A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING THE ENGINEER'S
REPORT FOR, AND DECLARING ITS INTENTION TO MAKE
CERTAIN CHANGES AND TO ORDER THE ANNUAL ASSESSMENTS
FOR THE "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE DISTRICT NO. AD -84 -2" FOR THE FISCAL
YEAR COMMENCING JULY 1, 1999, AND ENDING JUNE 30,
2000, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT
OF 1972, AND FIXING THE TIME AND PLACE FOR A PUBLIC
HEARING TO RECEIVE OBJECTIONS THERETO.
WHEREAS, by Resolution No. 99 -1562, the City Council ordered
the City Manager to cause to be prepared an Engineer's Report for
Assessment District 84 -2 for FY 1999/2000, in accordance with
Article 4, Chapter 1, Part 2, Division 15 of the California Streets
and Highways Code; and
WHEREAS, pursuant to said Resolution, the said Engineer's
Report was filed with the City Clerk on the 23rd day of April 1999;
and
WHEREAS, the City Council has reviewed said Engineer's Report
and wishes to take certain actions relative to said report and to
the levy of the assessments recommended therein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The Engineer's Report for "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" for the
fiscal year commencing July 1, 1999, and ending June 30, 2000, filed
with the City Clerk on the 23rd day of April 1999, is hereby
approved.
SECTION 2. That said Engineer's Report may be further modified
or changed, pursuant to the provisions of Section 22630 of the
Streets and Highways Code.
SECTION 3. That certain of the zone assessments levied in FY
1998/99 were net amounts subsequent to a credit given for a prior
year carry over -- the actual assessment amount being the full
assessment prior to said credit. A list of the total actual adjusted
zone assessment amounts for FY 1998/99 is set forth in Section D of
the report to the City Council dated April 23, 1999.
SECTION 4. That the assessment amount for FY 1999/2000 for Zone
12 has been increased from zero to the amounts indicated in the
Engineer's Report, said assessments being the amounts tentatively to
be set forth in a mail ballot to be considered by the City Council
on or prior to the public hearing herein called for.

SECTION 5. That except as noted in Sections 3 and 4 of this
Resolution, the assessment amounts proposed for FY 1999/2000 have
not changed from the assessments levied in FY 1998/99.
SECTION 6. That the public interest and convenience require and
it is the intention of the City Council of the City of Moorpark to
make certain changes, to the "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" and to order the
extension of the annual assessments for said district for the fiscal
year commencing July 1, 1999, and ending June 30, 2000, pursuant to
the Landscaping and Lighting Act of 1972, and to levy and collect
assessments for certain improvements as described herein, in
accordance with said Act. Said "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" consists of a single
city -wide zone to provide electric current or energy for public
lighting within the City, to install, construct or maintain any
authorized improvements under the Act, including but not limited to
one or more of street lights, public lighting facilities,
landscaping, statuary, fountains, and other ornamental structures
and facilities, and any facilities which are appurtenant to any of
the aforementioned or which are necessary or convenient for the
maintenance or servicing thereof, including irrigation, electric
current and energy; and to provide incidental expenses in connection
therewith. Said district also includes assessments for the
improvement and maintenance of the above described landscaping and
related improvements in a number of zones of benefit.
SECTION 7. That said lighting and landscape maintenance
assessment district shall specifically include the lighting and
landscape sites with all improvements located therein, described by
and heretofore included within "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT NO. AD- 84 -2."
SECTION 8. That the foregoing described work is to be located
within said Assessment District, the boundaries of which are more
particularly described on maps included in the aforesaid Engineer's
Report and entitled "Boundary Map, City of Moorpark Lighting and
Landscaping Maintenance Assessment District No. AD- 84 -211, said
report and maps being on file in the office of the City Clerk as of
the 23rd of April 1999.
SECTION 9. That the proposed maintenance and improvement, in
the opinion of the City Council, is of benefit to, and the City
Council hereby makes the expense of said maintenance and
improvements chargeable upon the district.
SECTION 10. That a full and detailed description of the
improvements, the boundaries of the Assessment District and any
zones therein, and the proposed assessments upon assessable lots and
parcels of land within said District, is set forth in a copy of the
aforementioned Engineer's Report, a copy of which is on file with
the City Clerk and open to inspection.

SECTION 11. That the proposed assessment amounts are set forth
in Exhibit 'A' attached hereto and made a part hereof.
SECTION 12. That a public hearing of the Moorpark City Council
shall be convened on the 2nd day of June 1999, at the hour of 7:00
p. m., in the Council Chambers of the City Hall of said City,
located at 799 Moorpark Avenue, Moorpark, for the purpose of
receiving oral and written testimony regarding the proposed
assessments for FY 1999/2000.
SECTION 13. That Notice of said pubic hearing is hereby given.
All persons having any objections to the work or extent of the
assessment district may appear and show cause why said work should
not be done or carried out or why said district should not be
extended for the fiscal year commencing July 1, 1999, and ending
June 30, 2000. Protests must be in writing, and must be filed by the
property owner with the City Clerk prior to the conclusion of the
hearing and such protest shall state all grounds of the objection
and shall contain a description sufficient to identify the property.
A majority protest will cause the assessment increase to be
abandoned.
SECTION 14. All the work herein proposed shall be done in
accordance with the Landscaping and Lighting Act of 1972, being Part
2 of Division 15 of the Streets and Highways Code of the State of
California.
SECTION 15. The City Clerk shall cause a notice OF public
hearing to be given by causing a summary of this Resolution to be
published in the manner required by Part 2 of Division 15 of the
Streets and Highways Code and Section 54954.6 of the Government Code
of the State of California.
Section 16. The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
