PUBLIC COMMENTS: Any member of the public may address the Commission during the Public Comments portion of the Agenda, unless it is a Public Hearing or a Discussion item. Speakers who wish to address the Commission concerning a Public Hearing or Discussion item must do so during the Public Hearing or Discussion portion of the Agenda for that item. Speaker cards must be received by the Secretary for Public Comment prior to the beginning of the Public Comments portion of the meeting and for Discussion items prior to the beginning of the first item of the Discussion portion of the Agenda. Speaker Cards for a Public Hearing must be received prior to the beginning of the Public Hearing. A limitation of three minutes shall be imposed upon each Public Comment and Discussion item speaker. B. Consider the Draft Seven Year Capital Improvement Program (CIP) for Streets and Roads for FY 2005/06 — FY 2011/12 (Staff: Yugal Lail) Staff Recommendation: Find the subject draft Seven Year Capital Improvement Program for Streets and Roads to be in conformity with the Moorpark General Plan, except as noted above. 10. Each such selection shall be by three (3) or more affirmative votes. Additionally, each person so selected shall serve until the end of a one -year term or until a successor is chosen (at any time) by three (3) or more affirmative votes. By consensus the motion was restated with 9 clarification of staff's recommendation. 10 MOTION: Chair Pozza moved and Vice -Chair Peskay 11 seconded a motion to accept staff recommendation with 12 the overall height of the steeple and spire at fifty 13 (50) feet. Motion failed with a 2:2 tie voice vote; 14 Commissioners DiCecco and Taillon dissenting; 15 Commissioner Landis absent. 16 Mr. Hogan advised the Commission that per Commission 17 rules, a tie vote was to be continued to the next 18 Planning Commission meeting. He further advised that 19 due to Permit Streamlining Act requirements, a 20 decision on the matter would need to be made at the 21. next City Council meeting, and stated the Commission 22 could direct staff to move the application forward to 23 City Council without a recommendation. 24 Commissioner DiCecco requested that the motion be re- 25 voted in order to provide an opportunity for the 26 project to move forward to City Council with a 27 recommendation. BACKGROUND /DISCUSSION On November 22, 2005, the Planning Commission continued this agenda item with the public hearing open to January 24, 2006, to allow the applicant time to resolve outstanding project issues. Those issues have not yet been resolved. Given the uncertainty of when project issues can be resolved, as well as the length of time since this case was first noticed to the public, staff recommends that this item be taken off calendar so it can be re- noticed when it is ready to be heard by the Planning Commission. MOORPARK PLANNING COMMISSION AGENDA REPORT TO: The Honorable Planning Commission FROM: Yugal Lail, Public Works Director / City Engineer BY: Ken Gilbert, Public Works Consultant rQ9 DATE: January 9, 2006 (PC Meeting 1- 24 -06) SUBJECT: Resolution Finding Magnolia Street to General Plan nVFRVIFW the Vacation of a Certain Segment of be in Conformance with the Moorpark This presents a resolution of the Planning Commission, which makes a finding that the vacation of the street right -of -way for that portion of Magnolia Street between Charles Street and a point approximately one hundred twenty feet (120') south of Charles Street, is in conformance with the Moorpark General Plan. DISCUSSION A. Magnolia Park It is the intent of the City to construct a neighborhood park in the vicinity of the southwest corner of Charles Street and Magnolia Street (see Exhibit 1). It is also the intent of the City to close the northerly one hundred twenty feet (120') ±, of Magnolia Street (see Exhibit 2) and incorporate that property into the neighborhood park. It is necessary, therefore, for the City to vacate the street right -of -way for the above described segment of Magnolia Street, before the City can proceed with construction of modifications to the street improvements in this area, and the construction of the new neighborhood park. Fee Ownership The City of Moorpark is the owner of the property at the southwest corner of Magnolia Street and Charles Street. Accordingly, the City of Moorpark also owns the underlying fee title to the westerly one -half of the subject segment of Magnolia Street. The Area Housing Authority of the County of Ventura [ "Housing Authority "] is the owner of the property at the southeast corner of Magnolia Street and Charles Street. The Housing Authority was, therefore, the owner of the easterly one -half of the subject street segment. The Housing Authority has executed a deed granting to the City of Moorpark, its interest in the underlying fee title to those portions of street right0of -way fronting their property. Accordingly, the City of Moorpark is now the owner of the underlying fee interest to the easterly one -half of the subject segment of Magnolia Street. Upon vacation of the subject street segment, the City of Moorpark will be the owner of the underlying property. C. Process Local agencies may vacate surplus street right -of -way by adoption of a resolution pursuant to the requirements of applicable provisions of the Streets and Highways Code of the State of California. Those provisions require a public hearing be conducted and due notification of said hearing to be given. In the very near future, it is the intent of staff to present to the City Council, a Resolution of Intent to vacate the above described segment of Magnolia Street. That resolution will set the date of a public hearing to consider any objections to this proposed action. As stated below, prior to the City Council taking any action to vacate a street, the Planning Commission must first make a finding that said street vacation is in conformance with the General Plan. D. Open Space and Recreation The proposed construction of Magnolia Park is consistent with certain language set forth in the Open Space, Conservation and Recreation Element of the Moorpark General Plan which discusses the development of Miniparks in the downtown area. vacate_Ma nolia_PC 0510 Street Vacation: Magnolia Street January 24, 2006 Page 3 E. Downtown Specific Plan The Moorpark Downtown Specific Plan discusses the closure of Magnolia Street to through traffic for the purpose of creating outdoor pubic places. F. Utilities Staff is working with the owners of all utilities affected by this proposed street vacation, to prepare and record easements to preserve the rights of those utility owners, subsequent to the vacation of the street right -of -way. It is proposed that existing utilities will remain, within those easements, subsequent to the vacation of the street and the construction of the new park. G. Report on Conformity Section 65402 of the Government Code of the State of California states, in part, as follows: 1. no real property shall be ... disposed of, no street shall be vacated or abandoned ... if the adopted general plan or part thereof applies thereto, until the location, purpose and extent of such ... vacation ... have been submitted to and reported on by the planning agency as to conformity with said adopted general plan or part thereof. The planning agency shall render its report as to conformity with said adopted general plan or part thereof within forty (40) days after the matter was first submitted to it, or such longer period of time as may be designate by the legislative body." It is necessary and appropriate for the Planning Commission to report to the City Council on the conformity of the proposed street vacation with the Moorpark General Plan. H. Conformity It is the view of staff that the vacation and closure of that portion of Magnolia Street from Charles Street to a point approximately one hundred twenty feet (120') south of Charles Street is in conformity with the Moorpark General Plan for the following reasons: 1. Prior to that action, the Planning Commission reviewed that document and took action with regard to its conformance with the Moorpark General Plan. Such action by the Planning Commission is required by Section 65401 of the Government Code of the State of California. Each year staff will be revising and updating the CIP to delete completed projects, add new projects and otherwise revise and update the descriptions, cost estimates and funding sources anticipated to be required for the Program. DISCUSSION A draft copy of the CIP for the seven (7) year period beginning with FY 2005 -06 and ending with the FY 2011 -2012, has been distributed to the Planning Commission under separate cover. This draft document sets out a seven (7) year plan for the construction of infrastructure improvements throughout the City. Public Works, Engineering and Community Development staff have reviewed the draft CIP and have confirmed the following: 1) All of the future streets and other public works projects listed in the Circulation Element and other elements of the Moorpark General Plan have been included in the CIP. Said project is, therefore, inconsistent with the provisions of the Circulation Element of the Moorpark General Plan. 3) Except as noted above, the projects listed in the subject draft CIP are in conformance with the Moorpark General Plan. Staff is working on a project to update and revise the Circulation Element. It is the intent of staff to include in the recommended changes, a different designation for Moorpark Avenue which will allow for more than two (2) lanes of traffic. Introduction This is the first update of the Seven Year Capital Improvement Program [CIP] for Streets and Roads for both the City of Moorpark and the Moorpark Redevelopment Agency (MRA), adopted last year. This revised program is for the period covering FY 05/06 through FY 11/12. The primary purpose of this CIP is to provide the City Council with a framework for identifying, planning and prioritizing needed municipal capital improvements for streets and roads. Congestion Management Program The purpose of the Ventura County Transportation Commission's (VCTC) Congestion Management Program (CMP) is to monitor certain street segments and/or intersections on the CMP Road Network (see Map), to confirm that the Level of Service (LOS) [a measurement of the level of congestion] on those segments, or at those intersections, does not deteriorate below certain stipulated levels. Increased traffic. generated by development is one of the major causes of increased traffic congestion and, therefore, the deterioration of the LOS. The CMP requires each Agency to identify projects designed to increase capacity and/or otherwise improve the efficient and effective movement of traffic.
