HomeMy WebLinkAboutRES CC 2000 1695 2000 0202RESOLUTION NO. 2000 -1695 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING A HARDSHIP ASSISTANCE PROGRAM FOR MOBILEHOME TENANTS FOR CALENDAR YEAR 2000 AND RESCINDING RESOLUTION NOS. 99 -1669 AND 99 -1680 WHEREAS, Ordinance No. 254 adopted June 2, 1999 provides that the City Council may establish by resolution a Hardship Assistance Program for providing hardship financial assistance to tenants of mobilehome parks within the city; and WHEREAS, such resolution is to establish procedures for receipt and review of applications for such program; and WHEREAS, the City Council desires to establish such assistance program for calendar year 2000 only; and WHEREAS, on October 20, 1999 the City Council adopted Resolution No. 99 -1669 establishing such an assistance program and on December 1, 1999, adopted Resolution No. 99 -1680 amending a provision of Resolution No. 99 -1669. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1 established for City of Moorpark A Hardship Assistance Program is herewith tenants of mobilehome parks located within the for the calendar year 2000 only. SECTION 2. Tenants shall make applications for the assistance program on forms provided by the City. Said application shall include information regarding current income and housing expenses as shall be necessary for the City to determine that the Tenants meet Section 8 Housing income requirements. The application shall also require copies of income tax forms, utility bills, rent and mortgage payments, and such other information deemed necessary by City staff to determine eligibility. SECTION 3. All applications shall be submitted to the City no later than forty -five (45) calendar days prior to the effective date of the rent increase. The City Council's Budget and Finance Committee may waive the submittal deadline for Resolution No. 200(, -1695 Page 2 tenants who are submitting their first application for a hardship assistance, provided the application was received prior to posting of the notice of the Committee's hearing on any assistance application. For applications to be reviewed by the City Manager pursuant to Section 5 herein, the City Manager may waive the submittal deadline for tenants who are submitting their first application for a hardship assistance, provided the application was received at least thirty (30) days prior to the effective date of the rent increase. SECTION 4. City staff shall review all materials presented, and may require additional information to be provided, to make a determination of eligibility using Section 8 standards. SECTION 5. No later than twenty -five (25) days prior to the effective date of the rent increase, the City Manager may grant a hardship assistance to tenants who, based on information provided under Section 4 herein, expend thirty -five percent (35 %) or more of their gross annual income on housing costs. The City Manager shall at the same time establish the amount of the assistance to be provided. SECTION 6. No later than twenty (20) days prior to the effective date of the increase, the City Council's Budget and Finance Committee shall meet with each applicant meeting Section 8 housing standards but who expend less than thirty -five percent (35 %) of their gross annual income on housing costs. At said meeting the Committee shall make a determination as to whether hardship assistance shall be granted and the amount of such assistance. SECTION 7. The City shall notify the owner of the mobilehome park of the tenants that will receive the hardship assistance and the amount of assistance for each tenant within five (5) days of the decision being made. SECTION 8. Following the determination on the hardship assistance payments, a resolution amending the operating budget to appropriate the required funds shall be presented to the City Council for action, if required. SECTION 9. The Finance Department shall be responsible for making the required assistance payments to the mobilehome owner on a monthly basis. Resolution No. 200(, -1695 Page 3 SECTION 10. Resolution No. 99 -1669 and Resolution No. 99- 1680 are hereby rescinded in their entirety. SECTION 11. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
