HomeMy WebLinkAboutRES CC 1997 1387 1997 0827RESOLUTION NO. 97 -1387 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA RESCINDING RESOLUTION NO. 97 -1363 AND APPROVING MINOR MODIFICATION NO. 2 TO COMMERCIAL PLANNED DEVELOPMENT PERMIT NO. 96 -2 ON THE APPLICATION OF SAN PEDRO SIGNS FOR APPROVAL OF A SIGN PROGRAM FOR A COMMERCIAL BUILDING LOCATED AT 555 AND 561 NEW LOS ANGELES AVENUE AS REVISED (ASSESSOR PARCEL NO. 512- 0 -180- 100) WHEREAS, at its meeting of August 20, 1997 the City Council considered the application filed by San Pedro Signs, requesting approval of Minor Modification No. 2 to Commercial Planed Development Permit No. 96 -2 for approval of a sign program and the addition of awnings to the building; and WHEREAS, at its meeting of August 20, 1997, the City Council after review and consideration of the information contained in the staff report dated August 8, 1997 reached a decision on this matter. WHEREAS, at its meeting of September 3, 1997, the City Council reconsidered the Minor Modification and directed to eliminate approval of the awnings City Council Resolution No. 97 -1363 is hereby rescinded and replaced. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. City Council Resolution No. 97 -1363 is hereby rescinded and replaced. SECTION 2. Based upon the information and findings presented in the staff report and accompanying documents, and public testimony, the City Council finds that: a. The project is Categorically Exempt from California Environmental Quality Act requirements as a Class 1 exemption for the operation or alteration of private structures. b. The proposed project would not have a substantial adverse impact on surrounding properties; 000116 Resolution 97- San Pedro Signs Page 2 C. The Minor Modification is consistent with the intent and provisions of the City's general Plan and of the City Ordinance Code; d. The Minor Modification is compatible with the character of surrounding development; e. The proposed Minor Modification would not be obnoxious or harmful, or impair the utility of neighboring property or uses; f. The Minor Modification would not be detrimental to the public interest, health, safety, convenience, or welfare; g. The proposed signs, as conditioned are similar to the signs in centers along Los Angeles Avenue and are not out of scale with the buildings elevations; SECTION 3. The City Council conditionally approves Commercial Planned Development Permit No. 96 -2 Minor Modification No. 2 for adoption of a sign program as revised. SECTION 4. Approval of Minor Modification No. 2 to Commercial Planned Development Permit No. 96 -2 is hereby approved subject to the following revised conditions: 1. Approval of a Sign Permit is required prior to installation of any sign. 2. All conditions of approval in Resolution No. 96 -1258 apply. 3. Sign Program for any other tenants shall be as shown on Exhibit 1 (attached) and also including the monument sign as shown on Exhibit 2 (attached) 4. The Starbucks logo on the southern elevation shall be eliminated. 5. Sign letters shall not exceed 24" in height. 6. Awnings will not be allowed. 7. Neon trim shall not be allowed on the building. UUU:L(;7 Resolution 97- San Pedro Signs Page 3 8. The sign program shall be modified to allow future tenants a choice of four permitted colors and three lettering styles. 9. The Director of Community Development may declare a development project that is not in compliance with the conditions of approval or for some other just cause, a "public nuisance ". The applicant shall be liable to the City for any and all costs and expenses to the City involved in thereafter abating the nuisance and in obtaining compliance with the conditions of approval or applicable codes. If the applicant fails to pay all City costs related to this action, the City may enact special assessment proceedings against the parcel of land upon which the nuisance existed (Moorpark Municipal Code Section 1.12.080) 10. The continued maintenance of the landscaping, permit area, and facilities shall be subject to periodic inspection by the City. The permittee shall be required to remedy any defects in ground maintenance, as indicated by the Code Enforcement Officer within thirty (30) days after notification. 11. The applicant and successors, heirs, and assigns shall remove any graffiti within five (5) days from written notification by the City of Moorpark. All such graffiti removal shall be accomplished to the satisfaction of the Director of Community Development. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
