Home My WebLink AboutRES CC 2005 2338 2005 0601RESOLUTION NO. 2005 -2338 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, CERTIFYING THE FINAL PROGRAM ENVIRONMENTAL IMPACT REPORT FOR THE NORTH PARK VILLAGE AND NATURE PRESERVE SPECIFIC PLAN PROJECT (GENERAL PLAN AMENDMENT NO. 2001 -05, SPECIFIC PLAN NO. 2001 -01, ZONE CHANGE NO. 2001 -02, AND DEVELOPMENT AGREEMENT NO. 2005 -01). WHEREAS, the California Environmental Quality Act (CEQA) mandates that a lead agency, prior to approving a project for which an Environmental Impact Report (EIR) has been prepared, certify that 1) the Final EIR has been completed in compliance with CEQA; 2) the Final EIR has been presented to the decision - making body of the lead agency and that the decision - making body reviewed and considered the information contained in the Final EIR; and 3) the Final EIR reflects the lead agency's independent judgment and analysis; and WHEREAS, applications have been filed with the City of Moorpark by North Park Village, Limited Partnership for the North Park Village and Nature Preserve Specific Plan project, consisting of General Plan Amendment No. 2001 -05, Specific Plan No. 2001 -01, Zone Change No. 2001 -02, and Development Agreement No. 2005 -01 for 1,680 housing units and other supporting land uses on approximately 3,586.3 Acres, located generally north of Moorpark College and State Route 118 on land immediately outside the City of Moorpark municipal boundaries; and WHEREAS, as permitting authority for these land -use applications, including pre- zoning, the City Council of the City of Moorpark is the decision - making body of the lead agency for this project under CEQA; and WHEREAS, an Initial Study for this project, completed by the City on January 22, 2002, indicated the need to prepare an EIR and a Notice of Preparation of an EIR was distributed; and WHEREAS, a Draft Program EIR was prepared for this project and was circulated for written comments from July 10, 2003 to September 24, 2003; and WHEREAS, the Planning Commission held a public hearing to accept oral comments on the Draft Program EIR on August 19, 2003 and September 16, 2003; and Resolution 2005 -2338 North Park Village and Nature Preserve Final Program EIR Certification Page 2 WHEREAS, in response to written and oral comments on the Draft Program EIR, a Revised Draft Program EIR was prepared with Chapter 3.3b (Freeway Traffic) added to the document and this new chapter was circulated for written comments pursuant to Section 15088.5 of the CEQA Guidelines from December 15, 2003 to January 30, 2004; and WHEREAS, the Planning Commission held a public hearing to accept oral comments on Chapter 3.3b of the Revised Draft Program EIR on January 20, 2004; and WHEREAS, draft responses to written and oral comments received on the Draft EIR and Chapter 3.3b of the Revised Draft Program EIR were prepared with copies of the draft responses sent to the commentators on December 15, 2003, and March 24, 2004 respectively; and WHEREAS, the Final Program EIR for the North Park Village and Nature Preserve Specific Plan project (SCH No. 2002011114) consists of the Draft Program EIR and Revised Draft Program EIR (Volumes I and VI), technical appendices (Volumes II, III, and VII) , comments and recommendations received on the Draft Program EIR and Chapter 3.3b of the Revised Draft Program EIR (Volumes IV, V, and VIII), a list of persons, organizations, and public agencies commenting on both the Draft Program EIR and Chapter 3.3b of the Revised Draft Program EIR (Volumes IV, V, and VIII), and responses of the City of Moorpark to significant environmental points raised in the review and consultation process (Volumes IV, V, and VIII); and WHEREAS, public notices of preparation, completion, and responses to comments of the Draft Program EIR and Chapter 3.3b of the Revised Draft Program EIR were prepared, noticed, and distributed in compliance with CEQA; and WHEREAS, the Planning Commission has reviewed and considered all the material comprising the Final Program EIR and on April 6, 2004, and has adopted Planning Commission Resolution No. PC- 2004 -456 recommending that the City Council certify that the Final Program EIR has been completed in compliance with CEQA and City environmental review procedures and that the Final Program EIR reflects the independent judgment and analysis of the City of Moorpark. Resolution 2005 -2338 North Park Village and Nature Preserve Final Program EIR Certification Page 3 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. PROJECT REVISIONS AND ISSUES RAISED AFTER THE CLOSE OF THE PUBLIC COMMENT PERIOD - The City Council finds that the North Park Village and Nature Preserve Final Program EIR adequately addresses the project as revised and all issues raised after the close of the public review period, and that no new significant environmental impacts, feasible project alternatives, or mitigation measures considerably different from others previously analyzed have been identified. SECTION 2. CERTIFICATION OF FINAL PROGRAM EIR - The City Council, as lead agency under CEQA for the North Park Village and Nature Preserve Specific Plan project, certifies that: a. The Final Program EIR for the project (SCH No. 2002011114), incorporated herein by reference and on file with the Community Development Department, has been completed in compliance with CEQA, the CEQA Guidelines, and the City CEQA Procedures. b. The Final Program EIR was presented to the City Council of the City of Moorpark, and the City Council has reviewed and considered the information contained in the Final Program EIR prior to approving the project. C. The Final EIR reflects the independent judgment and analysis of the City of Moorpark. this filed SECTION 3.
