SUBJECT : OFF-SITE SUBDIVISION DIRECTIONAL SIGNS .
• (continued from May 4, 1987) .
BACKGROUND
In the fall of 1986, the• Plannin'g ,Commis's;.ion directed• staff to develop a
comprehensive off-site subdivision direct'i'on sign program. The 'intent was to
' organize the advertising for new tract homes, .limit the locations, control •
aesthetics while still giving each new •tract• in the City the opportunity in
having equal sign exposure. The Buildin g` Industry Association expressed an
interest in working-with the City staff to deveTop a sign program and to' be the
responsible party to ultimately implement the program.
Sample ordinances of 'similar sign programs', from other cities were collected and
presented to the Planning Commission for review at 'a public -hearing held on
April 6, 1987. The item was continued :to April 20th and subsequently to '
May 4, 1987. It was the Commissions desire to have an ordinance modeled after
the Lancaster ordinance. This was presented to the Commission at its May 4th .
meeting. .
The item was continued again to make- certain 'refinements to the ordinance. 'The
B.I .A. has addressed additional concerns in a supplemental- draft ordinance.
Additional items addressed in the- supplemental draft are a. list of definitions,
implementation procedures and a few changes in the sign standards than originally
proposed by staff. ' An annotated' copy of the supplement is attached. ' Although
some implementation language..is included, it is still the City' s interest to
implement the ordinance by separate 'agreement. • . .
RECOMMENDATION . ' .
Approve the attached material as deemed appropriate by. the Commission. A 1 '
revised draft ordinance will be provided to the. Commission prior to a City Council '
' public hearing on the draft ordinance.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, AMENDING ORDINANCE NO. 82,
AS ADOPTED BY THE CITY OF MOORPARK ON
NOVEMBER=.3, 1983, PERTAINING TO THE- SIGN
CODE: STANDARDS AND PERMITS -REAL ESTATE
SUBDIVISION DIRECTIONAL SIGNS.
THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
DOES ORDAIN AS FOLLOW: :
SECTION 1. The City Council of the City of Moorpark does hereby
find, determine and declare that:.
A. The amendment to the zoning ordinance set forth below, was
duly initiated, accordance with applicable laws;
B. Public hearings thereon were duly held by the Planning Commission
of the City of Moorpark on April 6, 1987, and by the City Council on , 1987
C. On May 4, 1987, the Planning Commission of the City of Moorpark,
by resolution No. PC-87-135 recommended to the City Council:
1. That the proposed amendment will not have a significant
effect on the environment and this Commission has reviewed and
considered the information contained in the Negative Declaration
and approved the attached Negative Declaration as having been
completed in compliance with State CEQA Guidelines issued thereunder;
and
2. Directed staff to prepare a resolution recommending
approval to the City Council of the proposed amendment; and
D. That the City Council has further reviewed the requested
amendment and finds that the proposed amendment will not have a significant
effect on the environment and that the Council reviewed and considered the
information contained in the Negative Declaration and approved the attached
Negative Declaration as having been completed in compliance with State CEQA
Guidelines issued thereunder; and
E. Approved the requested amendment on- , 1987;and
F. The City Council has considered all of the information presented
to it at the public hearing held on 1987 and determined that the public
necessity, convenience, general welfare and good zoning practice require the
following amendment be made; .
G. In taking this action, the City Council finds that .the amendment
to the Zoning Ordinance, as -set forth below, is consistent with the General Plan.
SECTION 2. -That Chapter 50 of Title 9 of the Moorpark Municipal
Code is amended as per attached Exhibit "A".

SECTION 3. That this ordinance shall become effective thirty
(30) days after its passage and adoption.
SECTION 4. The City clerk shall -certify to the passage and adoption
of this ordinance; shall enter the same in the book of original ordinances of
said City; shall make a minute of the passage and adoption thereof in the .
records of the proceedings of the City Council at which the same is passed
and adopted; and shall, within fifteen (15) days after the passage and adoption
thereof, cause the same to be published once in the Moorpark News, a weekly
newspaper of general circulation, as defined in Section 6008 of the Government
Code, for the City of Moorpark, and which is hereby designated for that purpose.
SECTION 5. Severability - If any section, subsection, sentence,
clause, phrase or word of this Ordinance is for any reason held to be invalid
by a court of competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this Ordinance. The City Council of the City
• of Moorpark hereby declares that it would have passed and adopted this Ordinance
and each and all provisions thereof, irrespective of the fact that any one or
more of said provisions may be declared invalid. .

ADD TO: Section 9.50.020 - DEFINITIONS: & EXCLUSIONS
(d) "Subdivision Development Subdivision Development shall
• mean a subdivision located wholly or- partially within the
City of Moorpark, a final map of which has been recorded
prior to -the date on which an application for a subdivision
directional sign pursuant to the .provisions of Section 9.50. .
060(a)(1) has been filed."
(e) "Subdivision Directional Sign Base Subdivision Directional
Sign Base shall mean the base structure upon which Subdivision
Directional Signs are placed."
ADD TO: Section 9.50.060 - PERMITS
(a) "Subdivision Directional Signs -
1. Contents of Application.
An application for a subdivision directional sign shall
contain the following information:
a. A scale drawing of the proposed sign.
b. Proposed location of the sign.
c. A list of all previously approved nonconforming
directional signs for the same subdivision development
whether existing or not.
2. Development Standards.
All subdivision directional signs shall comply with
the following standards:
a. Subdivision direction sign base and subdivision
directional sign design shall be approved by
the Department of Community Development.
(See Exhibit "B") .
b. Subdivision directional sign and base shall be
located not less than 600 feet from an existing
or previously approved subdivision directional
sign site. -Further, each sign may contain only
the name of the subdivision and a directional
arrow [maximum of four (4)] . (.See Exhibit "C")
c. the placement of each subdivision directional
sign and base shall be reviewed and approved
by the Director of Community-.Development prior
to the issuance of a building permit. -

d. All subdivision directional signs and bases shall
be placed on private property or City right-of-way
with written consent of the property owner or
City Encroachment Permit obtained and filed
with the Department of Public Works prior to
issuance of a permit. -
e. Any such sign approved for a particular subdivision
within the City shall not be changed to advertise
another subdivision without approval by the
Director of'Community Development.
f. There shall be no additions, tag signs, "streamers,
flags, banners, devices, display boards,' or
appurtenances added to the signs as originally
approved. Further, no other directional signs
may be used, including but not limited to posters
or portable outdoor advertising signs.
g. All nonconforming subdivision directional signs
associated with the subdivision in question shall
be removed within thirty (30) days of the effective
date of this ordinance prior to the installation
of the subdivision directional sign.
h. No subdivision signs shall be erected advertising
tracts located outside the City limits.
i. Said subdivision directional signs shall be allowed
until the subdivision is sold out or for a period
of twelve (12) months, whichever comes first.
Extensions of this twelve (12) month time limit
can be approved by the Director of Community
Development with cause.
j. No more than four (4) subdivision directional
signs shall be placed on subdivision directional
sign base.
k. Prior to the issuance of a permit to place an
individual subdivision directional sign on an
existing base; the applicant shall provide written
proof of paying one-quarter (1/4) the cost of
the original sign base from the applicant originally
constructing such sign base.

TO PROVIDE FOR OFF-SITE DIRECTIONAL SIGNS
RELATING TO NEW HOUSING DEVELOPMENTS CITY OF MOORPARK
Section 1. Purpose: 14151.0

This ordinance is adopted to provide standards for the construction and installation (AL-
of off-site Subdivision Signs within the City of Moorpark and to provide for the
enforcement of such regulations.
Section 2. Definitions and Usage: •
2.1 Unless the context requires otherwise, words and terms used in this ordinance
with initial capitalization shall have the meanings set forth below in Sections
2.1.1 and following.
2.1.1 BIA: "BIA: means the Ventura County Building Industry Association.
2.1.2 CITY: "City" means the City of Moorpark, a municipal corporation of
the State of California.
2.1.3 CITY COUNCIL: "City Council" means the City Council of the City.
2.1.4 CITY MANAGER: "City Manager" means the City Manager of the City or
his or her designnee.
2.1.5 DIRECTOR OF COMMUNITY DEVELOPMENT: "Director of Community Development"
means the Director of. Community Development of the City or his or her designee.
2.1.6 OFF-SITE: "Off-Site" means not located within the boundaries of the
subdivision which is the subject of a Subdivision Sign. -
2.1.7 PLANNING COMMISSION: "Planning Commission" means the Planning Commission
of the City.
2.1.8 SUBDIVISION SIGN: "Subdivision Sign" means an off-site sign adver- 6114IL46 -

2.1.9 PANEL: "Panel" means an advertisement for a specific subdivision af- NEB

3.1 The BIAis hereby designated as the agent of the City for administration of U .)
terms of this Section 3, except that the BIA shall have no enforcement powers 1-04Oa.
hereunder. , The duties of the BIA under this Section 3 include, but are not limited
to, the following:
3.2 Timely, equitable and non-discriminatory acceptance and processing of applications
to install off-site subdivision signs.
3.2. 1 Preparation of an off-site subdivision sign location plan showing the
site of each sign subject to the approval of the Director of Community Development.
3.2.2 Timely construction and installation of off-site subdivision signage.
3.2.3 Maintenance of off-site subdivision signs and their locations in a neat,
clean and orderly condition.
3.3 The duties imposed upon the BIA pursuant to this Section 3 may be exercised
by a third party, subject to prior approval of such third party by the Director
of Community Development. . ,
3.4 Off-site subdivision signs shall confirm to the following standards: 6-X11g34E
3.4.1 The panel and sign structure design shall be in accordance with EC-FtrOr< EN

3.4.2 Off-site subdivision signs shall contain no more than -s°ixx—(6) panels

3.4.3 The first panel of each sign shall be reserved for the purpose of identi-5i
fying important public buildings or facilities at no cost to the City of Moorpark. !1Tg 'c
3.4.4 No off-site subdivision sign shall exceed eight (8) feet in height or EN4W15

3.4.5 Each panel shall be nine (9) inches high and five (5) feet long.
Further, each panel may contain only the name of the subdivision or project and
a directional arrow. (Exhibit C)
3.4.6 Any such sign approved for a particular subdivision within the City .ye{NE- p0j

3.4.7 There shall be no additions, tag signs, streamers, devices, display

3.4.8 Off-site Subdivision Signs be permitted in all land use zones and
may be placed on private property with written consent of the property owner or
on city right-of-way pursuant to a City encroachment permit obtained from the
Director of Community Development.

- 4.1 All liabilities, costs and expenses arising out of the siting, installation
and construction of off-site subdivision signs, and out of administering the
provisions of this Section 3, other than enforcement expenses related to violations
of Section 3, shall be borne by the BIA and the City shall have no liability
therefore.
