RPD-857 U.S. Condominium - Request for Minor Modification Background The above tract was approved by the County of Ventura, prior to the city of Moorpark's incorporation. This tract consists of 92 units. Of the 92 units, ten were originally proposed to be single family detached units, and the remaining 82 units would have been attached (41 buildings in a duplex construction with a zero lot line arrangement) . However due to market demand in the earlier phases of the tract the developer is requesting a change in the proportion of attached and detached units. This request is to increase the number of detached units to 52 and decrease the amount of attached units to 40. Discussion The requested changes from attached units to detached units will only occur where the five feet sideyard requirements can still be met. No changes in lot lines would be required. The elevations of the "newly created" detached units will be the same elevations of the already approved detached units. No architectural changes will be required as a result of this request. TR-3070-4/RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. RPD-857 U.S. Condominium - Request for Minor Modification 1. In the event the Commission feels that this request is reasonable and the Commission has no objections it may approve of the Minor Modification as presented, or 2. It may amend the Minor Modification to the Commission's satisfaction, or 3. The Commission may disapprove the Minor Modification altogether. 4. If the Commission is of the opinion the request is of signi- ficance to the surrounding property owners, it may set a public hearing on this matter, Recommended Action Approve the Minor Modification request. No action on the part of the Commission is necessary. The preliminary draft of an Environmental Impact Report was prepared and was scheduled for public review in May of 1983. • The proposed project for PC-4 consisted of eight phases to be devel- oped over an eight year period (an EIR for Phase I was certified by the Board of Supervisors in 1981). The EIR for PC-4 was a very thorough environmental analysis and included a Fiscal Impact Report. Upon incorporation in 1983 PC-4 was dropped and the Carlsberg Const- ruction Company applied for a General Plan Amendment and Zone Change from Residential to Industrial on approximately 77 acres in the northeast corner of the property. This application, which included an EIR, was denied primarily on the basis of increased traffic. The zoning and General Plan designation at the time of denial was for residential with a maximum density of 1.6 dwelling units per acre. Subsequent to the denial, on June 16, 1986, the Council modified the General Plan Land Use designation by adding the words "this area requires the approval of a Specific Plan" for all of the subject property. With this information develop a Specific Plan to include the selected land uses and specific types and densities for each use. While the draft Specific Plan document submitted by Carlsberg provides a good basis, the plan to be reviewed should reflect the results of the number 1, above and a complete review of pertinent issues including but not limited to hillside grading concerns, timing of critical public improvements, and meeting of General Plan and other City goals and policies. 3. Preparation of an environmental impact report based on the City plan with the Carlsberg plan as an alternative (if the two are different). It appears that the previous EIR's can be used to a certain extent but that at a minimum the traffic and fiscal impact analysis would definitely need to be updated. 4. That a private firm be retained to prepare a complete scoping of the project, the necessary specific plan document(s) and accompanying EIR. Recommended Action 1. Forward this report to the City Council with any additional comments and recommendations. 2. Recommend that staff prepare request for proposals (RFP) for the hiring of a consultant to perform the scoping and to prepare the necessary Specific Plan documents and accompanying EIR.
