shall be posted in three public places in the City of Moorpark. PASSED, APPROVED AND ADOPTED this =2nd day of February 1995.
