HomeMy WebLinkAboutRES CC 2004 2186 2004 0505RESOLUTION NO. 2004 -2186 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING A SCHEDULE OF LAND USE DEVELOPMENT PRELIMINARY PROCESSING FEE DEPOSITS AND RESCINDING RESOLUTION NO. 99 -1659 WHEREAS, the City of Moorpark provides land use development planning services; and WHEREAS, the City Council has determined that the cost of these services shall be offset by fees which accompany land use entitlement requests; and WHEREAS, the Community Development Department staff costs are charged against fees, based upon real time cost accounting; and WHEREAS, on September 23, 2003, the City Council did consider and adopt Ordinance No. 297 which amended the Zoning Code relating to entitlement process and procedures; and WHEREAS, Ordinance 297 established modified categories for entitlement process; and WHEREAS, a fee for such entitlements are necessary; and WHEREAS, it is necessary to differentiate within certain fee categories, fees consistent with the demands for staff time for specific forms of applications. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City of Moorpark staff shall bill actual time spent on land use applications and other at a real time cost accounting rate per Table 1. SECTION 2. Contract services shall be billed at cost, plus fifteen percent (150 ), including but not limited to the City Engineer, except where otherwise specified; City Attorney; geotechnical /geological services, landscape architect review and inspection services; lighting engineer review and inspection services and planning consultant services. The Community Development Code Compliance Officer shall bill actual time spent on land use application and other items eligible for cost recovery at a real time cost accounting rate per Table 1. SECTION 4. The Administrative Services staff shall bill actual time spent on land use application and other items eligible for cost recovery at a real time cost accounting rate per Table 1. SECTION 5. The Community Development Director has the authority to reduce certain deposit amounts up to fifty percent (500), where the project involves multiple applications of the same type of project on the same property, to be processed concurrently. SECTION 6. The Schedule of Land Development Preliminary Processing Fee Deposits shall be identified as those revised fees show in "Exhibit A" to this Resolution SECTION 7. This Resolution shall become effective sixty (60) days following the public meeting held on May 5, 2004, pursuant to Government Code Section 66016, (July 4, 2004) implementing those changes to the fees described herein immediately upon the effective date set forth herein. SECTION 8. Resolution No. 99 -1659 adopted the 6th day of October, 1999, is hereby rescinded upon the effective date of this Resolution. Resolution No. 2004 -2186 Page 3 SECTION 9.
