A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA APPROVING MINOR MODIFICATION NO. 1 TO
INDUSTRIAL PLANNED DEVELOPMENT PERMIT NO. 95 -2 ON THE
APPLICATION OF SPECIAL DEVISES, INC. FOR A MODIFICATION
TO APPROVED SITE PLAN AND ELEVATIONS AT 14370 LOS ANGELES
AVENUE (ASSESSOR'S PARCEL NO. ISSUED SUBSEQUENT TO FILING
OF THE FINAL MAP)
WHEREAS, on August 21, 1996, the City Council adopted
Resolution No. 96 -1222 approving Tentative Parcel Map No. 5004 and
Industrial Planned Development Permit No. 95 -2 for 131,200 sq.ft
of building improvements.
WHEREAS, On September 4, 1997, Special Devices, Inc. applied
for Minor Modification No. 1 to Industrial Planned Development
Permit No. 95 -2 to modify the site plans and elevations to the
approved building; and
WHEREAS, Minor Modification No. 1 would modify the proposed
development by the following:

Building 300
Building 400
Building 500
119,796 sq. ft.
26,523 sq. ft.
12,605 sq. ft.
4,371 sq. ft.
Total 166,908 sq. ft.
WHEREAS, the Director of Community Development referred the
matter to the City Council on August 20, 1997; and
WHEREAS, at its meeting of September 17, 1997, the City
Council considered the application filed by Special Devices, Inc.
for Minor Modification No. 1 to Industrial Planned Development

Permit No. 95 -2 to modify the site plans and elevations to the
approved building; and
WHEREAS, at its meeting of September 17, 1997, the City
Council after review and consideration of the information contained
in the staff report dated September 5, 1997 and reached a decision
on this matter.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Based upon information in the Staff Report and
accompanying information and information from the public testimony,
the City Council finds that:
a. The proposed improvements addressed by this Minor Modification
were addressed in the Environmental Impact Report previously
certified by the City Council on August 21, 1996;
b. The proposed project would not have a substantial adverse
impact on surrounding properties;
C. The Minor Modification is consistent with the intent and
provisions of the City's general Plan and of the City
Ordinance Code;
d. The Minor Modification is compatible with the character of
surrounding development;
e. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses;
f. The Modification would not be detrimental to the public
interest, health, safety, convenience, or welfare; and
g. The proposed use is compatible with the scale, visual
character and design of the surrounding properties, designed
so as to enhance the physical and visual quality of the
community, and the structure has design features which provide
visual relief and separation between land uses of conflicting
character.
h. The proposed minor modification is consistent with the
Development Agreement approved by the City Council on August

SECTION 2. The City Council conditionally approves Minor
Modification No. 1 for a two story tilt -up industrial
manufacturing /office building and four smaller accessory buildings
containing a total building square footage of 166,908 sq. ft.
subject to compliance with Conditions of Approval contained in
Resolution 96 -1222 for IPD 95 -2 approved by the City Council on
August 17, 1996, subject to the following conditions:
1. The plans shall be consistent with the plans submitted to
the Planning Department on September 2, 1997.
2. The first building permit for any increase in building
footprint subsequent to approval of the currently
proposed buildings shall require payment of AOC fees for
the balance of the developable pad at the rate that is in
effect at the time of permit issuance.
3. All previous conditions of approval for IPD 95 -2 remain
in full force and effect.
SECTION 4. The City Clerk shall certify to the adoption of
this Resolution.
