Richards, Director of Community Development DATE: September 23, 1987 (PC meeting of 9/28/87) SUBJECT: CURRENT REQUESTS FOR GENERAL PLAN AMENDMENTS The attached represents a list of requests for General Plan Amendments that dates back to 1985 when the Council discontinued accepting applications. All individuals and organizations on this list have been contacted and asked to indicate their current interest in their past request for a General Plan Amendment. Of the eighteen people solicited, only 3 have responded to date. They are as follows (also see attached map): 1. Moorpark Ranch and Milling, Inc. Request to change 35.4 acres on south side of Los Angeles Avenue east of Maureen Lane from medium low density residential to high density, very high density, and general. commercial . 2. The Levy Company Request to change 290 acres north of Poindexter Avenue and west of Moorpark High School from AG-1 to various residential and industrial uses. 3. Lynn Scaroni Request to change approximately 1.75 acres on the north side of Everett Street east of Walnut Canyon Road from medium low density residential to very high density residential . Two unsolicited requests were also received: 4. Moorpark Ave. Moorpark , California 93021 In 1960 , we purchased parcel no. 500-0-260-060 , located at 289 Casey Road , Moorpark. At the time of purchase , it was zoned A-1 (Agricul = tural 1 acre inclusive) . In the middle 1960' s , it was re-zoned RE- 1 acre . It was our intent to develop this property by building three more homes . We purposely bought this property because it was zoned for that possibility. Until the late 1970 ' s , it was impossible to secure any financing in Moorpark and outside banks were not making loans here either. Conditior improved in the late seventies , and were about to start building when the county of Ventura decided to have an update of the General Plan . They chose a group of citizens that were relatively new to the area (all but a couple were residents of a year or so) . As they held public hearings , we attended and voiced our objections when they proposed to change our zoning from. RE- 1 to "Open Space 5 acres " . . We were told that they were the ones that were making the decisions . When it came before the county Supervisors , we again protested at the hearing , but our cries were not heard and the Supervisors adopted the Update to the General Plan. When Moorpark became a city, we again voiced our objection to the new zoning and were informed that the only way we could regain our previous zoning was to submit for a General Plan Amendment (with no guarantee that after we expended thousands of dollars that we would get our old zoning back ) . While we pondered our next course of action , a Moritorium w-as made on all changes to the General Plan. On June 9 , 1987 , the United States Supreme Court ruled that the cities and counties that deny a landowner the use of his or her land is to be considered taking of property within the meaning of the Fifth Amendment "Just Compensation" clause , requiring government to pay landowner value of use for the period during which use is denied . Any act of this shall be considered a violation of the Fifth Amendment. The first taking of our land occurred when the Ventura County Board of Supervisors adopted the new General Plan Update in 1979 . They shall be held liable for the period from 1979 to July of 1983 , when Moorpark became a city and shortly thereafter adopted the General Plan from the county . The city then assumed all responsibility for any and all violations from that date on . I cannot seek recourse from the City of Moorpark for the time from 1979 until incorporation . I shall seek compensation from the county in due time through the courts . • August 21, 1987 Joseph & Evelyn Latunski 289 Casey Road re : 500-0-260-060 P .O. Box 456 Page 2. Moorpark , CA 93020 It is our belief that the city assumed all responsibilities when they adopted the county' s General Plan for the City of Moorpark . We do feel the City of Moorpark also denied us the rights guaranteed in the Fifth Amendment for denying us the right to develop our own property. To do this without due compensation is a violation of the Fifth Amendment, and we seek compensation for these acts since 1983 . First , we want oar property re-zoned back to its original zoning RE-1 acre. AI-1 acre would also be acceptable , this would allow horses . Second, we request that all fees and charges imposed by the city after 1983 when the City of Moorpark incorporated , be waived for our devel - opment of this property. Third , we feel that we should be financially compensated for the taking of our property for the past four years . Fourth , we wish to start immediately to develop our property and your cooperation in this matter would be most appreciated. Our property is within six tenths of a mile from City Hall . There was never any reason to re- zone our property to Open Space 5 acre „ minimum in the first place . That zoning made our parcel non-conforming . We request action on this matter as soon as possible and do not want to wait until the NEW General Plan is adopted at some future date . You further state that if we wish to pursue our original intentions to have that fact in writing to you by 5 p.m. tomorrow. This is that letter. Our request is for a General Plan Amendment to provide for development of our 290 acres in the City of Moorpark. We send herewith copies of our April 9, 1985, request, of the maps showing the subject property, and of intervening correspondence with the City indicating our desire and intention to pursue the matter. It seemed to me that Mr. Montgomery's comments to the affect that you are now "scoping" the General Plan, will soon hire consult- ants who will study and report, and that you will then make pro- posals which will be the subjects for public hearings, are right on track. As a matter of fact, your memorandum to the City Council dated January 28, 1987, recommended that exact action. As I have told you informally before, we think our parcel is pretty sensitive because of its visibility and its proximity to the City offices and the "old" downtown area. Therefore we don't want to propose usages that are not really solidly compatible with good • planning for that particular general area. And we don't think we can be specific until we know what the City wants and has to do about traffic circulation. As a consequence, I have not yet felt it appropriate to make any verbal statements or pose any requests at the public hearings. If it is available, we would like a copy of the City Engineer's comments on the General Plan; and when you have pulled your comments together, we would like a copy of them also. Finally, with enough warning, I would be glad to tour the Commissioners over our parcel as they Monday night indicated they would like to do. The property is located on Casey Road directly across the street from the Moorpark High School, less than 1000 feet from the Moor- park Fire Station, which is itself located across the street from th Moorpark City Hall and Moorparl Library. It is bordered on the east by a substantial number of small residences located along Walnut Canyon Road. East and south of the fire station are several churches and nearby Main Street is the largest and oldest shopping area in the city. The map of Moorpark discloses that my parcels are almust in the heart of old Moorpark, whereas new areas of growth, which have been incorporated into the city, such as the Moorpark Road-Peach Hill area, Los Angeles Ave.-Buttercreek Road area, and the Simi Valley Freeway-Moorpark College area are located miles away from the city center. The community water reservoir was located on my land until it was found inadequate for the needs of the growing community and a new larger reservoir was built farther north on Walnut Canyon Road where it oould service the growing community. Sewers were built, flood control channels were constructed (some of them on easements over my parcels) , roads were built and enlarged, and street lights were installed. During all these years taxes were imposed by the county(and now by the city) for the construction and maintenance of all these improvements and these taxes were paid and still being paid by me(on parcels located in the very heart of the city) . The above facts would seem to indicate that the zoning of parcels located in the immediate vicinity of the city hall, fire department, city library, several churches , bank, shopping areas, etc. would be very high density because residents of homes in this area could - RECEIVED -- SEP 2 1981 CITY 11F Mflt1RPARK . ,' Page 2 easily walk to schools, city hall, shopping areas and churches, reducing vehicular traffic. However, the city of Moorpark, when creating the first city plan, zoned most of my parcels (about 39 acres) as RA-5 (5 acres to one residenwe) nhave called 11 acres aforEatOleast a ,000, although conventional planning ould buffer zone of gradually decreasing density between the commercial, high density residential city center district and the agricultural land farther out. The designation of very low density, RA-5 is generally given when no amenities, such as sewers, streets, schools, fire protection, police protection, etc. are unavailable or too expensive to provide. For all these years I have been paying the taxes on my parcels for such improvements and have been assessed higher taxes for street lighting, street improvements, etc. and yet have been effectivelye denied the use of the property in its highest and best use. compound the injury the action of the City of Moorpark in declaring a moratorium has caused me furthur damage and has reduced the current value of my property well over 50%. The argument is made that large growth has brought with it greater traffic , etc. on the streets near my property. Telling me that I cannot improve my property because of this haS ,increased tral‹, brought about because neiJgrowth in outlying areas of the city ignores the fact that these newer areas should have been assessed the costs for the heavier traffic flow into the center city. We centrally located property owners have already paid for the roads, etc. over the many, many years of paying taxes and should have the privilege and right to use the improvements we have helped pay for. I ask that these inequities be corrected by the planning commission by changing the zoning of my parcels to medium density in the proposed modification of the City General Plan. The proposed amendment would redesignate approximately 350 acres located west of Walnut Canyon Road and north of Moorpark High School from rural high (one unit to five acres) to low (1 .6 units to the acre) density residential. The subject property was evaluated in the 1980 Walnut Canyon Study which was adopted by the County Board of Supervisors. The study established the road and infrastructure necessary for the development of the area. The proposal would provide for development consistent with the intent of the study. The approval of the General Plan screening would permit future development to proceed and permit City staff to thoroughly evaluate the proposal. In support of the General Plan Amendment request, we would propose that the Planning Commission consider the rural character of the property and the ability to retain this character through proper land planning. Over the past 18 years the Westoaks Realty Group has been successful in developing residential and commercial projects in the Conejo,Simi and Santa Rosa Valley areas. We feel that the best use of this land is to develop a higher end residential single family homes similiar to the North Ranch development in Westlake Village. This idea was originally suggested to us by Jim Weak . In order to accomplish this we discussed using density averaging with lots varying in size from 1/2 to 1 acre with the balance of acreage left to open space. It is very expensive for a owner to maintain a 5 acre site and we have found that the most successful developments will limit their lot size from 1/2 to 1 acre and have a home owners association maintain the balance of the open space. We are currently considering using the open space for parks, horse trails or even possibly a golf course. Tom Weiscoff and The Pittman Land Planning Group are currently exploring the golf course idea. Under its' current zoning, the property is not feasible to develop and we are therefore requesting a higher density from 1 unit per 5 acres to 1 unit per acre. The land is presently leased for row crops on an annual basis . It is essentially level and bordered by gentle slopes at the north , east & west boundaries : a separately distinct small valley , in effect , at the same elevation as the industrial land to the south . Access to the property consists of a private "at grade " SPRR crossing. Proposed access would be a westerly extension of a street from Gabbert Road , parallel and north of the SPRR tracks . This street alignment would be a continuation of High Street , were it extended west from Moorpark Avenue, in the future. The topography would lend itself well to an enclosed park or fee mobile subdivision. The surrounding slopes provide for natural topographic separation from adjacent land uses now and in the future. The proposed use would work very well in a transitional sense, industrial/SPRR, North to rural agriculture/rural estate. The project can be designed with good sound and visual buffering from the SP tracks at the south boundary, primarily due to the approximate 300 ' separation afforded by the S. C. Edison parcel separating the subject property from the tracks . Secondary emergency access is available to the north , with the primary being east to Gabbert Road . We think there is considerable merit in providing the opportunit9 for a new, good sized mobile home park or mobile home subdivision . With an average density of 7 units ( typical park density ) , this project could yield approximately 240 low income/affordable housing units , and/or retired/fixed income homes for Seniors. FOUNTAINWOOD: A preliminary site plan depicting a "density transfer" or clustered development proposal at the proposed RPD-1 . 6 zoning, (1 . 6 DU/ACRE - LOW DENSITY) . As previously discussed , this concept yields approximately 700 units for the total 443 acre gross acreage . It also provides for approximately 193 acres of natural Open Space, generally in existing watershed areas , and for buffer purposes, in certain areas . Access is addressed via a 1985 traffic engineering preliminary study incorporating the then best information available regarding the future connection of the 23/118 freeways . As we have indicated on a number of occasions , the access study was done preliminarily, utilizing a long range planning posture, in order to determine development options and pattern: should the freeways connect in some fashion similar to the then speculative information available from Cal-trans . The proposed development pattern does not depend upon freeway access, however, as previously stated . There are 3 points of access to existing roadways , plus rural ranch roads for emergency, secondary access to the north . CIRCULATION PLAN - FOUNTAINWOOD: A more detailed map of the preliminary access and general circulation study done by JBR traffic engineers in 1985 for planning purposes . 3 . CIRCULATION PLAN - EASTERN MOORPARK: A general circulation update of the 1985 study, completed in March , 1987 . JBR ' s proposed project is not highlighted since this map was intended to assist the City of Moorpark General Plan Update process , incorporating existing, proposed and "future" roadways for overall circulation analysis and consideration . We hope this additional information will help you envision the JBR property land use proposal and appreciate the overall merits of our plan .
