HomeMy WebLinkAboutRES CC 1996 1216 1996 0807RESOLUTION NO. 96 - 1216 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, FINDING AND DECLARING CERTAIN PRIVATE ROADS AND PARKING FACILITIES WITHIN TRACT 4792 [TRADITIONS] SUBJECT TO THE PROVISIONS OF THE CALIFORNIA VEHICLE CODE WHEREAS, Tract 4792 [Traditions], identified on Exhibit "A" attached hereto and made a part hereof, has within it certain privately owned roads which, although not generally held open for use of the public for vehicular travel, are connected to a public street; and, WHEREAS, Section 21107.7 of the California Vehicle Code (CVC) allows for the enforcement of said code upon such privately owned and maintained roads, upon receipt of a request for such enforcement from the property owner; and, WHEREAS, said Tract 4792 also has within it certain privately owned and maintained off street parking facilities which are generally held open for use by the public for vehicular parking; and, WHEREAS, pursuant to CVC Section 21107.8, CVC Sections 22350, 23103, 23109 and Division 16.5 (Section 38000 et.seq.) may be made applicable to such facilities; and, WHEREAS, the owner of these privately owned and maintained roads and parking facilities has requested that said traffic and parking regulations be enforced within those facilities; and; WHEREAS, pursuant to the requirements of said code, a public hearing has been held on the matter and the owner of the affected property was notified of said hearing at least ten (10) days prior to the date thereof. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That, pursuant to CVC Sec. 21107.7, certain privately owned and maintained roads within the Traditions Homeowners' Association [Tract 4792], as generally shown on Exhibit 'A', which are not generally held open for the use of the public for vehicular travel, but which are connected to a public street, shall be subject to the provisions of the California Vehicle Code. Resolution No. 96- Page 2 SECTION 2. That, pursuant to CVC Sec. 21107.8, certain privately owned parking facilities within the aforesaid HOA, which are generally held open for public use, shall be subject to Sections 22350, 23103, 23109 and Division 16.5 (Section 3800 et.seq.) of the California Vehicle Code. SECTION 3. That the above traffic and parking regulations shall take effect upon the placement of appropriate signs giving notice of said regulation. SECTION 4. That said signs shall be placed and maintained by the property owner and shall comply with the requirements set forth in Section 21107.7 (a) and Section 21107.8 (b) of the California Vehicle Code.
