HomeMy WebLinkAboutRES CC 1999 1659 1999 1006RESOLUTION NO. 99 -1659 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, STATE OF CALIFORNIA, ESTABLISHING A SCHEDULE OF LAND USE DEVELOPMENT PRELIMINARY PROCESSING FEE DEPOSITS AND RESCINDING RESOLUTION NO. 99 -1593 WHEREAS, the City of Moorpark provides land use development planning services; and WHEREAS, the City Council has determined that the cost of these services shall be offset by fees which accompany land use entitlement requests; and WHEREAS, the Community Development Department staff costs are charges against fees, based upon real time cost accounting; and WHEREAS, the City Council did consider and adopt Resolution 98 -1551 which established a schedule of land use development processing fees on December 2, 1998; and WHEREAS, the City Council did consider and adopt under Ordinance No. 265 revised procedures for the processing of development applications within the Downtown Specific Plan area, not previously a portion of the City's entitlement procedures; and WHEREAS, a fee for such revised entitlements is necessary; and WHEREAS, it is necessary to differentiate within certain fee categories, fees consistent with the demands for staff time for specific forms of applications. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the Community Development Department staff shall bill actual time spent on land use applications at a real time cost accounting rate of $88.00 per hour. SECTION 2. Contract services shall be billed at cost, plus fifteen percent (15 %), including but not limited to the City Attorney, geotechnical /geological services, landscape consultant reviews and inspections, and the City Engineer, except where otherwise specified. That the Community Development Code Enforcement staff shall bill actual time spent on land use applications and other items eligible for cost recovery at a real time cost accounting rate of $82.00 per hour. SECTION 4. That the Administrative Services staff shall bill actual time spent on land use applications and other items eligible for cost recovery at a real time cost recovery rate of $90.00 per hour. SECTION 5. That the Director of Community Development has the authority to reduce certain deposit amounts up to fifty percent (50 %), where the project involves multiple applications of the same type of project on the same property, to be processed concurrently. SECTION 6. That there is a need to provide incentive to the economic development of the Downtown Specific Plan area through the reduction of development processing and review fees established in "Exhibit A" such that projects within the boundaries of the adopted Downtown Specific Plan shall be required to pay a fee equal to the lesser of the following: (1) A fee not more than fifty percent (50 %) of the established deposit /review fee as shown upon the fee schedule in "Exhibit A", or (2) a fee equal to the actual cost to process and review such applications when such costs may be less than the fee in (1) above. SECTION 7. That the schedule of Land Development Preliminary Processing Fee Deposits shall be as identified as those revised fees shown in "Exhibit All to this Resolution. SECTION 8. That this Resolution shall become effective sixty days (60) following the public meeting held on October 6, 1999 (December 4, 1999), pursuant to Government Code Section 66016, implementing those changes to the fees described herein immediately upon the effective date set forth herein. SECTION 9. That Resolution No. 99 -1593 adopted December 2, 1998, is hereby repealed upon the effective date of this Resolution. Resolution No. 99 -1659 Page 3 SECTION 10. That the City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
