HomeMy WebLinkAboutRES CC 2000 1739 2000 0517RESOLUTION NO. 2000 -1739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTENT TO VACATE A PORTION OF THE LOS ANGELES AVENUE EAST RIGHT -OF -WAY, AT THE NORTHEAST CORNER OF THE INTERSECTION OF CONDOR DRIVE, IN TRACT 3492 Vacation No. V- 2000 -1 WHEREAS, a portion of Los Angeles Avenue East right -of -way, in Tract 3492, was relinquished to the City of Moorpark; and WHEREAS, it has been determined that the said portion of right -of -way will allow for realignment of the intersection of Los Angeles Avenue East and Condor Drive and is otherwise of no interest to the City of Moorpark; and WHEREAS, it is appropriate, therefore, to consider the vacation of said portion of right -of -way; and WHEREAS, the hearing for the Vacation No. V- 2000 -1 was previously scheduled for May 17, 2000, pursuant to City Council Resolution No. 2000 -1730, and such resolution is now proposed to be rescinded and a new resolution adopted to ensure compliance with the notice publishing and posting requirements addressed in Sections 8320, 8322, and 8323 of the Streets and Highways Code of the State of California. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That in order to allow for said street improvements, it is the intention of the City Council to vacate a portion of Los Angeles Avenue East right -of -way, at the northeast corner of the intersection with Condor Drive, as generally shown on Exhibit "A ", as the "PORTION OF RIGHT -OF -WAY TO BE VACATED ". SECTION 2. That the City Council of the City of Moorpark hereby elects to proceed with said vacation pursuant to the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California. SECTION 3. That 6:30 p.m. on the 7th day of June, 2000, in the Community Center at 799 Moorpark Avenue in the City of Resolution No. 2000 -1739 Page 2 Moorpark, is hereby fixed as the time and place at which a hearing will be held before the City Council, at which time and place all persons interested in or objecting to the proposed vacation may appear and be heard. SECTION 4. The City Clerk is hereby directed to publish notice of the hearing on the proposed vacation for at least two successive weeks prior to the hearing. Such notices shall be prepared and published consistent with the notice requirements in Sections 8320 and 8322 of the Streets and Highways Code of the State of California. SECTION 5. The City Engineer's Office is authorized and directed to post three notices of said proposed vacation conspicuously along the line of the street to be vacated at least two weeks before the day set for the hearing. Such notices shall be prepared and posted consistent with the requirements in Sections 8320 and 8323 of the Streets and Highways Code of the State of California. SECTION 6. Resolution No. 2000 -1730 is hereby rescinded. SECTION 7. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions. PASSED AND ADOPTED this 17th of May, 2000.
