Richards, Director of Community Development DATE : January 19, 1987 SUBJECT : REQUEST OF THE CITY COUNCIL FOR JOINT MEETING The City Council at their meeting of January 7, 1987 requested a joint meeting with the Planning Commission. It is suggested that the Commission consider the Council ' s request at your next meeting of January 19, 1987. The Council did not set a specific date for the Commission to consider. In addition the Commission should consider topics for discussion with the Council. RECOMMENDATION 1. Request a date for a joint meeting with the Council. 2. Moorpark Avenue Moorpark, CA 93021 Attention: Planning Commission Dear Planning Commission Members: The Marlborough Moorpark Homeowners-Association (MMH4 hereby request permission from the City of Moorpark to landscape the Southwest corner of the intersection of Peach Hill Road and Moorpark Road. The MMHA proposes to provide all labor and materials to install and maintain (for a period of not less than five (5) years) all landscaping and irrigation in accordance with the attached Drawing, dated 1985. In granting permission to the MMHA to landscape said corner, the City of Moorpark agrees to indemnify, save harmless, and defend the MMHA, its agents, and members from and against any and all suits, action, legal proceedings, claims, demands, damages, costs, and expenses , whatsoever kind of character (including, but not limited to, attorney's fees and expenses) caused by any wrongful acts or any omission, fault or negligence of the City or anyone acting on the City's behalf in connection with incidents involving Tis corner property. Richards, Director of Community Development DAT E = January 13, 1987 S U B J E C T : TRACTS 3070-4 and 4170 (U.S. CONDOMINIUM CORPORATION) - REQUEST TO REVISE GRADING PLAN BACKGROUND Pursuant to the City Council policy regarding changes to approved grading plans (see Exhibit A, item 3) , the attached (Exhibit B) request is being transmitted to the Planning Commission for its review prior to consideration by the City Council. The request is to distribute approximately 103,000 cubic yards within or adjacent to the site. The applicant has provided a grading plan with the revisions shown in red. The original pad elevations are shown in a box within each lot. Their proposed revisions are indicated below each box. An area to the north of the project site will receive most of the surplus dirt. This area is located in the County. One receiver area is within the project site. None of the receiver areas are near existing developed areas, including the pads proposed to be raised. The benefit of this proposal of dealing with the surplus dirt is that no export of dirt would be required from the site, and no truck traffic would be generated on City streets. The City Engineer has also addressed this request (see Exhibit C) . RECOMMENDED ACTION Recommended that the requested grading plan revision be approved by the City Council. The projects have been graded simultaneously to ensure a balance of dirt. As we have come to the end of the job a grading surplus has occured. We have strived to come up with a plan for relocating the excess dirt (approximately 103,000 yards) , which will result in the least impact on the project and surrounding neighborhoods. Our original proposal, presented to the City Council, required constructing new slopes and raising pads up to five (5) feet. The impact of this plan was considered too dramatic. Subsequently, we have completely redesigned this relocating plan, which significantly decreases the impact of the work. To this end, we are proposing that the excess dirt be placed in the following manner. 1. Approximately 69,000 yds of dirt will be relocated into county land in three (3) areas, which are contiguous to our current project. The dirt will be placed in these pockets, utilizing undulating slopes to minimize any impact. The three (3) pockets are all located on County of Ventura property and have been tentatively approved by the County, contingent upon the City of Moorpark approval . The most significant of the three (3) pocket locations in the County is in one of the more desireable areas per the Moorpark City Council . 2. Of the 156 lots in the two phases 34, will be raised a maximum of 3 ft. 3. With the approval of this new plan, it is the intent that there should be no export of dirt. EXHIBIT " B " . , . . RPD-1044 (Cal Prop) Condition Compliance Review of Wall Plan BACKGROUND The above request is related to a 66 lot subdivision (Tract 4037) bounded by Moorpark road on the northeast, Peach Hill road on the south, and easterly of Vista Del Valle Drive. The tract and planned development permit were approved by',the City Council on October 21, 1985 . The final map was recorded on September 10, 1986 . A condition of approval of the planned development permit requires that the wall plan be approved by the Planning Commission. DISCUSSION The wall plan consists of two materials - slumpstone and wrought iron. The walls are shown on the construction detail sheet as five (5) feet above finished grade with a pilaster extending an additional six (6) inches (see detail F) . A slumpstone cap is proposed on top of the wall and pilaster. This type of wall is used through most of the subdivision. The perimeter wall on Peach Hill Road will be of this combination as well as the easterly half of the Moorpark Road segment of the wall . Where view lots. exists -:the__rear wall is proposed to be a combination of four courses of slumpstone as a base with 3 feet of iron above (see detail E) . This will be provided at rear lot lines of view lots as well as the side lot lines that border the westerly half of Moorpark Road. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Planning Commission p. 2 - January 5, 1987 DISCUSSION (continued) A variation of the above two wall types will also be used as a retaining wall in at least one location between Lots 11 & 12 . This wall will be a 6 foot slumpstone base with 5 feet of iron above. A staff concern is the location of the walls on some of the corner lots . Ideally, a five foot setback between the sidewalk and slumpstone wall would be best for aesthetic relief. Some of the corner lots do not provide this separation of the wall and sidewalk because the top of the slope being adjacent to the sidewalk. It appears that this deficiency is a function of the design of the subdivision and is too late to allow for any setback now. Lots 30, 36, and 49 are three corner lots that appear to have walls located where they could be moved back from the sidewalk five feet. A second staff concern is that the fence height is only five feet. This applies to both the slumpstone and iron walls. The pilaster extends one additional course above five feet. Staff ' s opinion is that the five foot height does not afford sufficient privacy and that this height should be increased to six feet. Sideyard gates will be provided as shown in detail J. No color of the gates is specified on the plans. The gates are proposed to be fabricated of resawn cedar with douglas fir frames. RECOMMENDED ACTION Approve the wall plan with the following modifications . 1. A side wall setback of 5 feet shall be provided on Lots 30, 36 and 49 unless it is adequately demonstrated that this is infeasible. 2 . Wall height shall be increased to 6 feet from finished grade to the top of the top course of masonry or wrought iron (the top of the pilaster shall be located one course higher) . 3. Gates shall be painted to match the color of the slumpstone . /crl
