HomeMy WebLinkAboutRES CC 2000 1750 2000 0607RESOLUTION NO. 2000 -1750 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING MINOR MODIFICATION NO. 3 TO SPECIFIC PLAN NO. 92 -1 (CARLSBERG SPECIFIC PLAN) TO REDUCE THE LENGTH AND CHANGE THE LOCATION OF THE PROJECT TRAILS ON THE APPLICATION OF LENNAR COMMUNITIES OF CALIFORNIA WHEREAS, on September 7, 1994, the City Council approved the Carlsberg Specific Plan (Specific Plan 92 -1) and certified the Subsequent Environmental Impact Report. On September 21, 1994, modifications to the zoning designation of the property described in the Carlsberg Specific Plan were approved; and WHEREAS, the City Council adopted Resolution No. 96 -1230 approving Tentative Tract Map Nos. 4975, 4976, 4977 and 4980 on October 2, 1996; and WHEREAS, on April 8, 1999, Lennar Homes applied for Minor Modification No. 2 to the Carlsberg Specific Plan (Specific Plan 92 -1) concerning the architectural theme, design and development standards, signage, and trails; and WHEREAS, at its meetings on May 5 Council discussed Minor Modification No discussed Minor Modification No. 3 (the is now identified as Minor Modification conditionally approved Minor Modificatioi Specific Plan (Specific Plan 92 -1). and 19, 1999, the City 2 and on June 7, 2000, trail reduction request No. 3 for clarity) and z No. 3 to the Carlsberg NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council has determined that approval of this Minor Modification is consistent with the purpose and intent of the Carlsberg Specific Plan and is not a substantial or fundamental change and is categorically exempt from CEQA requirements as a Class 1 exemption for minor alterations. SECTION 2. The City Council approves Minor Modification No. 3 to Specific Plan No. 92 -1 on the application of Lennar Communities of California for a reduction in the location and. number of linear feet of the approved trails system from approximately 10,520 to 5,400 lineal feet, a reduction of 5,120 feet. Resolution No. 2000 -1750 Page 2 SECTION 3. The following conditions shall be complied with by the applicant within the time frames as noted. A. Prior to the recordation of Tentative Map 4975, an in- lieu fee of $46,700 shall be paid to allow a reduction in the length of the proposed trail system from 10,520 feet to 5,850 feet. B. Prior to the issuance of the first Zone Clearance for the first residential unit to be constructed in Tract 4975, a trails plan including cross section, alignment, signage and erosion control measures shall be submitted to and approved by the City Engineer and Director of Community Development. C. Prior to the issuance of the first Zone Clearance for the first residential unit to be constructed in Tract 4975, or prior to acceptance by the City of Miller Park, whichever occurs last, the entire trail network shall be installed and completed to the satisfaction of the City Engineer and Director of Community Development. The trail segment that will connect the reservoir access road to Tract 4975 may be fenced temporarily to block access to developed area until occupancy of homes on Shawnee Street is approved by the Director of Community Development. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
