A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA APPROVING MINOR MODIFICATION NO. 3 TO
RESIDENTIAL PLANNED DEVELOPMENT PERMIT 89 -3 (MOORPARK
PRESBYTERIAN CHURCH).
WHEREAS, on July 25, 1990, the City Council adopted Resolution
No. 90 -699 approving Residential Planned Development Permit No. 89-
3; and
WHEREAS, on August 14, 1995, the applicant applied for Minor
Modification No. 3 to Residential Planned Development Permit No.
89 -3; and
WHEREAS, the Director of Community Development referred the
matter to the City Council on September 20, 1995; and
WHEREAS, at its meeting of September 20, 1995, the City
Council considered the application filed by the Moorpark
Presbyterian Church, requesting approval of Minor Modification No.
3 to RPD 89 -3; and
WHEREAS, at its meeting of September 20, 1995, the City
Council after review and consideration of the information contained
in the staff report dated September 8, 1995 reached a decision on
this matter; and
WHEREAS, the City Council determined that this project is
categorically exempt from CEQA requirements as a Class 14 exemption
for minor additions.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Based upon the information and findings, the City
Council conditionally approved Minor Modification No. 3 to RPD 89 -3
for the placement of a third portable classroom and time extension.
SECTION 2. The City Council has determined that the
application for Minor Modification No. 3 to RPD 89 -3, with the
following conditions meets the requirements of the Moorpark
Ordinance Code in that:
a. The Minor Modification is consistent with the intent and
provisions of the City's general Plan and of the City
Ordinance Code;
b. The Minor Modification is compatible with the character of
surrounding development;
c. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses;
d. The Modification would not be detrimental to the public
interest, health, safety, convenience, or welfare; and
e. The conditionally permitted use is compatible with existing
and planned land uses in the general area where the
development is to be located.
SECTION 3. Approval of Minor Modification No. 3 to RPD 89 -3 is
hereby approved with the following conditions:
1. A landscape plan prepared by a California licensed landscape
architect is to be submitted to the Community Development
Department. The landscape plan is to be approved by the
Director of Community Development. Additional landscaping
shall be planted adjacent to Peach Hill Road and on the corner
of Spring Road and Peach Hill, and around the perimeter of the
new classroom.
2. Approval of a Zoning Clearance and landscape plan is required
before the building can be placed on the site.
3. All portable buildings on the site must be removed within six
years from the date of approval of this Minor Modification.
4. Failure to inaugurate this Minor Modification in twelve months
or less from the date of approval will render this
Modification null and void.
SECTION 4. The City Clerk shall certify to the adoption of
this Resolution.
PASSED, APPROVED, AND ADOPTED THIS 20 DAY OF SEPTEMBER, 1995.
