Essex Portfolio, L.P. (Continued from November 22, 2005 meeting)

Staff Recommendation: Close the public hearing, take the agenda item off
calendar, and direct staff to advertise and notice a new public hearing for
this project when the project is ready for Planning Commission review.
9. DISCUSSION ITEMS:
A. Consider Resolution Finding the Vacation of a Certain Seqment of
Magnolia Street to be in Conformance with the Moorpark General Plan.

Staff Recommendation: Adopt the attached Planning Commission
Resolution (Exhibit 3) finding the vacation of the above described segment
of Magnolia Street to be in conformity with the Moorpark General Plan.
B. Consider the Draft Seven Year Capital Improvement Program (CIP) for
Streets and Roads for FY 2005/06 — FY 2011/12 (Staff: Yugal Lail)
Staff Recommendation: Find the subject draft Seven Year Capital
Improvement Program for Streets and Roads to be in conformity with the
Moorpark General Plan, except as noted above.

BACKGROUND /DISCUSSION
Municipal Code Section 2.36.080 and Section 3.1 of Resolution PC 2004 -466 (Rules of
Procedure for Commission Meetings and Related Functions and Activities) require the
Planning Commission to select a Chair and Vice Chair from among the appointed
members at the first regular meeting of each year. Each such selection shall be by three
(3) or more affirmative votes. Additionally, each person so selected shall serve until the
end of a one -year term or until a successor is chosen (at any time) by three (3) or more
affirmative votes.
STAFF RECOMMENDATION
Open the floor to nominations for a Chair;

33 steeple.
34 Mr. Hogan stated there were three (3) written
35 statement cards, which indicated support of the
36 project.

motion to accept staff recommendation. Motion failed

with a 2:2 voice vote; Commissioners DiCecco and

Taillon dissenting; Commissioner Landis absent.

Commissioner DiCecco requested clarification of the

Motion. By consensus the motion was restated with
9
clarification of staff's recommendation.

MOTION: Chair Pozza moved and Vice -Chair Peskay
11
seconded a motion to accept staff recommendation with
12
the overall height of the steeple and spire at fifty
13
(50) feet. Motion failed with a 2:2 tie voice vote;
14
Commissioners DiCecco and Taillon dissenting;
15
Commissioner Landis absent.

Mr. Hogan advised the Commission that per Commission
17
rules, a tie vote was to be continued to the next
18
Planning Commission meeting. He further advised that
19
due to Permit Streamlining Act requirements, a
20
decision on the matter would need to be made at the
21.
next City Council meeting, and stated the Commission
22
could direct staff to move the application forward to
23
City Council without a recommendation.

Commissioner DiCecco requested that the motion be re-
25
voted in order to provide an opportunity for the
26
project to move forward to City Council with a
27
recommendation. By consensus, the motion was
28
restated.

MOTION: Chair Pozza moved and Vice -Chair Peskay

seconded a motion to accept staff recommendation to
31
adopt Resolution No. PC- 2005 -492, with the overall
32
height of the steeple and spire at fifty (50) feet.

Motion passed with a 3:1 voice vote, Commissioner

Taillon dissenting; Commissioner Landis absent.
35 Commissioner DiCecco stated for the record that he had
36 voted in favor of staff recommendation in order to
37 move the application forward to City Council with a
38 recommendation for approval, but indicated that he was
39 in favor of the applicant's request for a sixty -nine
40 (69) foot overall height for the steeple.

BACKGROUND /DISCUSSION
On November 22, 2005, the Planning Commission continued this agenda item with the
public hearing open to January 24, 2006, to allow the applicant time to resolve outstanding
project issues. Those issues have not yet been resolved. Given the uncertainty of when
project issues can be resolved, as well as the length of time since this case was first
noticed to the public, staff recommends that this item be taken off calendar so it can be re-
noticed when it is ready to be heard by the Planning Commission.

This presents a resolution of the Planning Commission, which makes a finding that the
vacation of the street right -of -way for that portion of Magnolia Street between Charles
Street and a point approximately one hundred twenty feet (120') south of Charles Street,
is in conformance with the Moorpark General Plan.
DISCUSSION
A. Magnolia Park
It is the intent of the City to construct a neighborhood park in the vicinity of the
southwest corner of Charles Street and Magnolia Street (see Exhibit 1). It is also the
intent of the City to close the northerly one hundred twenty feet (120') ±, of Magnolia
Street (see Exhibit 2) and incorporate that property into the neighborhood park. It is
necessary, therefore, for the City to vacate the street right -of -way for the above
described segment of Magnolia Street, before the City can proceed with construction
of modifications to the street improvements in this area, and the construction of the
new neighborhood park.

B. Fee Ownership
The City of Moorpark is the owner of the property at the southwest corner of Magnolia
Street and Charles Street. Accordingly, the City of Moorpark also owns the underlying
fee title to the westerly one -half of the subject segment of Magnolia Street.
The Area Housing Authority of the County of Ventura [ "Housing Authority "] is the
owner of the property at the southeast corner of Magnolia Street and Charles Street.
The Housing Authority was, therefore, the owner of the easterly one -half of the
subject street segment. The Housing Authority has executed a deed granting to the
City of Moorpark, its interest in the underlying fee title to those portions of street
right0of -way fronting their property. Accordingly, the City of Moorpark is now the
owner of the underlying fee interest to the easterly one -half of the subject segment of
Magnolia Street.
Upon vacation of the subject street segment, the City of Moorpark will be the owner of
the underlying property.
C. Process
Local agencies may vacate surplus street right -of -way by adoption of a resolution
pursuant to the requirements of applicable provisions of the Streets and Highways
Code of the State of California. Those provisions require a public hearing be
conducted and due notification of said hearing to be given.
In the very near future, it is the intent of staff to present to the City Council, a
Resolution of Intent to vacate the above described segment of Magnolia Street. That
resolution will set the date of a public hearing to consider any objections to this
proposed action.
As stated below, prior to the City Council taking any action to vacate a street, the
Planning Commission must first make a finding that said street vacation is in

E. Downtown Specific Plan
The Moorpark Downtown Specific Plan discusses the closure of Magnolia Street to
through traffic for the purpose of creating outdoor pubic places.
F. Utilities
Staff is working with the owners of all utilities affected by this proposed street
vacation, to prepare and record easements to preserve the rights of those utility
owners, subsequent to the vacation of the street right -of -way. It is proposed that
existing utilities will remain, within those easements, subsequent to the vacation of
the street and the construction of the new park.
G. Report on Conformity
Section 65402 of the Government Code of the State of California states, in part, as
follows:
1.
no real property shall be ... disposed of, no street shall be vacated or
abandoned ... if the adopted general plan or part thereof applies thereto, until the
location, purpose and extent of such ... vacation ... have been submitted to and
reported on by the planning agency as to conformity with said adopted general
plan or part thereof. The planning agency shall render its report as to conformity
with said adopted general plan or part thereof within forty (40) days after the matter
was first submitted to it, or such longer period of time as may be designate by the
legislative body."
It is necessary and appropriate for the Planning Commission to report to the City
Council on the conformity of the proposed street vacation with the Moorpark General
Plan.
H. Conformity
It is the view of staff that the vacation and closure of that portion of Magnolia Street
from Charles Street to a point approximately one hundred twenty feet (120') south of
Charles Street is in conformity with the Moorpark General Plan for the following
reasons:
1. Magnolia Street is a local street and, as such, is not included in the Circulation
Element of the Moorpark General Plan.

WHEREAS, consideration is being given to the possible vacation of a portion of
Magnolia Street south of Charles Street; and
WHEREAS, Section 65402 of the Government Code of the State of California
requires that, prior to an agency taking any such action to vacate any street segment, an
assessment must be made by the Planning Commission of that agency as to the
conformity of the action with that agency's general plan.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The vacation of that segment of Magnolia Street between Charles
Street and a point approximately one hundred twenty feet (120') south of Charles Street,
as more particularly described and shown on Exhibit `A', attached hereto and made a part
hereof, is hereby found to be in conformance with the Moorpark General Plan.
SECTION 2. Said finding is made pursuant to the requirements of Section 65402
of the State of California.
SECTION 3. CERTIFICATION OF ADOPTION: The Community Development
Director shall certify to the adoption of this resolution and shall cause a certified resolution
to be filed in the book of original resolutions.

SUBJECT: Consider the Draft Seven Year Capital Improvement Program [CIP] for
Streets and Roads for FY 2005/06 — FY 2011/12
BACKGROUND
In March of 2005, the City Council approved the City's first Capital Improvement Program
[CIP] for Streets and Roads. Prior to that action, the Planning Commission reviewed that
document and took action with regard to its conformance with the Moorpark General Plan.
Such action by the Planning Commission is required by Section 65401 of the Government
Code of the State of California.
Each year staff will be revising and updating the CIP to delete completed projects, add new
projects and otherwise revise and update the descriptions, cost estimates and funding
sources anticipated to be required for the Program.
DISCUSSION
A draft copy of the CIP for the seven (7) year period beginning with FY 2005 -06 and ending
with the FY 2011 -2012, has been distributed to the Planning Commission under separate
cover. This draft document sets out a seven (7) year plan for the construction of
infrastructure improvements throughout the City.
Public Works, Engineering and Community Development staff have reviewed the draft CIP
and have confirmed the following:
1) All of the future streets and other public works projects listed in the Circulation
Element and other elements of the Moorpark General Plan have been included in
the CIP.

2) The Circulation Element of the Moorpark General designates Moorpark Avenue to
be a two lane local collector. Project 113: Moorpark Avenue Widening calls for the
widening of Moorpark Avenue to more than two (2) lanes. Said project is,
therefore, inconsistent with the provisions of the Circulation Element of the
Moorpark General Plan.
3) Except as noted above, the projects listed in the subject draft CIP are in
conformance with the Moorpark General Plan.
Staff is working on a project to update and revise the Circulation Element. It is the intent of
staff to include in the recommended changes, a different designation for Moorpark Avenue
which will allow for more than two (2) lanes of traffic.
As stated above, it is necessary for the Planning Commission to review the subject draft
document and render a finding as to its conformity with the Moorpark General Plan.
STAFF RECOMMENDATION
Find the subject draft Seven Year Capital Improvement Program for Streets and Roads to
be in conformity with the Moorpark General Plan, except as noted above.

A. Introduction
This is the first update of the Seven Year Capital Improvement Program [CIP] for Streets and Roads for
both the City of Moorpark and the Moorpark Redevelopment Agency (MRA), adopted last year. This
revised program is for the period covering FY 05/06 through FY 11/12.
The primary purpose of this CIP is to provide the City Council with a framework for identifying,
planning and prioritizing needed municipal capital improvements for streets and roads. The year each
project is recommended to be funded, is an indication of the priority given to each project. The figures
cited in the FY 05/06 column, should be equal to the appropriations approved in the FY 2005/06
Budget for capital improvement projects for streets and roads (8000 series).
Projects have been organized- info the five (5) Sections noted below. The projects identified in this
program include both City funded projects as well as major projects which are likely to be constructed
by land developers. The projects listed in Section 100 include future streets which are identified in the
Circulation Element of the Moorpark General Plan. The projects listed in Section 500 include future
needed storm drains identified in the Moorpark Master Drainage Study. Also included in Section 500
this year are certain projects of importance to the City which are planned to be constructed by the
Ventura County Watershed Protection District.
A brief description of the contents of this program is as follows:

includes a location map, a project cost estimate, an implementation schedule, and
recommended funding sources.
The reader is advised that there has been no preliminary engineering performed for most
of the projects programmed in future years. Accordingly, the cost estimates provided for
those projects are very rough in nature and should not be relied upon to predict actual
costs. These "rough" estimates were included in the project descriptions in order to more
accurately depict the estimated total program costs. Individual project cost estimates

Project Description
Realignment and reconstruction of Princeton Avenue (formerly Los Angeles Avenue [East]) from a point
east of Spring Road easterly to South Condor Drive. Additional street right -of -way will be acquired to
provide an eighty -eight feet (88') corridor — sufficient to allow for future widening of the road to four
lanes. The project design provides for only one lane in each direction, with a paved median and paved
shoulders. The project plans call for the realignment and reconstruction of the street pavement, the
construction of storm drains and the construction of retaining walls as required. The walls on the north side
of the street will exceed twenty feet in height at some locations.

development of a trail system, generally along the levee road of the Arroyo Simi, from the westerly City
Limit easterly to Madera Road in the City of Simi Valley. Future expenses are for projects to implement
segments of that system. FY 05/06 costs are for the design of "trail ramps" at the Tierra Rejada Road
Bridge. Ramps at the Spring Road bridge are included in the design for the channel improvements planned

project was redirected to a study of the pedestrian and trail needs in the downtown area. This study will

This project is to provide for the construction of a trail extending from the east end of Campus Park Drive,
across the watercourse referred to Drain No. 2, then south under the freeway through an existing access
tunnel to Los Angeles Avenue. Prior year and FY 05/06 costs are for the development of a feasibility study
to determine access and design requirements. As of December 2005, the study was nearing completion.
Future costs are for the acquisition of those access rights, preparation of the design and construction of the
project. Cost estimates for this project have not yet been developed and the funding for future year projects
has not yet been determined.

Project Description
There is a culvert under Los Angeles Avenue at the entrance to the Villa Del Arroyo Mobile Home Park,
which connects to a storm drain pipe owned by the Mobile Home Park. This "private" drain line extends
southerly to the arroyo. It has been determined that the function of that storm drain is impaired and that
remedial action must be taken in order to provide adequate drainage for both the City street and the Mobile
Home Park. Consistent with the provisions of a Settlement Agreement between the City and the Mobile
Home Park, the property owner is required to take corrective action to remedy this problem.

Capital Improvement Program
D. Congestion Management Program
The purpose of the Ventura County Transportation Commission's (VCTC) Congestion Management
Program (CMP) is to monitor certain street segments and/or intersections on the CMP Road Network
(see Map), to confirm that the Level of Service (LOS) [a measurement of the level of congestion] on
those segments, or at those intersections, does not deteriorate below certain stipulated levels. Increased
traffic. generated by development is one of the major causes of increased traffic congestion and,
therefore, the deterioration of the LOS. The CMP requires each Agency to identify projects designed to
increase capacity and/or otherwise improve the efficient and effective movement of traffic. The
projects set forth in this seven year program, which are on the CMP Road Network and which could
reduce congestion, are listed on the following page.

Remarks
With rare exception, capital improvement projects
have not been funded by the General Fund. It
should be noted that State law requires the City to
maintain an established level of effort of General
Fund expenditures for streets [called a Maintenance
of Effort (MOE)], in order to continue to receive
State AB2928 Congestion Relief monies [see Fund
26101. Although currently suspended, the current
annual MOE amount is $510,432.
Revenue to this Fund is only about $125,000 per
year. In recent years this fund has been used
primarily to fund the Crossing Guard program.
There are no project proposed to be funded by this
source.
In the past these funds have been used to fund
such things as the acquisition of low emission
vehicles. The projected FY 04/05 year -end Fund
Balance is $3.8 million. A list of candidate projects
for this funding was recently reviewed and approved
by the City Council.
The draft program currently shows almost $7 million
in projects, funded by this source, over the seven -
year cycle. The projected FY 04/05 year -end Fund
balance for Fund 2002 is $6.5 million.
Project 401 - Los Angeles Avenue / Tierra Rejada
Road parkway landscaping includes $7,315 from
Fund 2300, which is an amount paid by a developer
as mitigation for unauthorized tree removal. The Los
Angeles Avenue Undergrounding Project [ #111] is
partially funded by Fund 2330 [AD92 -1: Mission
Bell Plaza].
