HomeMy WebLinkAboutRES CC 1996 1214 1996 0702RESOLUTION NO. 96 -1214 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESCINDING RESOLUTION 94 -1090, AND REVISING THE ESTABLISHED APPROVAL OF FILM /PHOTOGRAPHY PERMIT FEES WHEREAS, it is appropriate for the City to establish fees for filming and photography activities in the City of Moorpark; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. That the City Council hereby approves the fee schedule as follows: A) Preliminary Review Fee $100 Per Application B) Preliminary Review Deposit $600 Per Application C) City Film Permit Fee $600 Per Day D) City Film Permit Deposit 1). $1,000 1 to 2 day projects 2). $1,500 3 to 5 day projects 3). $2,000 6 to 9 day projects 4). $5,000 10 day projects or more 5). $ 500 for those projects defined in Section 4 SECTION 2. That when it can be demonstrated to the satisfaction of the City that an entire project, including parking, noise and lighting, can be contained within the legal boundaries of a private property owner, with the property owner's approval, the fee schedule shall be as follows: A) Preliminary Review Fee $100 Per Application B) Preliminary Review Deposit $250 to $600 Per staff's discretion C) At staff's discretion, minor changes can be permitted under this section which apply to a minimal use of City property and /or Right of Way, where an encroachment permit would be issued at the current rate, and where if needed, City and /or Redevelopment Agency property can be rented for $100 per day when used only for parking. SECTION 3. The fees presented in this resolution shall be applied independent of other charges applicable to filming /photography activities in the City including but not limited to police services, and rental of City property. SECTION 4. Any and all costs which may occur during the effective dates of the film permit shall be billed by the City at the per hour rate for staff costs based on the applicable City Resolution, for any actual out -of- pocket costs plus 15 percent for costs not related to staff, and are in addition to those fees set forth in this resolution. SECTION 5. All applications for a Film Permit which are submitted from persons or companies that are permanently located in the City of Moorpark as a business and /or represent a non - profit organization (and have verified the non - profit status by submitting a copy of the Internal Revenue Service 501.C.3 document) will be exempt from the fees stipulated in "1.C" and 111.E" above, and billed at actual City costs (including overhead), per the applicable City resolutions establishing said rates.
