HomeMy WebLinkAboutRES CC 2000 1721 2000 0405RESOLUTION NO. 2000 -1721 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE ENGINEER'S REPORT FOR, AND DECLARING ITS INTENTION TO MAKE CERTAIN CHANGES AND TO ORDER THE ANNUAL ASSESSMENTS FOR THE " MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. AD -84 -2" FOR THE FISCAL YEAR COMMENCING JULY 1, 2000, AND ENDING JUNE 30, 2001, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, AND FIXING THE TIME AND PLACE FOR A PUBLIC HEARING TO RECEIVE OBJECTIONS THERETO WHEREAS, by Resolution No. 2000 -1688, the City Council ordered the City Manager to cause to be prepared an Engineer's Report for Assessment District 84 -2 for FY 2000/2001, in accordance with Article 4, Chapter 1, Part 2, Division 15 of the California Streets and Highways Code; and WHEREAS, by Resolution No. 2000 -1711, the City Council approved an Excerpt from said Engineer's Report pertaining to Zone 12, and set May 3, 2000, as the date of a public hearing to consider an increase to the Zone 12 assessment; and WHEREAS, pursuant to the requirements of Resolution No. 2000 -1688, the completed draft Engineer's Report, including the above mentioned Excerpt for Zone 12, was filed with the City Clerk on the 24th day of March, 2000; and WHEREAS, the City Council has reviewed said Engineer's Report and wishes to take certain actions relative to said report and to the levy of the assessments recommended therein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVE AS FOLLOWS: SECTION 1. The Engineer's Report for " MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" for the fiscal year commencing July 1, 2000, and ending June 30, 2001, filed with the City Clerk on the 24th day of March 2000, is hereby approved. SECTION 2. That said Engineer's Report includes certain information pertaining to a proposed increase to the amount of the assessments for Zone 12, said assessment increase being contingent upon approval via mail ballots to be received by the City on May 3, 2000. Resolution No. 2000 -1721 Page 2 SECTION 3. That the aforementioned Engineer's Report may be further modified or changed, pursuant to the provisions of Section 22630 of the Streets and Highways Code. SECTION 4. That, except as noted in Sections 2 of this Resolution, the assessment amounts proposed for FY 2000/2001 have not changed from the assessments levied in FY 1999/2000. SECTION 5. That the public interest and convenience require and it is the intention of the City Council of the City of Moorpark to make certain changes, to the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" and to order the extension of the annual assessments for said district for the fiscal year commencing July 1, 2000, and ending June 30, 2001, pursuant to the Landscaping and Lighting Act of 1972, and to levy and collect assessments for certain improvements as described herein, in accordance with said Act. Said "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" consists of a single city -wide zone to provide electric current or energy for public lighting within the City, to install, construct or maintain any authorized improvements under the Act, including but not limited to one or more of street lights, public lighting facilities, landscaping, statuary, fountains, and other ornamental structures and facilities, and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof, including irrigation, electric current and energy; and to provide incidental expenses in connection therewith. Said district also includes assessments for the improvement and maintenance of the above described landscaping and related improvements in a number of zones of benefit. SECTION 6. That said lighting and landscape maintenance assessment district shall specifically include the lighting and landscape sites with all improvements located therein, described by and heretofore included within "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD- 84 -2." SECTION 7. That the foregoing described work is to be located within said Assessment District, the boundaries of which are more particularly described on maps included in the aforesaid Engineer's Report and entitled "Boundary Map, City of Moorpark Lighting and Landscaping Maintenance Assessment District No. AD- 84-211, said report and maps being on file in the office of the City Clerk as of the 24th of March 2000. Resolution No. 2000 -1721 Page 3 SECTION 8. That the proposed maintenance and improvement, in the opinion of the City Council, is of benefit to, and the City Council hereby makes the expense of said maintenance and improvements chargeable upon the district. SECTION 9. That a full and detailed description of the improvements, the boundaries of the Assessment District and any zones therein, and the proposed assessments upon assessable lots and parcels of land within said District, is set forth in a copy of the aforementioned Engineer's Report, a copy of which is on file with the City Clerk and open to inspection. SECTION 10. That the proposed assessment amounts are set forth in Exhibit 'A' attached hereto and made a part hereof. SECTION 11. That a public hearing of the Moorpark City Council shall be convened on the 7th day of June 2000, at the hour of 6:30 p.m., in the Council Chambers of the City Hall of said City, located at 799 Moorpark Avenue, Moorpark, for the purpose of receiving oral and written testimony regarding the proposed assessments for FY 2000/2001. SECTION 12. That Notice of said pubic hearing is hereby given. All persons having any objections to the work or extent of the assessment district may appear and show cause why said work should not be done or carried out or why said district should not be extended for the fiscal year commencing July 1, 2000, and ending June 30, 2001. Protests must be in writing, and must be filed by the property owner with the City Clerk prior to the conclusion of the public hearing and such protest shall state all grounds of the objection and shall contain a description sufficient to identify the property. A majority protest will cause the assessment increase to be abandoned. SECTION 13. All the work herein proposed shall be done in accordance with the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the Streets and Highways Code of the State of California. SECTION 14. The City Clerk shall cause a Notice of Public Hearing to be given by causing a summary of this Resolution to be published in the manner required by Part 2 of Division 15 of the Streets and Highways Code and Section 54954.6 of the Government Code of the State of California. Resolution No. 2000 -1721 Page 4 SECTION 15. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
