HomeMy WebLinkAboutRES RD 2004 138 2004 0505RESOLUTION NO. 2004 -138 A RESOLUTION OF THE MOORPARK REDEVELOPMENT AGENCY OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING INITIATION OF AN AMENDMENT NO. 1 TO THE MOORPARK REDEVELOPMENT PROJECT WHEREAS, the City of Moorpark Redevelopment Agency (the "Agency ") is a duly constituted redevelopment agency under the laws of the State of California and pursuant to such laws is responsible for the administration and implementation of redevelopment activities within the City of Moorpark; and WHEREAS, by City Ordinance No. 110, dated July 5, 1989, the City Council of the City of Moorpark (the "City Council ") officially adopted the Redevelopment Plan (the "Plan ") for the Moorpark Redevelopment Project (the "Project ") pursuant to procedures codified within the California Community Redevelopment Law ([CCRL] Health and Safety Code Section 33000, et seq.); and WHEREAS, by City Ordinance No. 111, dated July 5, 1989, the City Council of the City of Moorpark, and as subsequently approved by the voters of Moorpark, placed restrictions on the use of eminent domain authority to acquire residentially zoned property and commercially or industrially zoned property that had a residential structure (house) on it and was owner occupied at the time the Redevelopment Plan was adopted which is June 28, 1989; and WHEREAS, in accordance with CCRL Article 12, commencing with Section 33450, the City Council may amend a redevelopment plan upon the recommendation of the Agency; and WHEREAS, it is the Agency's desire, so that it may more effectively administer and implement redevelopment projects and programs in the Project Area, that the City Council amend the Plan for the purpose of reinstating the Agency's eminent domain authority for the maximum permissible 12 -year period as limited by Ordinance 111, and further limited to exclude the authority to acquire property upon which persons reside; and WHEREAS, the Agency is authorized and required to act as the "Lead Agency ", as per the California Environmental Quality Act (CEQA) Guidelines (the "Guidelines "), commencing with Section 15050; and WHEREAS, Amendment No. 1 is a "Project" as that term is defined in CEQA Section 21065, and therefore the Agency is required to conduct an "Initial Study" to determine if Amendment No. 1 may have a significant effect on the environment; and Resolution No. 2004 -138 Page 2 WHEREAS, completion of the Initial Study will provide the Agency with sufficient information and analysis whereby the Agency can make its determination as to whether a Negative Declaration of environmental impact or an Environmental Impact Report should be prepared to fully and legally comply with CEQA mandates. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Agency hereby indicates its desire to begin Amendment No. 1 for the purpose stated in the recitals, above, and authorizes and directs the officers, employees, staff, consultants and attorneys for the Agency to take any and all actions that may be necessary to effectuate the purposes of this Resolution and preparation of Amendment No. 1, or appropriate or desirable in the circumstances, including but not limited to the preparation of documents, conduct of meetings, and filing and transmittal of notices, documents and other information as may be required by appropriate Sections of the CCRL. SECTION 2. Acting as the Lead Agency pursuant to CEQA, and because Amendment No. 1 is a Project as defined in CEQA, the Agency, hereby authorizes and directs the officers, employees, staff, consultants and attorneys for the Agency to prepare an Initial Study for Amendment No. 1. SECTION 3. This Resolution shall take effect upon the date of its adoption. SECTION 4.
