A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING MINOR MODIFICATION NO.
1 TO COMMERCIAL PLANNED DEVELOPMENT PERMIT NO. 97 -1
(GHARABAGHI)
WHEREAS, on November 19, 1997, the City Council adopted
Resolution No. 97 -1409 approving Commercial Planned Development
Permit No. 97 -1; and
WHEREAS, on September 2, 1998, the applicant applied for
Minor Modification No. 1 to Commercial Planned Development
Permit No. 97 -1 for approval of a sign program; and
WHEREAS, the Director of Community Development referred the
matter to the City Council on November 18, 1998, and
WHEREAS, the City Council did make certain determinations
by consensus on November 18, 1998, concluding that the monument
sign could be a maximum of five (5) feet in height and include
fuel pricing information, that the size of the monument sign at
18.7 square feet was acceptable, that no fuel pricing signs were
required to be placed on the canopy, and that the item be
referred to staff for preparation of a resolution concerning
this direction; and
WHEREAS, staff conducted an environmental review of the
proposed sign program and determined that the project is
Categorically Exempt from the California Environmental Quality
Act requirements as a Class 1 Exemption for the minor alteration
of private structures; and
WHEREAS, the Director of Community Development referred the
matter to the City Council on January 20, 1999; and
WHEREAS, at its meeting of January 20, 1999, the City
Council considered the application filed by Eddie Gharabaghi,
requesting approval of Minor Modification No. 1; and
WHEREAS, at its meeting of January 20, 1999, the City
Council after review and consideration of the information
contained in the staff report dated January 20, 1999, reached a
decision on this matter.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Based upon the information and findings
presented in the staff report and accompanying documents, and
public testimony, the City Council finds that:
a. The project is Categorically Exempt from California
Environmental Quality Act requirements as a Class 1
exemption for the operation or alteration of private
structures;
b. The Minor Modification is consistent with the intent and
provision of the City's General Plan and of the City Zoning
Ordinance;
C. The Minor Modification is compatible with the character of
surrounding development;
d. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses;
e. The Permit would not be detrimental to the public interest,
health, safety, convenience, or welfare;
f. The proposed signs, as conditioned, are similar to the
signs at service stations /mini mart facilities along Los
Angeles Avenue and are not out of scale with the Building
elevations and proposed uses;
g. Approval and adoption of this resolution is shall delete
Conditions 50e and 50f of City Council Resolution No. 97-
1409, allowing the monument sign to have a maximum height
of five (5) feet and to allow fuel pricing signs to be
placed consistent with the provisions of the Zoning
Ordinance.
SECTION 2. The City Council conditionally approves Minor
Modification No. 1 to Commercial Planned Development No. 97 -1
for adoption of a sign program.
SECTION 3. Approval of Minor Modification No. 1 to
Commercial Planned Development Permit No. 97 -1 is hereby
approved subject to the following conditions:

1. All signage to be placed on this site shall be in
conformance with the pertaining provisions of the Zoning
Ordinance, except that the maximum allowable sign area
shall be 145.15 square feet and the sign area limitations
for wall signs and frontage of a building shall not apply.
2. Approval of a Sign Permit is required prior to installation
of any sign.
3. The sign program, site plan and elevations shall not be
revised to reflect any additional modifications, unless an
appropriate modification permit is approved by the City.
4. Sign letters shall not exceed 18" in height.
5. Neon trim shall not be allowed on the buildings or signs.
6. All lettering on the monument sign, with the exception of
the gasoline prices, shall utilize push- through letters as
required in Section 17.40.050 of the Municipal Code.
7. All signs on the building shall utilize individual channel
letters, except the car wash pricing signs.
8. All signs on the site which are to be illuminated, whether
on the building or on the monument sign shall utilize
interior illumination.
9. Any change of occupancy or use shall require approval of an
additional permit and revised sign program prior to the
installation of any sign.
10. Prior to issuance of a Sign Permit for construction of the
signs, applicant shall pay all applicable fees and all
outstanding case processing costs. Any charges incurred by
the applicant for the processing of this Minor Modification
after November 18, 1998, shall not be paid to the City, or
if they have already been paid, shall be refunded to the
applicant

SECTION 4. The City Clerk shall certify to the adoption of
this Resolution.
PASSED, APPROVED, AND ADOPTED this 20TH day of JANUARY,
1999.
