HomeMy WebLinkAboutRES CC 2001 1916 2001 1205RESOLUTION NO. 2001 -1916 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING A MITIGATED NEGATIVE DECLARATION AND EXPANDED INITIAL STUDY/ ENVIRONMENTAL ASSESSMENT AS WELL AS THE MITIGATION MONITORING PLAN FOR A PROJECT TO WIDEN LOS ANGELES AVENUE BETWEEN MOORPARK AVENUE AND SPRING ROAD WHEREAS, the City intends to construct a project to realign, widen and improve Los Angeles Avenue between Moorpark Avenue and a point east of Spring Road; and WHEREAS, at a duly noticed public hearing on November 7, 2001, the City Council considered the content of a Draft Mitigated Negative Declaration /Expanded Initial Study/ Environmental Assessment for said project; and WHEREAS, the City Council opened the public hearing on November 7, 2001, and took testimony from all those wishing to testify and continued the public hearing to December 5, 2001; and WHEREAS, the Draft Mitigated Negative Declaration and Expanded Initial Study /Environmental Assessment was made available to the public for the required review period set forth in the City and State CEQA Guidelines and NEPA requirements; and WHEREAS, responses to comments on the adequacy of the Draft Mitigated Negative Declaration and Expanded Initial Study/ Environmental Assessment were presented to the City Council; and WHEREAS, a mitigated monitoring plan conforming with City and State guidelines was prepared and distributed to the public and decision - makers prior to taking action on the sufficiency of the environmental analysis of the project; and WHEREAS, the City Council has determined that based on the record as a whole the proposed street improvement program will not result in any significant impacts that have not been fully and completely mitigated; and WHEREAS, appropriate findings concerning the impacts of the project have been prepared (attached to this resolution). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby determines that the Mitigated Negative Declaration and Expanded Initial Study/ Environmental Assessment prepared for the proposed widening, realignment and improvement of Los Angeles Avenue between Moorpark Avenue and a point east of Spring Road, is accurate and complete and has been prepared in compliance with CEQA and NEPA. Resolution No. 2001 -1916 Page 2 SECTION 2. The City Council hereby approves the Mitigation Monitoring Plan prepared to implement the Mitigation Measures set forth in the Mitigated Negative Declaration and Expanded Initial Study /Environmental Assessment for this project. SECTION 3. On the basis of the record as a whole, the City Council hereby determines that the impacts of the proposed project, with the adoption of Mitigation Measures, will not have a significant adverse effect on the environment. SECTION 4. The City Council, therefore, hereby approves the Mitigated Negative Declaration /Expanded Initial Study/ Environmental Assessment and Mitigation Monitoring Plan subject to the attached findings. SECTION 5. TraffeiMtedt, City Cler] Attachment: Exhibit "A": CEQA Findings Resolution No. 2001 -1916 Page 3 "EXHIBIT A" STATEMENT OF FINDINGS LOS ANGELES AVENUE WIDENING: MOORPARK AVENUE TO SPRING ROAD Legal Requirements The California Environmental Quality Act (CEQA) section 15074 and 15704.1, which specify procedures for the consideration and approval of a Mitigated Negative Declaration, requires the preparation of certain findings. These findings, as applicable to the proposed project, include: (1) Based on the record as a whole, the decision - making body, the City of Moorpark City Council (Lead Agency), has determined that there is no substantial evidence that the proposed project will result in significant effects on the environment; (2) The Mitigated Negative Declaration /Expanded Initial Study reflects the independent judgement and analysis of the Lead Agency; (3) The analysis of the data contained in the Mitigated Negative Declaration /Expanded Initial Study was subjected to properly noticed public review and comment; (4) All comments on the Draft Mitigated Negative Declaration /Expanded Initial Study were considered and responses, in writing, to each comment were prepared by the Lead Agency; (5) The record of the proceedings are available for review upon request from the City of Moorpark City Clerk; (6) The City has adopted a Mitigation Monitoring and Reporting Program to ensure proper implementation of mitigation measures; and, (7) The mitigation measures that have been adopted will not themselves cause any significant effects on the environment.
