HomeMy WebLinkAboutRES CC 1999 1566 1999 0203RESOLUTION NO. 99 -1566 A RESOLUTION OF THE CITY OF MOORPARK, CALIFORNIA INITIATING PROCEEDINGS FOR THE FORMATION OF A PARKS AND RECREATION MAINTENANCE AND IMPROVEMENT DISTRICT AND ORDERING THE PREPARATION AND FILING OF AN ENGINEERS REPORT WHEREAS, the City Council of the City of Moorpark, at its meeting on November 4, 1998, directed staff to proceed with efforts to form a Parks and Recreation Maintenance and Improvement District; and WHEREAS, the Lighting and Landscape Act of 1972 requires the adoption of a resolution initiating proceedings related to the formation of an assessment district and the preparation of an engineer's report. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Council hereby proposes the formation of a landscaping and lighting district pursuant to Article XIIID of the California Constitution, and the Landscaping and Lighting Act of 1972 (the "Act "), Part 2 of Division 15 of the California Streets and Highways Code (commencing with Section 22500 thereof). SECTION 2. The purpose of the landscaping and lighting district shall be for the installation, maintenance and servicing of improvements, to the City of Moorpark described in Section 3 below. SECTION 3. Within the landscaping and lighting district, the existing and proposed improvements to be undertaken by the Parks and Recreation Maintenance and Improvement District are described as installation, maintenance and servicing of public parks and park facilities, including but not limited to, landscaping, irrigation systems, grounds, sports fields and courts, amenities, trees, playground equipment, and hardscape areas, as applicable, for public park property owned and maintained by the City of Moorpark. Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation and servicing of said improvements, including repair, removal, or replacement of Resolution No. 99 -1566 Page 2 all, or part of any improvement; providing for the life, growth, health and beauty of landscaping; and cleaning, sandblasting and painting of walls and other improvements to remove or cover graffiti. Servicing shall also mean the furnishing all necessary utilities for maintaining park improvements including, but not limited to, electricity for lighting, timers, and irrigation clocks, and water for irrigation of all landscaping, park restroom service, and general maintenance requirements for all park improvements. SECTION 4. The landscaping and lighting district proposed in this resolution is hereby given the distinctive designation of the "City of Moorpark Parks and Recreation Maintenance and Improvement District," which proposed landscaping and lighting district is primarily described as all of the park lands within the current boundaries of the City of Moorpark. SECTION 5. Shilts Consultants, Inc. is hereby designated as Engineer of Work for the purposes of these proceedings and is hereby authorized to prepare an Engineer's Report in accordance with Article 4 of Chapter 1 of the Act and Article XIIID of the California Constitution. Upon completion, the Engineer shall file the Engineer's Report with the Clerk of the City Council for submission to the Council. SECTION 6.
