A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DENYING INDUSTRIAL PLANNED
DEVELOPMENT PERMIT NO. 97 -4, CONDITIONAL USE
PERMIT NO. 98 -4 AND VESTING TENTATIVE PARCEL MAP
NO. 5123 ON THE APPLICATION OF WILLIAM BROMILEY
AT THE NORTHEAST CORNER OF FLINN AVENUE AND
SPRING ROAD (ASSESSOR PARCEL NOS. 512- 0 -171-
20/21)
WHEREAS, at a duly noticed public hearing on September
14, 1998, the Planning Commission held a public hearing and
conditionally recommended to the City Council approval of
Industrial Planned Development Permit No. 97 -4, Conditional
Use Permit No. 98 -4 and Vesting Tentative Parcel Map No.
5123 including changes to the elevation and site plan as
directed to staff to incorporate prior to scheduling a
public hearing before the City Council.
WHEREAS, at a duly noticed public hearing on November
4, which was continued to November 18 and subsequently to
December 2, 1998, the City Council considered the
application filed by William Bromiley, requesting approval
of the following:
Industrial Planned Development Permit No. 97 -4 for a
72,400 square foot (building area) self storage
facility is proposed to be constructed on 4.019 acres.
Conditional Use Permit No. 98 -4 for approval of a
caretakers dwelling for an on -site manager.
Vesting Tentative Parcel Map No. 5123 for a
subdivision of 7.5 acres into the following two
parcels:
Gross Area Net Area
Parcel 1 4.019 acres 4.019 acres
Parcel 2 3.5 acres 3.5 acres
WHEREAS, at its meeting of November 4, 1998, the City
Council opened the public hearing, took testimony from all
those wishing to testify on the project and continued
consideration to November 18, 1998, at which time the
public hearing was closed, and subsequently continued
consideration to December 2, 1998.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council finds and determines the
following:
1. The location of the proposed project on a major
arterial roadway in the Downtown area would be
detrimental to the public interest since development
of parcels inconsistent with the comprehensive
planning of this area will jeopardize the economic
viability of the Downtown area and a Downtown area
that is not economically viable will have a
detrimental effect on the ability of the City to
finance governmental services.
2. The proposed project is not consistent with the
General Plan Land Use designation of General
Commercial or the Downtown Specific Plan.
3. The building materials and design of the buildings are
not consistent with the Downtown Specific Plan Design
Guidelines and would not be compatible with, nor
enhance the physical and visual quality of the
community.
4. The accessory recreational vehicle storage use would
not be fully screened, as proposed, which would be
detrimental to the public interest and impair
surrounding properties.
5. The proposed circulation design of the project and
subdivision would increase the number of driveways
along Spring Road, rather than centralizing them at a
common point, which could impair traffic flow which
would be detrimental to the public interest.
