HomeMy WebLinkAboutRES CC 1996 1181 1996 0207RESOLUTION NO. 96- 1181 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA APPROVING ADMINISTRATIVE PERMIT NO. 95 -20 (SELSA AND MAURO TELLO). WHEREAS, on December 15, 1995, the applicant applied for Administrative Permit No. 95 -20 to Planned Development Permit No. 863; and WHEREAS, the Director of Community Development referred the matter to the City Council on January 17, 1996; and WHEREAS, at its meeting of January 17, 1996, the City Council considered the application filed by Selsa and Mauro Tello, requesting approval of Administrative Permit No. 95 -20; and WHEREAS, at its meeting of January 17, 1996, the City Councils after review and consideration of the information contained in the staff report dated January 3, 1996 reached a decision on this matter; and WHEREAS, the City Council determined that this project is categorically exempt from CEQA requirements as a Class 5 exemption for alterations in land use limitations. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Based upon the information and findings, the City Council conditionally approved Administrative Permit No. 95 -20 for approval of a Liquor Public Convenience and Necessity Permit for the sale of alcoholic beverages. SECTION 2. The City Council has determined that the application for Administrative Permit No. 95 -20, with the following conditions meets the applicable requirements of the Moorpark Municipal Code in that: a. The Administrative Permit is consistent with the intent and provisions of the City's General Plan and of the Municpal Code; b. The Administrative Permit is compatible with the character of surrounding development; C. The proposed Administrative Permit would not be obnoxious or harmful, or impair the utility of neighboring property or uses; d. The Permit would not be detrimental to the public interest, health, safety, convenience, or welfare; and 00009'7 e. The conditionally permitted use is compatible with existing and planned land uses in the general area where the development is to be located. SECTION 3. Approval of Administrative Permit No. 95 -20 is hereby approved with the following condition: 1. Approval of this permit is for the off -sale of beer and wine in conjunction with the sale of take out food only. No food or alcoholic beverages are to be consumed on site. If the restaurant ceases its sale of prepared food in the same manner as it currently operates, then this Administrative Permit shall become null and void and the sale of off -site alcoholic beverages shall cease immediately. The City shall henceforth notify Alcoholic Beverage Control of the cancellation of Administrative Permit No. 95 -20. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
