HomeMy WebLinkAboutRES CC 1995 1123 1995 0503RESOLUTION NO. 95 -1123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA APPROVING MINOR MODIFICATION NO 1 OF MAJOR MODIFICATION NO. 2 TO CPD 89 -1 ON THE APPLICATION OF VENTURA PACIFIC CAPITAL GROUP VI WHEREAS, on September 7, 1994, the City Council approved Resolution No. 94 -1074 for approval of Major Modification No. 2 to CPD 89 -1 and PM 4961 for property identified as Assessor Parcel No.s 511- 080 -195, -205, -215, -245, -255, -265, -315, and -325; and WHEREAS, on April 7, 1995, Ventura Pacific Capital Group VI applied for Minor Modification No. 1 of Major Modification No. 2 to CPD 89 -1, and; WHEREAS, at its meeting on May 3, 1995, the City Council discussed Minor Modification No. 1 and approved the Minor Modification with conditions. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council has determined that approval of the Minor Modification is categorically exempt from CEQA requirements as a Class 1 exemption for minor alterations. SECTION 2. The Council approves Minor Modification No.l to Major Modification N0.2 to CPD 89 -1, subject to the following conditions: DEPARTMENT OF COMMUNITY DEVELOPMENT CONDITIONS GENERAL REQUIREMENTS 1) Deletion of Condition 42 of the conditions for Major Modification No. 2 to CPD 89 -1 as follows: 2) The applicant shall incorporate changes to the Site Plan, including: a. Expanding the building separation between the Supermarket and the Theater from 10.5' to 40' and going to a Type III building for the Theater and Shop One Building, while maintaining 60' sideyards to the north, west and south. Modification to the northern most boundary separating the project from the future park and housing to conform to the current Moorpark Redevelopment Agency plan for the property north of the project. Provisions for vehicular access off Sierra, emergency vehicular access into the park parking lot, pedestrian access points at the park parking lot and at the end of Lassen Avenue have been made. C. The hardscape plans for the 22' and 40' separations between Kmart and Albertson's and the theater and Albertson's, respectively along with the area just south of the Theater and north of the outdoor seating area for Shop 1 shall be tied together in theme to create a plaza or portico atmosphere to encourage the community's use and enjoyment of the project, generally consistent with Site Plan /Sheet SD2 and Sheet HD1 dated 4/5/95 and subject to final approval by the Director of Community Development. (See Site Plan /Sheet SD2 and Sheet HD1) d. Future construction of the 6,000 s.f. area shall not require a modification if it is built as currently approved. 3) The three pad buildings (A,C and D) are approved as shown on the plans dated March 5, 1995. 4) The elevations of Shop Building No. 1 to the south, north and west are approved as revised pursuant to Sheet Numbers 7 and 8. This will also include the separate hardscape and fountain area immediately adjacent to the southwest corner of this building for outdoor seating for the proposed Restaurant as shown on Sheet No. 7. 5) The permit is granted for the land and project as identified on the entitlement application form and as shown on the approved plot plans dated March 5, 1995, elevations dated April 5, 1995 and Floor Plans dated February 27, 1995. The location and design of all site improvements shall be as shown on the approved plot plans and elevations submitted with this application. 6) The eight foot high wall along the west property line shall be installed by this applicant. The wall shall continue southward to the building setback line. If the adjacent property owner constructs the wall first, then this applicant shall be exempted from constructing the wall where it would be duplicated. The applicant shall construct the wall adjacent to the property known as Assessor's Parcel No. 511 -0- 080 -42 prior to the issuance of a Zoning Clearance for construction of Pad A. PP04:14:95111:92amA:\CC.RES 2 B. The proposed wrought iron fence located along the northerly border of the property shall be constructed with pilasters located 10 feet on- center. The design of the fences is subject to review and approval of the Director of Community Development. The applicant shall be responsible for maintaining the fence. 9) The 22 foot buffer located east of the Albertson's and the 40 foot separation between the Albertson's and the Theater shall not be used for storage. 10) Failure to inaugurate this Minor Modification in twelve months or less from the date of approval will render this modification null and void. 11) A one year extension to this Minor Modification Permit may be granted by the Director of Community Development upon the written request and payment of the appropriate filing fee. SECTION 3. That Minor Modification No. 1 is also subject to the same conditions as Major Modification 2 to CPD 89 -1, unless amended by this Resolution.
