A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA DENYING COMMERCIAL PLANNED DEVELOPMENT PERMIT
NO. 96 -2 MINOR MODIFICATION NO. 1 WITHOUT PREJUDICE (SAN
PEDRO SIGNS)
WHEREAS, on December 18, 1996, the City Council adopted
Resolution No. 96 -1258 approving Commercial Planned Development
Permit No. 96 -2; and
WHEREAS, on May 22, 1997, the applicant applied for
Commercial Planned Development Permit No. 96 -2 Minor Modification
No. 1 for approval of a sign program; and
WHEREAS, staff conduced an environmental review of the
proposed application and determined that the project is
Categorically Exempt from the California Environmental Quality Act
requirements as a Class 1 exemption for the minor alteration of
private structures.
WHEREAS, the Director of Community Development recommended
denial of Commercial Planned Development Permit No. 96 -2 Minor
Modification No. 1 on June 30, 1997; and
WHEREAS, the City Council after review and consideration of
the information contained in the Staff Report and testimony which
was received at the July 16, 1997 meeting reached a decision on
this matter; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby denies Commercial Planned
Development No. 96 -2 Minor Modification No. 1 without prejudice
based on the findings set forth in section 2 and on information in
the Staff Report dated June 30, 1997, which report in incorporated
herein by reference as though fully set forth:

SECTION 2. The City Council adopts the following findings:
1. The Minor Modification is not consistent with the intent and
provisions of the City's General Plan and of the City
Ordinance Code;
2. The Minor Modification is not compatible with the character of
surrounding development;
3. The proposed Minor Modification would be obnoxious or harmful,
or impair the utility of neighboring property or uses;
4. The Permit would be detrimental to the public interest,
health, safety, convenience, or welfare; and
5. The conditionally permitted use is not compatible with
existing and planned land uses in the general area where the
development is to be located.
6. The proposed project will have a substantial adverse impact on
surrounding properties.
SECTION 3. The City Clerk shall certify to the adoption of
this Resolution.
PASSED, APPROVED, AND ADOPTED THIS 16 DAY OF 1996.
