A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA APPROVING MINOR MODIFICATION NO. 2 TO INDUSTRIAL PLANNED
DEVELOPMENT PERMIT NO. 89 -2 - GENERAL OPTICS
WHEREAS, the expiration date in which to "use inaugurate"
Industrial Planned Development permit ended on April 15, 1995; and
WHEREAS, on May 4, 1995, General Optics applied for Minor
Modification No. 2 to Industrial Planned Development Permit No. 89-
2 requesting a two year extension to "use inaugurate" the project
on land identified as Assessor's Parcel No. 511 -0 -07- -720; and
WHEREAS, the Director of Community Development referred
the matter to the City Council on .Lune 7, 1995 since the current
conditions do not grant the Directo- the ab;-lity to further extend
the project; and
WHEREAS, at the City Council hearing on June 7, 1995, the
City Council considered the application filed by General Optics,
requesting approval of Minor Modification No. 2 to IPD 89 -2; and
WHEREAS, at its meeting of June 7, 1994, the City Council
after review and consideration of the information contained in the
staff report dated May 4, 1995 reached a decision on this matter;
and
WHEREAS, the City Council determined that this project is
categorically exempt from CEQA requirements as a Class 1 exemption
for minor alterations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Based upon the information and findings, the City
Council conditionally approved Minor Modification No. 2 to IPD 89 -2
for a one (1) year time extension iT- order to "use inaugurate" the
project ending on April 15, 1996.
SECTION 2. The City Council has determined that the application
for Minor Modification No. 2 to :PD 89 -2, with the following
conditions meets the requirements of the Moorpark Ordinance Code in
that:
a. The Minor Modification is consistent with the intent and.
provisions of the City's General Plan and of the City
Ordinance Code;
b. The Minor Modification is compatible with the character of
surrounding development;

c. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses;
d. The Modification would not be detrimental to the public
interest, health, safety, convenience, or welfare; and
e. The conditionally permitted use is compatible with existing
and planned land uses in the general area where the
development is to be located.
SECTION 3. Approval of Minor Modification No. 2 to IPD 89 -2 is
subject to the following Conditions:
1. That unless the use is inaugurated (building foundation slab
in place and substantial work in progress) not later than one
year after Minor Modification No. 2 to IPD 89 -2 is granted,
this permit shall automatically expire on April 15, 1996.
2. The Conditions of approval for this Minor Modification are in
addition to the conditions of approval to IPD 89 -2 and those
approved for Minor Modification No. 1
PASSED, APPROVED AND ADOPTED THIS 21ST DAY OF JUNE, 1995.
