HomeMy WebLinkAboutRES CC 2000 1711 2000 0301RESOLUTION NO. 2000 -1711 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTENTION TO MAKE CERTAIN CHANGES TO, AND TO ORDER THE LEVY OF ASSESSMENTS UPON THE PROPERTIES WITHIN, ZONE 12 OF THE " MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. 84 -2" FOR THE YEAR 2000 -2001, PRELIMINARILY APPROVING THE ENGINEER'S REPORT FOR ZONE 12 AND PROVIDING FOR NOTICE OF A PUBLIC HEARING TO CONSIDER SAID REPORT AND PROPOSED ASSESSMENTS WHEREAS, by Resolution No. 2000 -1688, the City Council ordered the preparation of an Engineer's Report for "Moorpark Lighting and Landscaping Assessment District 84 -2" for Fiscal Year 2000 -2001, in accordance with Section 22500 et. seq. of the Streets and Highways Code; and WHEREAS, said Resolution stated the intent of the City Council to make certain changes to the amount of the assessment for Zone 12 of said District, said increases to be made in accordance with the requirements of Article XIII -D of the California Constitution (Proposition 218); and WHEREAS, an excerpt from the Engineer's Report pertaining to Zone 12, was filed with the City Clerk on the 25 h day of February, 2000; and WHEREAS, the City Council has reviewed said Engineer's Report excerpt and wishes to take certain actions relative to said report and to the levy of the assessments for Zone 12 recommend therein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Engineer's Report excerpt pertaining to Zone 12 of the " MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. 84 -2" for Fiscal Year 2000 -2001, on file with the City Clerk, is hereby approved. SECTION 2. Said Engineer's Report excerpt shall be incorporated into the Engineer's Report for the entire District, which is to be considered by the City Council at a later date. SECTION 3. Said Engineer's Report excerpt may be further modified or changed, pursuant to the provisions of Section 22630 of the Streets and Highways Code, provided, however, that the amounts of the assessments provided for therein may not be increased. It is the intent of the City Council to make certain changes to the amount of the assessment for Zone 12 of "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" for the fiscal year commencing July 1, 2000, and ending June 30, 2001, and to levy and collect said assessments within Zone 12 to install, construct or maintain any authorized improvements under the Act, including but not limited to one or more of street lights, public lighting facilities, landscaping, statuary, fountains, and other ornamental structures and facilities, and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof, including irrigation, electric current and energy; and to provide incidental expenses in connection therewith. SECTION 5. Zone 12 consists of the lots and parcels shown in the Boundary Maps included in the aforesaid Engineer's Report excerpt. SECTION 6. Reference is hereby made to the Engineer's Report excerpt for a full and detailed description of the improvements within Zone 12, the boundaries of Zone 12 and the proposed assessments upon the lots or parcels within Zone 12. SECTION 7. A public hearing shall be held before the City Council in the Council Chambers, located at 799 Moorpark Avenue, Moorpark, California 93021 on Wednesday, May 3, 2000, at 6:30 p.m. for the purpose of the City Council's determination whether the public interest, convenience and necessity require the improvements and the Zone 12 assessments required to fund the maintenance of said improvements. SECTION 8. The City Clerk is hereby authorized and directed to cause Notice of the hearing ordered under Section 7 hereof to be given in accordance with law by mailing, postage prepaid, in the United States mail, and such Notice shall be deemed to have been given when so deposited in the mail. The mailed Notice shall be given to all property owners within the Zone 12 of the District by such mailing by name to those persons whose names and addresses appear on the last equalized secured property tax assessment roll of the County of Ventura. The Notice shall include, but not be limited to, the total amount of the Zone 12 assessment proposed to be levied for fiscal year 2000 -2001, the assessment proposed for the owner's particular parcel(s) and the duration thereof, the reason for the assessment and the basis upon which the amount of the assessment was calculated. Each Notice shall also contain an assessment ballot, a summary of the procedures applicable to the completion, return and tabulation of assessment ballots, and a statement that the existence of a majority protest will result in the assessment not being imposed. Resolution No. 2000 -1711 Page 3 The Notice herein provided shall be mailed not less than forty - five (45) days before the date of the public hearing. SECTION 9. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 1st day of March 2000.
