SUBJECT: PLANNING COMMISSION ACTION ITEM - MULTIPLE PROCESSING
OF PLANNED DEVELOPMENTS ON A SINGLE LOT
Background
The Planning Commission at their meeting of April 4, 1988
requested that the subject of multiple processing of planned
developments on a single lot be placed on their April 18, 1988
agenda for future consideration. This subject was of concern to
the Planning Commission during their latest review of a major
modification to PD-1062 (Embassy Group, Ltd. ) . The processing of
a request to develop the northwest corner of Spring Road and
Tierra Rejada Road involved a land division so as to separate a
portion of the original 4+ acre site for another use and
ownership. The applicant choose to process a separate planned
development for each of the lots so as to allow for future
modifications and not enjoin the other portion of the site into
discussions and conditions of later modifications.
Discussion
The city has processed multiple planned developments for projects
since its incorporation. This includes Residential, Commercial and
Industrial projects. Until the present time it has been the city's
policy to allow the applicant to file any number of planned
developments as part of project processing. It has only been
within the past year that staff has "packaged" multiple PD's and

considered them a "proposal" under Resolution 86-276. As with
most issues thRee are positive and negative aspects. The following
are those positive elements that staff feels are of benefit to the
city in allowing multiple PD's to be processed:
1 . The city has the opportunity to review the complete
(or at least the major portion) project in lieu of an
incremental approach.
2. Where a parcel map is involved it is assumed that the
property will be sold to separate parties. In the
future modifications will occur. Should a project be
processed under one PD the party seeking a
modification would need concurrence with all the other
property owners to seek a change.
3. Separate PD's allow for the tailoring of conditions to
fit a specific user.
The negative aspect of processing multiple PD's on a single lot is
the fact that should modifications occur on an adjacent PD the city
cannot go back and modify the conditions of approval or even
revoke the PD as approved without risking legal action.
Recommendation
Should the Commission wish to modify the current practice of
allowing multiple PD's to be processed staff would request
consideration of the following:
1 . Consider the adoption of a policy by the City Council
in lieu of a resolution or ordinance so as to allow
future flexibility on permit processing; or
2. Consider modification to Resolution No. 86-276
regarding processing of certain permits; or
3. Create a new resolution regarding the processing of
multiple planned developments.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, DIRECTING THAT CERTAIN
PERMIT APPROVAL PROCESSES BE PERFORMED BY CERTAIN
CITY OFFICIALS; AND THE REPEALING OF ALL RESOLUTIONS
IN CONFLICT THEREWITH.
WHEREAS, Resolution No. 83-29 as amended by Resolution No.
83-49, prescribes the City offices that approves various permits;
and
WHEREAS, the Planning Commission as well as the staff have
recommended changes to said approval authority;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Resolution No. 83-29, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK DIRECTING THAT CERTAIN FORMER VENTURA
COUNTY PERMIT APPROVAL PROCESSES BE PREFORMED
BY CERTAIN CITY OFFICIALS.
adopted September 7, 1983, and Resolution No. 83-49, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK AMENDING SECTIONS (e) and (f) OF
RESOLUTION NO. 83-29, ADOPTED SEPTEMBER 7, 1983,
regarding permit approval process.

SECTION 2. Where the Planning Commission is authorized
to approve or disapprove an entitlement herein, such decision is
appealable to the City Council. Where the Director or Community
Development is authorized to approve or disapprove an entitlement
herein,. such decision is appealable to the Planning Commission
and subsequently to the City Council.
SECTION 3. A request for a Modification to an entitlement
herein shall be deemed a "Minor Modification" , as determined by
the Director of Community Development, when such modification does
not alter the intent of the determining body. All other modification,
and including those where there is doubt as to it classification,
are deemed "Major Modifications" .
SECTION 4. Major Modifications shall be approved or dis-
approved by the official or body granting the original approval or
an appeal thereof , and shall be processed in the same manner as the
original approval.
SECTION 5. Where the City Council is the body with approving
or disapproving authority, the action shall first -be processed through
the Planning Commission for its recommendation.
SECTION 6. Approval or disapproval shall be performed by
the following City Offices of Officials:
(a) General Plan adoption - City Council.
(b) General Plan Amendment - City Council.
(c) Ordinance Adoption/Amendment - City Council.
(d) Zone Change - City Council.
(e) Residential Planned Development Permits - Planning
Commission for proposals of four units or less; City
Council for proposals of for more than four units.
(f) Commercial Planned Development Permit - Planning
Commission for proposals of less than 20, 000 square
feet of gross floor area; City Council for proposals
of 20, 000 square feet or more of gross floor area.
(g) Industrial Development Plan Permit - Planning Commission
for proposals containing less than 50, 000 square
feet of gross floor area for all buildings involved;
City council for proposals of 50, 000 square feet
or more of gross_ floor area for all-buildings involved.
-(h)- Administrative Clearance Director -of Community Development.
(i) Director Conditional Use Permit - Planning Commission.
(j) Planning Commission Conditional Use Permit - Planning
Commission.
