Resolution NO. 97 - 1322 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTENT TO VACATE PEDESTRIAN EASEMENTS ON LOTS 64 AND 65 OF FINAL MAP NO. 4342-3, AT THE EAST END OF SAGEWOOD DRIVE Vacation No. V -97 -1 WHEREAS, a 10 foot wide pedestrian easement on lots 64 and 65 of Final Map No. 4342 -3, at the east end of Sagewood Drive, was dedicated to the City of Moorpark; and, WHEREAS, it has been determined that said easement provides no public benefit and is of no interest to the City of Moorpark; and, WHEREAS, it is appropriate, therefore, to consider the vacation of said easement. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the public interest, convenience and necessity so requiring, it is the intention of the City Council of the City of Moorpark to vacate the pedestrian easements as shown across lots 64 and 65 of Tract 4342 -3, at the east end of Sagewood Drive, more particularly shown in Exhibit "A" attached hereto and made a part hereof. Further particulars with reference to said proposed vacation may be obtained from certain maps and reports on file in the office of the City Clerk of the City of Moorpark. SECTION 2. That the City Council of the City of Moorpark hereby elects to proceed with said vacation pursuant to the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California. Owl-19 SECTION 3. That 7:00 P.M. on the 18th day of June, 1997, in the Community Center at 799 Moorpark Avenue in the City of Moorpark, California, is hereby fixed as the time and place at which a hearing will be held before the City Council, at which time and place all persons interested in or objecting to the proposed vacation may appear and be heard. SECTION 4. The City Clerk is authorized and directed to post notices of said proposed vacation conspicuously along the line of the street to be vacated at least ten (10) days before the date of said hearing. Such notices shall be prepared and posted pursuant to Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. This resolution shall be posted in three public places in the City of Moorpark.
