A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA APPROVING MINOR MODIFICATION NO. 4 OF MAJOR
MODIFICATION NO. 2 TO CPD 89 -1 AND MINOR MODIFICATION NO.
10 TO CPD 89 -2 ON THE APPLICATION OF MISSION BELL
PARTNERS
WHEREAS, on September 7, 1994, the City Council approved
Resolution No. 94 -1074 for approval of Major Modification No. 2 to
CPD 89 -1 and PM 4961 for property identified as Assessor Parcel
Nos. 511 - 080 -195, -205, -215, -245, -255, -265, -315, and -325; and
WHEREAS, on April 3, 1996 , Mission Bell Partners applied
for Minor Modification No. 4 to Major Modification No. 2 to CPD
89 -1 and Minor Modification No. 10 to CPD 89 -2 for approval of
reimbursement to Mission Bell Partners of the "Art in Public
Places" deposit, and;
WHEREAS, at its meeting on May 15, 1996, the City Council
discussed the applicant's requested Minor Modifications and
conditionally approved them.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council has determined that approval
- of the requested Minor Modifications are categorically exempt from
CEQA requirements as a Class 1 exemption for minor alterations.
SECTION 2. The Council approves Minor Modification No.4
to Major Modification No.2 to CPD 89 -1, and Minor Modification No.
10 to CPD 89 -2 subject to the following conditions:
DEPARTMENT OF COMMUNITY DEVELOPMENT CONDITIONS
Upon completion of the artwork to the satisfaction of the Director
of Community Development, the applicant shall be reimbursed the
amount paid by the applicant for "Art in Public Places" in the
amount of $24,946.49 to be distributed as follows:
1. Reimbursement to Mission Bell Partners of $14,077.90,
paid during development of Phase 1, pursuant to Condition
No. 50 of CPD 89 -2 and $5,285.20 paid by El Polo Loco and
Albertson's, pursuant to Condition 24 of CPD 89 -1.
2. Reduction of the Promissory Note with the City in the
amount of $5,601.39, representing the Art in Public
Places Fee portion of the note for Shops, Pads and
Theater.

SECTION 3. That the City Council has determined that the
application for the Minor Modifications meets the requirements of
the Moorpark Ordinance Code in that:
a. The Minor Modifications are consistent with the intent
and provisions of the City's General Plan and the City
Ordinance Code;
b. The Minor Modifications are compatible with the character
of surrounding development;
C. The proposed Minor Modifications would not be harmful, or
impair the utility of neighboring property or uses; and
d. The Modifications would not be detrimental to the public
interest, health, safety, convenience, or welfare.
SECTION 4. That the Minor Modifications No. 4 to CPD 89-
1 Major Modification No. 2 and Minor Modification No. 10 to CPD
89 -2 are subject to the same conditions as previously approved for
the projects, unless amended by this Resolution.
PASSED, APPROVED, AND ADOPTED THIS 15TH DAY OF MAY, 1996.
