G. PROPOSED PROJECT:
The proposal is to modify the Industrial Planned Development Permit (DP-34 ) to
allow for the outdoor storage of recreational vehicles, and for a rental
business of transportation vehicles (U-Haul trucks and trailers), to be stored
and displayed within the existing parking stalls along the east and west sides
of the project site. The applicant also requests approval to conduce;
complementary service and sale activities which are auxiliary to the existing
self-storage operations and the proposed outdoor truck and recreational vehicle
storage. These activities include the rental of copying equipment and mail
boxes; sales of packaging materials and general merchandise; installation of
public telephones, vending machines, and a propane gas filling station. In
addition, for the convenience of the patrons of the self-storage facility, the
applicant proposes to extend the bo'irs of operation during weekdays and
Saturdays from 6:00 a.m. to 10: p.m. and Sundays from 10:00 a.m. to 4:00 p.m..
Finally, the applicant requests to amend the liability clause (a standard
condition of the Development Plan. Permit: No. 348) in order to reduce his
financial obligations in case of any l.eal proceedings against the City. A list
of the approved conditions for. DP-348, which the applicant proposes to modify,
delete, or add is given in Exhibit 6.

E. PROJECT SITE HISTORY:
On February 2, 1987 the Planning Commission adopted Resolution No.
PC-87-127 approving a 47,400 sq. ft. self storage building on a 1.4 acre
site along Los Angeles Avenue, approximately 210 feet east of Goldman
Avenue. On September 8, 1987, the Planning Commission approved Minor
Modification No. 1 to allow the construction of two buildings instead of
four as originally approved. On February 6, 1989, the Planning Commission
approved Minor Modification No. 2 to allow the substitution of fifteen (15)
gallon size trees along the eastern property line in lieu of the nine 24"
box trees as specified.
F. EXISTING SETTING:
The project is bordered to the north and north-w- by the industrial
buildings. To the southwest of the project site, a O northeast corner of
Goldman Avenue and Los Angeles Avenue, is an undeveloped, vacant 0.64 acre
parcel. Single family residences abut the project site along the eastern
periphery of the project site approximately 20 feet from the side property
line. In addition, there are single family residences south of Los Angeles
Avenue, which fronts the project site to the south. On the project site,
existing development includes two completed two-story self-storage
buildings, 482 sq. ft. each and 26.5 ft. high with parking stalls located
along the eastern property line and along the west side of the storage
facility. A 9 foot concrete block wall is constructed along the eastern
boundary of the site, while a 6 foot wrought-iron fence with pilasters
fronts the south property line adjacent to Los Angeles Avenue. Existing
landscaping, which includes a 30 foot landscaped planter and two 3 foot
landscape strips, comprises 11% o:E the site.
SECTION III - ANALYSIS
As previously stated, the proposed modifications would involve the outdoor
storage of recreational and rental transportation vehicles on the existing
parking spaces. The modifications would also include the operation of service
related activities incidental to the self-storage facility and the proposed
outdoor storage use such as the rental of copying equipment and mail boxes;

sales of packaging materials and general merchandise; installation of public
telephones, vending machines, and a propane gas filling station. In reviewing
the appropriateness of the proposals for the M-1 Zoning District, planning staff
must analyze the issues of land use and its parking/circulation onsite;
aesthetic/visual considerations; traffic and noise impacts on adjacent single
family residences and the immediate neighborhoods; and safety hazards.
1. Land Use:
The applicant contends that since the outside storage of recreational
vehicles and transportation vehicle is a natural outgrowth and integral
part of the self-storage facility which is the principal use permitted in
the Industrial Park District Zone (M-1), the proposed use should be allowed
within the zone. Staff does not agree with this contention. The outside
storage of such vehicles is not considered auxiliary to the principal use
of self-storage. Moreover, this use is not consistent with the intent and_.
purpose of the M-1 District, Which does not allow it either as one of the
principally permitted uses, or accessory uses or conditionally permitted
uses. The outdoor storage of trucks and trailers for rental purposes is
only permitted in the commercial zones such as Neighborhood Commercial
(C-1); General Commercial (C-2); and Commercial Planned Development (CPD);
and is subject to a conditional use permit process in addition to a
development permit. The outdoor storage of recreational vehicles is
conditionally permitted only in Rural Agriculture (R-A); Rural Exclusive
(g-E); Limited Industrial District (M-2); provided the vehicles are placed
on the rear yards and on a minimum storage area of one acre.
Outside storage of vehicles such as those proposed by the applicant was
specifically prohibited by the Planning Commission as part of the
conditions of approval of September 1987. In relation to the applicant's
request to conduct minor service and sale activities, they are permitted in
the zone only if they are services related directly to the principally
permitted use of self-storage facility such as sales of packaging
materials, installation of a public telephone (only one allowed), and
vending machines. Those uses such as mail box rental, and the proposed
propane gas filling stations which provides service appropriate to
recreational vehicles would therefore not be permitted. Moreover, storage
of propane is not permitted in any industrial zones under any permit
process. Those uses which are directly related to the principal use of
self-storage, such as those listed above, can be processed as a minor
modification to the Industrial Planned Development Permit No. 348. If the
minor modification is approved by the Planning Commission, the applicant is
conditioned to file a Surety Performance Bond in the amount of $10,000 to
ensure compliance of conditions (see Exhibit 2 for Conditions of Approval
for Minor Modification No. 3) .

2. Parking/Internal Circulation
The storage of big trucks, trailers and recreational vehicles as proposed
by the applicant on the existing parking stalls would remove not only the
parking spaces required for the self-storage facility but would also
interfere with the onsite circulation patterns. The applicant has provided
40 parking spaces for the entire site while 39 spaces are required.
With only one extra parking space available the parking site will certainly
not be able to accommodate all 35 recreational vehicles, 4 van trucks, 5
trailer and two (transit) van trucks as proposed without complete
encroachment upon the existing parking stalls. Even if not all the tracks
or recreational vehicles are stored/parked at the same time, there will not
be adequate parking stalls for most employees, customers and visitors to
the main facility. The grossly inadequate parking areas for such vehicles
may encourage their storage in areas which would exacerbate the onsite
circulation patterns. For instance, staff, on two separate field
inspections, has noticed the illegal parallel parking of several U-Haul
trucks along the back of the northerly building, which tends to block the
two-way traffic flows of the 25 foot driveway.
The complementary service and sale activities proposed by the applicant
would require a loading zone to be set up for delivery trucks. However,
there is no space in the back yard to accommodate such a facility without
encroaching onto the 25 foot alleyway.
In view of the extra length of the transportation and recreational vehicles
(which range between 12 feet to 26 feet), staff concludes that the existing
18 foot compact stalls on the west side of the building would certainly be
too small in size to accommodate such vehicles. Moreover, staff believes
that the 18 foot alleyway along the western half of the site would be wide
enough only for one-way traffic. Also, it does not meet the minimum width
of 25 feet as required by the County Code for emergency access. If the
project is approved, the City should condition the applicant to construct
to full width (25 feet) this alleyway in order to ease onsite traffic
circulation.
The parking of the 14 foot to 20 foot recreational vehicles on the existing
20 foot parking stalls on the east side of the buildings would still create
traffic hazards. Even with the standard 25 foot aisle width, it would be
difficult for such vehicles to safely negotiate a 24 foot minimum radius
turn without sideswiping the side of the adjoining building. The regular
movements of heavy trucks and recreational vehicles to and from the site,
in addition to the normal trips generated by the self-storage facility,
would create traffic congestion, particularly on the 25 foot alleyway which
is shared and heavily used by the adjoining commercial properties to the
north and west of the site. The backing out of heavy trucks onto the
narrow parking aisle would cause stacking of cars and thereby interfere with
the internal traffic flows. The area of the site does not appear to allow
for a separation of the heavy truck movements and that of the cars.

3. Aesthetic/Visual Impacts
It is good zoning practice to reconcile existing discordant land uses by
establishing adequate interfaces among conflicting uses and functions. The
walls and landscaping that exist on the site do not present an effective
visual buffer for the adjoining single family residences across Los Angeles
Avenue to the south. Because of the nature of the wall construction (open
wrought-iron fence with pilasters) along the street frontage, the storage
of recreational vehicles along the east side of the storage buildings would
be seen easily from Los Angeles Avenue. Moreover, any outside storage of
U-Haul trucks and trailers along the west side of the building would be
open to view from the major arterial street until the adjoining parcel, to
the southwest of the project site is developed. The presence of the 9 foot
block wall along the east property line would not lessen the clutter and
visual blight that would be created if large tracks and vehicle are stored
outside. If the project is approved, a six foot solid, decorative masonry
wall, instead of the existing wrought-iron fence should be conditioned
along the entire street storage.
While landscaping occupies 11% of the site, the scale and nature of the
landscaping materials are not appropriate to the site and/or structure.
The type and nature of shrubs and groundcover that exist on the site is not
dense or mature enough to provide a visual enclosure and screening. They
lack visual interest in terms of type and spacing of plants and fail to
soften the appearance of the tall buildings structures. The shrubs in the
3 foot landscape strips should be grouped more densely together to form
substantial hedges and walls. They should be able to screen parked cars
from the adjacent street and minimize the impact of large paved areas.
Interior landscaping in the parking areas should include trees that will
provide adequate visual enclosure and shading when they mature.
Unfortunately, the existing 3 foot landscape strips are not wide enough to
accommodate the 24" box trees. The plants in the narrow 3 foot landscape
planters along the west side of the storage buildings are in danger of
being overexposed to the heat exhaust of automobiles because of the 2 foot
overhang of parked cars. The landscaping of the 30 foot planter along the
major street (Los Angeles Avenue) should also include larger size trees
with denser foliage than the existing trees. If this project is approved,
the above recommendations on landscaping should be incorporated as part of
the conditions of approval.
4. Traffic
The increased traffic that would be generated by the proposed modifications
may have an adverse impact on Los Angeles Avenue, a major arterial which
has not been fully widened to an ultimate 94 foot right of way and not been
fully improved at this point in time. If the project is approved, the
applicant is conditioned to provide full street improvements (including
meandering sidewalk, additional paving, curb, gutter, tree wells,
landscaping and irrigation systems) along Los Angeles Avenue after the City
has completed the widening of the arterial street.

5. Noise
Movement of 9 trucks and 35 recreational vehicles (though not necessary all
at the same time) would generate noise which would adversely impact the
adjoining single family residences. The proposed extended hours of
operation, if approved by the Planning Commission, would exacerbate the
noise problems. The noise levels would be particularly disruptive to the
noise-sensitive residential homes, if the applicant is permitted to extend
/',/both their hours of operation and the workdays to include Sunday. The
screening provided by the existing walls and landscaping is not adequate to
attenuate the noise that would be generated by the additional activity and
the extended hours If the project is approved, the applicant is
conditioned to reduce the possible hours of operation to occur between 8:00
a.m. to 8:00 p.m. and to exclude Sunday operation.
6. Safety
Because of the highly inflammable and hazardous nature of propane gas, the
installation of a propane gas filing station is heavily regulated by the
County Uniform Fire Code. The location of a propane gas filling station in
relation to setback requirements will depend on the size and capacity of
the tanks. As mentioned previously, the storage of propane is not
permitted in M-1 or any other industrial zones. Moreover, staff strongly
feels that the proposed use on the subject property would jeopardize, or
endanger the safety and general welfare of persons residing in the
adjoining residential properties. If the proposed modifications are
approved, the applicant is conditioned to meet all the pertinent
regulations of the Uniform Fire Code relating to location, setbacks and
capacity of the filling station. Further, the handling of the hazardous
gas shall require the filing of a Uniform Fire Code Permit and an Emergency
Hazardous Materials Business Plan pursuant to Chapter 6.95 of the
California Health and Safety Code.
7. Liability Clause
The applicant requests to amend the liability clause which is one of the
standard conditions of approval for the Industrial Planned Development
Permit (DP) 348. In order to protect the City from expensive litigations,
the liability condition was drafted by the City Attorney as a standard
condition of permit approval when the City incorporated on July 1, 1983.
Therefore, staff strongly recommends that no amendment on this legal clause
be permitted.
SECTION IV - CONFORMANCE WITH THE GENERAL PLAN
The requested major modification is considered inconsistent with the
following Goals and Policies of the Land Use Element of the General Plan:

Goal 3 To minimize air, water, visual, and noise pollution by
industrial uses.
Discussion: As previously discussed, the existing block wall and
landscaping are inadequate as visual and noise buffers against
the visually disruptive proposed uses.
Goal 8 To provide for visual amenities along major roads to make them
attractive as well as convenient to the people of Moorpark.
Discussion: The clutter and visual blight that would result from
the proposed modifications would be seen from a major road and
therefore would degrade the street scenic view corridor.
Policy 6 To establish sites for appropriate industrial uses in locations
which are harmonious with adjoining land uses, and which do not
degrade the general physical environment of Moorpark.
Discussion: The proposed modifications would generate visual
blight and adverse noise and traffic impacts on adjoining
residential properties without adequate interfaces between
discordant uses.
SECTION V - ENVIRONMENTAL DOCUMENTS
Review of pertinent environmental documents has disclosed that the
proposal, if approved, may have adverse environmental impacts. Mitigation
measures have been added to the proposal which would reduce these impacts
to a level of insignificance. A discussion of these potential impacts and
mitigation measures are attached. Proposed mitigation measures have been
included as conditions of project approval. A proposed Mitigations
Reporting and Monitoring Program is included with the Mitigated Negative
Declaration and must be adopted prior to project approval to comply with
Assembly Bill No. 3180.
Assembly Bill No. 3180 was adopted by the State Legislature in 1988. To
summarize, this new law requires a local agency to adopt a reporting and
monitoring program in conjunction with the adoption of a Negative
Declaration or in conjunction with the adoption of the findings for an
Environmental Impact Report.
SECTION VI - AGENCY REVIEW
Agencies and Departments which reviewed Major Modification No. 1 include
the County Fire Department, County Sheriff's Department, Caltrans
District7, County Environmental Health Department, and Air Pollution
Control District. Staff has included the proposed conditions generated
through the agency review as conditions of project approval.

SECTION VII - STAFF RECOMMENDATION
That the Planning Commission direct staff to draft a resolution to be
considered at the next regular meeting of December 18, 1989, recommending
that the City Council deny Major Modification No. 1 because the required
findings cannot be made, and approve Minor Modification No. 3 to allow the
installation of one public telephone, a vending machine, and the sale of
packaging materials which are considered accessory to the principal use of
self-storage.

1. MITIGATED NEGATIVE DECLARATION FOR MAJOR MODIFICATION NO. 1

REPORTING AND MONITORING PROGRAM
1. NOISE:
Mitigation: Prior to issuance of a zoning clearance the following
mitigations shall be adopted:
a. Reduce hours of operation to occur between 8:00 a.m. to 8:00 p.m. and
to exclude Sunday operations.
b. Replace the existing sparse shrubs and trees by a more dense
landscaping buffer per direction of the Director of Community
Development.
c. Replace the existing wrought-iron fence with a solid masonry
decorative wall along the street frontage.
d. All roof noise generation sources onsite shall be attenuated to 55 dBA
at the property line, or to the ambient noise level at the property
line measured at the time of the occupancy request. Prior to the
issuance of a zoning clearance for initial occupancy or any subsequent
tenant occupancy, the Director of Community Development may request
that a noise study be submitted for review and approval which
demonstrates that all onsite noise generation sources would be
mitigated to the required level. The noise study must be prepared by
a licensed acoustical engineer in accordance with accepted engineering
standards.
Reporting and Monitoring:
For mitigation conditions b, c, and d, a revised landscape plan, a wall plan and
a noise study shall be submitted to the Department of Community Development for
review and approval prior to zoning clearance. The Code Enforcement Officer for
the City would be responsible for the monitoring of Condition No. a. Monitoring
will only occur if a complaint is received regarding the hours of operations
which are in violation of that approved by the Planning Commission. The Code
Enforcement Officer will provide written notice of violation as required. If a
second violation notice is required, the owner of the property will be required
to pay a penalty fee equaling double the cost to the City for enforcement
activities beginning with the initial inspection. The City will place a lien on
the property if the fee is not paid and there is continued violation of the
outdoor repair work restriction. The Community Development Department will also
have the option of scheduling a public hearing before the City Council and
requesting revocation of the planned development permit.

2. LIGHT AND GLARE:
Mitigation - Prior to issuance of a Zoning Clearance, a lighting plan shall be
prepared by an electrical engineer registered in the State of California and
submitted to the Department of Community Development for review and approval.
The lighting plan shall achieve the following objectives: Avoid interference
with reasonable use of adjoining properties; minimize onsite and offsite glare;
provide adequate onsite lighting; limit electroliers height to avoid excessive
illumination; and provide structures which are compatible with the total design
of the proposed facility.
The lighting plan shall include the following:
a. A photometiric plan showing a point-by-point foot candle layout to
extend a minimum of twenty (20) feet outside the property lines.
Layout plan to be based on a ten (10) foot grid center.
b. Maximum overall height of fixtures shall be fourteen (14) feet.
c. Fixtures must possess sharp cut-off qualities with a maximum of one
foot candle illumination at property lines.
d. Average maximum of one foot candle illumination.
e: There shall be no more than a seven-to-one (7: 1) ratio of level of
illumination shown (maximum to minimum ratio between light standards).
f. Energy efficient lighting fixtures shall be provided which are
compatible with adjacent properties.
g. No light shall be emitted above the 90 degree or horizontal plane.
Reporting and Monitoring - Prior to issuance of a Zoning Clearance, the
Director of Community development shall review and approve the required
lighting plan. The staff planner shall document this approval in the file.
3. CIRCULATION:
Mitigation:
a. Full improvements and the widening of Los Angeles Avenue which would
be carried out by both the City and the developer.
b. After the City has completed the widening of Los Angeles Avenue, the
applicant shall provide full street improvements (meandering sidewalk,
paving, curb, gutter, tree wells, landscape and irrigation systems)
along Los Angeles Avenue in the State Highway right-of-way.

Reporting and Monitoring:
The applicant shall submit to the City of Moorpark for review and approval,
street improvement plans prepared by a Registered Civil Engineer; shall enter
into an agreement with the City of Moorpark to complete the improvements; and
shall post sufficient surety guaranteeing the construction of the improvements.
Prior to issuance of a zoning clearance, the staff planner shall contact the
City Engineer's Office to determine compliance with this condition and shall
document compliance by placing a note in the project file.
4. HUMAN HEALTH:
Prior to the issuance of a zoning clearance, the proposed installation of the
propane gas station shall be reviewed by the County Fire Department to ensure
that the proposal would comply with all the applicable state and local
regulations related to storage, handling, and placement of propane gas.
The handling of propane shall require a Uniform Fire Code Permit and an
Emergency Hazardous Materials Business Plan must be filed with the Fire
Protection District pursuant to Chapter 6.95 of the California Health and Safety
Code.

DISCUSSION OF ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES

No unstable earth conditions, soil compaction, changes in topography or
geological substructures would result by the proposal because the self storage
facility has already been built pursuant to the County Uniform Building Code
and the proposal does not involve any new construction of building structures
which would generate the impacts mentioned.

Based on the City's Safety Element, no erosional, geologic or seismic hazards
are known to exist on site or in the immediate vicinity. Therefore, no
significant effect is anticipated.
2. a., b., c. , and d. AIR
The proposed project is not expected to result in substantial deterioration of
the ambient air quality because no grading of the site or construction of
buildings would be involved. The anticipated movement of trucks and
recreational vehicles to and from the site would not generate enough air
emissions to degrade the ambient air quality.
3. a. through j. WATER
The proposal would not increase the rate and amount of surface runoff, lower the
infiltration rate, change the drainage patterns or degrade the ground water
quality because the site has already been developed and the buildings have been
constructed in accordance with the relevant County Building/Engineering Codes.
The proposal would not involve any new construction, therefore, no significant
effect is anticipated.
4 & 5 PLANT AND ANIMAL LIFE
The proposed project would not change the diversity and number of plant and
animal species or affect the wild life habitat because the site has already been
developed and is surrounded by industrial and residential developments.
6. 1. NOISE
In general, commercial/industrial noise within the City of Moorpark is not
considered excessive. However, where residential locations are adjacent to
industrial uses, as is true in this case, a significant impact may result. The
impact will be directly related not only to the number of truck movements to
and from the project site but also the time of day at which they occur. The
movement of 9 trucks and 35 recreational vehicles in and out of the site
(although not necessarily at the same time) coupled with the extended hours of
operations and the increased workdays (see Exhibit 6 for work schedules) would
generate noise levels exceeding 65 dBA which is the maximum acceptable noise
level for residential homes.

Mitigation
To mitigate this significant noise impact on the adjoining residential
properties, the applicant is conditioned to reduce the possible hours of
operation to occur between 8:00 a.m. and 8:00 p.m. and to exclude Sunday
operation. In addition, to attenuate noise more effectively, the applicant is
required to replace the existing sparse shrubs and trees by a more dense and
mature landscaping buffer and to replace the existing wrought-iron fence with a
solid masonry decorative wall along the street frontage. In addition, all
noise generation sources onsite shall be attenuated to 55 dBA at the property
line, or to the ambient noise level at the property line measured at the time of
the occupancy or any subsequent tenant occupancy. The Director of Community
Development may request that a noise study be submitted for review and approval
which demonstrates that all onsite noise generation sources would be mitigated
to the required level. The noise study must be prepared by a licensed acoustical
engineer in accordance with accepted engineering standards.
7. LIGHT AND GLARE
The proposal would generate new light or glare on the adjoining residential
neighborhood.
Mitigation
To mitfgate this impact, the applicant is required to shield all lighting onsite
and to design lighting so hat there is no glare or adverse spillover of light on
the adjacent residential homes. The following requirement should be included as
a condition of approval for the project. For all exterior lighting a lighting
plan shall be prepared by an Electrical Engineer registered in the State of
California and submitted to the Department of Community Development for review
and approval. The lighting plan shall achieve the following objectives: Avoid
interference with reasonable use of adjoining properties; minimize onsite and
offsite glare; provide adequate onsite lighting; limit electroliers height to
avoid excessive illumination; and provide structures which are compatible with
the total design of the proposed facility.

8. LAND USE
The proposed project would not encourage the development of presently
undeveloped areas or increase the development intensity in developed areas. The
proposed project is located in an area which is predominantly developed with
industrial and residential properties. All public services and utilities are
currently in place and no expansion to the infrastructure would result from the
project. Therefore, no potential significant impact on land use is anticipated.
9. NATURAL RESOURCES
The proposed project is not expected to result in a significant increase in the
rate of use of any natural resource, or result in substantial depletion of any
nonrenewable resource because the site has already been constructed and the
proposal does not involve any use or renewable or nonrenewable resources.
10. RISK OF UPSET (REFER TO No. 17. a. and b.)
11. POPULATION
The proposed project is not expected to significantly alter the location,
distribution, density, or growth rate of the human population in Moorpark. The
proposal would be for outside storage of trucks and recreational vehicles and
would not involve any residences on site.
12. HOUSING
The proposed project would not result in the displacement of people from the
existing site. The site is currently improved with a self storage facility with
no residences in existence or proposed.
13. a. through f. CIRCULATION
The increased traffic that would be generated by the proposed modifications may
adversely impact on Los Angeles Avenue. However, the full improvements and the
widening of Los Angeles Avenue which would be carried out by both the City and
the developer would reduce this impact to a level of insignificance. The
proposed outdoor storage of 35 recreational vehicles, 6 trucks, and 5 trailers
(though not all at the same time) would completely encroach on the existing 40
parking stalls. Since 39 stalls are required for the site, and the applicant
has provided 40, there is only one extra space remaining for the proposed uses.
The outdoor storage of these trucks and recreational vehicles would therefore
seriously impinge on the parking requirements of the entire site and cannot be
mitigated if the proposed uses are approved.

Mitigation
To minimize traffic circulation onsite, the applicant is required to construct
the existing alleyway (along the south wet portion of the site) to full width
(25 feet).
14. a. through e. PUBLIC SERVICES
The proposed project would not require Additional fire protection or police
protection personnel, and schools are not expected to be affected. Fees related
to fire and police protection and school fees were paid prior to issuance of a
building permit for the existing self storage facility. No further fees are
required for the proposed modifications. The project is not expected to impact
park and recreation facilities.
15. a. and b. ENERGY
The proposal is not expected to use substantial amounts of energy and would not
substantially increase demand upon existing sources of energy or require the
development of new sources of energy. As stated previously, there is an
existing self storage facility on site and no new construction is proposed.
16. a. through g. UTILITIES
The proposed would not create new demand for utilities which are already in
place to serve the existing self storage facility.
17. a. and b. HUMAN HEALTH
The proposed installation of the propane gas filling station would create
potentially safety hazards both onsite and on the adjoining residential
properties.
Mitigation
To minimize these hazards, the applicant is conditioned to meet all the relevant
regulations of the Uniform Fire Code relating to location, setbacks and capacity
of the filling station. The handling of the hazardous gas shall require a
Uniform Fire Code Permit and that an Emergency Hazardous Materials Business
Plan must be filed with the Fire Protection District pursuant to Chapter 6.95 of
the California Health and Safety Code.
18. AESTHETICS/VISUAL IMPACTS
The outdoor storage of vehicles and trucks would be visually disruptive and
aesthetically offensive to public view from both Los Angeles Avenue, and Goldman
Avenue as well as from the adjoining residential homes because of the inadequate
landscape and wall buffers.

Mitigation
To mitigate this visual impact, the applicant is conditioned to construct a 6
foot solid masonry wall along the entire street frontage and to replace the
existing plants with a more dense, and mature landscaping enclosure.
19. RECREATION
The project would not be expected to affect the quality or quantity of existing
recreational opportunities. (Refer to discussion on Item No. 14. Public
Services).
20. a. through c. ARCHAEOLOGICAL/HISTORICAL
There is a very low probability that the site has archaeological or historical
significance due to previous grading activities and existing development onsite.
21. MANDATORY FINDING OF SIGNIFICANCE
a. As identified in the preceding responses, the project is not expected
to significantly degrade the quality of the biological and cultural
environments.
b. Both short term and long term impacts in terms of noise, visual,
traffic, human health, light and glare, may result but are not
expected to be significant if mitigation measures previously
identified are included as conditions of project approval.
c. The proposal is expected to result in cumulative traffic impacts when
considered with other past, present, and future projects in the
vicinity of the site. However, the future widening of Los Angeles
Avenue, and the full street improvements that the applicant is
required as part of the conditions of approval would reduce these
impacts to a level of insignificance.
d. The project would have environmental effects which would cause effects
on human beings either directly or indirectly if the proposed propane
gas filling station is permitted onsite. However, the mitigation
measures which would be adopted as conditions of approval to minimize
the handling, and storage of the hazardous chemical would reduce this
impact to a level of insignificance.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF MOORPARK, CALIFORNIA, RECOMMENDING TO THE
CITY COUNCIL THAT MAJOR MODIFICATION NO. 1
(DEVELOPMENT PERMIT NO. 348) ON THE APPLICATION OF
A TO Z SELF-STORAGE BE DENIED WITHOUT PREJUDICE.
WHEREAS, at a duly noticed public hearing on December 4, 1989, the
Planning Commission considered the application filed by A to Z
Self-Storage requesting approval for the outdoor storage of
recreational vehicles, U-haul trucks and trailers on a 1.4 acre site
located at 5040-5060 Goldman Avenue, approximately 210 feet east of
Goldman Avenue and 40 feet west of Shasta Avenue.
WHEREAS, the Planning Commission reviewed and considered the
information contained in the Staff Report dated December 4, 1989, and
the Mitigated Negative Declaration; and
WHEREAS, at the Planning Commission's meeting of December 4, 1989,
the Commission opened the public hearing, took testimony from all those
wishing to testify, closed the public hearing, and directed staff to
prepare a resolution for the Planning Commission's decision;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission hereby adopts the findings

1. Prior to issuance of a zohing clearance, a Surety Performance Bond in the
amount of $10,000 shall be filed and accepted by the Director of Community
Development. The Director of Community Development, may, through a public
hearing to be heard before the City Council recommend that any or all of
the funds in the Performance Bond be forfeited for noncompliance of the
Conditions of Approval or for some other just cause. This condition shall
automatically be superseded by a related resolution or ordinance regarding
condition compliance for entitlement approvals as adopted by the City
Council.

1. Number of Recreational Vehicles stored shall not exceed 35.
2. Length of stored Vehicles shall not exceed 20 feet and height
shall not exceed standard Recreational Vehicle height of 14 ft.
The turning radius for vehicle movement shall follow the City

4. Propane gas or other similar tanks in standard R.V. shall be
disconnected and shall be secured to ensure no leakage occurs on

permitted for an extended periods except for periodic
maintenance.
6. Recreational Vehicle stored must carry comprehensive Insurance
Coverage in effect during the storage of the Vehicle.

Dear Mr. Maniar:
As stated in a number of letters from this office, and at an office
hearing conducted by the Code Enforcement Officer, the position of this
Department remains the same. If you park, or store, any "U Haul" type -
rental trailers/trucks or recreational vehicles on your property; you
are in violation of your Development Plan Permit No. PD 348.
The U Haul type rental trailer/trucks or recreational vehicles being
stored or parked on your property is not a permitted use, authorized by
Condition 31 on your DP-348. At the office hearing, although you did
not agree with staff's decisions, you did agree to comply. As far as I
am concerned this matter is closed. If violations continues to occur
then this office will have no other alternative but to seek whatever
legal action necessary to obtain compliance. We will also initiate a
request for revocation of your Planned Development Permit.
If you should disagree with my decision it is appealable under Section
9.12.040, as an administrative determination. You have 15 days from the
date of receipt of this letter to appeal. The filing fee is $432.00.
I would also like to remind you that your temporary ground sign (A to Z
Storage) is in violation and must be removed immediately upon receipt of
this letter.

Mr. Mike Thaker:
On February 13, 1989 our Department sent you a letter regarding a
inspection that was conducted of your property, revealing that you were
in violation of the Development Plan Permit No. PD-348, Condition 30 and
31 (see attached Resolution No. 87-127 regarding now outside storage
shall be permitted and no storage of recreational vehicles shall be
permitted.
A field inspection conducted on April 20, 1989 has revealed that you are
still- continuing to store outside storage "U-haul" trailers/trucks, and
the storage of recreational vehicles.
We are requesting your voluntary compliance immediately upon the receipt
of this letter, by removing the recreational vehicle and the U-Haul
trailers/trucks. A field inspection will be conducted by this office,
so as to determine compliance. Should this matter not be resolved we
will have no other alternative but to revoke your Development Plan
Permit No. DP-348.

With respect to your letter of May 3, 1989 we would like to submit
as follows:
1 . We had a meeting with the Director Of Community Development Mr.
Pat Richards on March 17,, 1989 in response to his letter of February
13, 1989.
2. During the meeting we had also discussed his letter matter and
several other items. Mr Richard recommended us to file for a major
modificatit'n to DP-348 conditions to cover the desired items.
Recognizing the monumental task:: of the major modification application,
we had agreed can atleast 8 to 10 weeks of time to prepare for the
same. We are currently working on the package and would like to submit
is as soon as we can.
Mr. Mancino, obviously you were not aware of this and we are sorry
that you had to go through the trouble of reminding us on the subject ,
which we are currently working on. We plan to get together with Mr.
Richards and/or his staff for the final submission of the documents
in the near future.

Dear Mr. Maniar:
As stated in a number of letters from this office, and at an office
hearing conducted by the Code Enforcement Officer, the position of this
Department remains the same. If you park, or store, any "U Haul" type
rental trailers/trucks or recreational vehicles on your property; you
are in violation of your Development Plan Permit No. PD 348.
The U Haul type rental trailer/trucks or recreational vehicles being
stored or parked on your property is not a permitted use, authorized by
Condition 31 on your DP-348. At the office hearing, although you did
not agree with staff's decisions, you did agree to comply. As far as I
am concerned this matter is closed. If violations continues to occur
then this office will have no other alternative but to seek whatever
legal action necessary to obtain compliance. We will also initiate a
request for revocation of your Planned Development Permit.
If you should disagree with my decision it is appealable under Section
9.12.040, as an administrative determination. You have 15 days from the
date of receipt of this letter to appeal. The filing fee is $432.00.
I would also like to remind you that your temporary ground sign (A to Z
Storage) is in violation and must by removed immediately upon receipt of
this letter.

item 4., we would like to continue working as Broker ReferralJfor the
U-Haul .',The broker referral operation would not involve any trucks and
or trailer storage or renting' from our facility .
As we understand 'it , in the referral service all we will do is ,
answer the phone calls and book a vehicle for the customers„ and do
necessary paper work . We will have no trucks or trailers to be picked
up or dropped off- from our storage facility . This will give us an
opportunity to serve the community and stay in touch with both the
community and the U-haul .
We would like to clarify that some customer may bring his or
her U-haul like truck or trailer rented from other facility to load
or unload their belongings. This is not to be confused with our
referral service.
B. MISCELLANEOUS ACTIVITIES :
We request the miscellaneous services be permitted without filing
a Surety Performance Bond . The services to be permitted will include :
1 . Installation of a Public Telephone in each building
2 . Installation of Vending Machines for beverages, snacks, and Candies
etc .
3 . Installation of FAX and Copying Machines
4 . Sale of Packaging Material
The above services are for convenience of our customers and the
rationale for these activities are described in enclosure # D . of our
application , reference 1 above.
C . HOURS OF OPERATION :
Most importantly to serve the community better and to remain
competitive and a viable business, we must remain open on SUNDAYS . For
• the same reasons , we would also like to extend hours of operation ,
seasonally adjusted as follows :
1 . FALL AND WINTER HOURS :
Beginning third Sunday in October through Third Saturday in
February of each year .
• GATE OPERATION :
Monday through Saturday 7 .00 AM to 7 .00 PM.
Sunday 9 .00 Am to 5 .00 PM .
• OFFICE HOURS :
Monday through Saturday 9 .00 AM to 6 .00- PM.
Sunday 11 . 00 AM to 5 .00 PM.
2 . SPRING AND SUMMER HOURS :
Beginning Third Sunday in February through Third Saturday in
October of each year .

We request your permission for allowing us to operate our facility
in accordance with the above hours .
We urge you to allow us to remain open on Sunday because our
business so much depends on our availability on Sundays . During the
first year of operation we have lost lot of business due to this
restriction . e . g . by the end of December 1989 , we should have 60%
occupancy at an average of 5% absorption rate per month . Instead, as
of today , we are only 35% occupied . We know from our marketing effort
that we are losing lot of clienteles due to being closed on Sundays .
In our business , maximum traffic is usually on weekends and
speciaLly on Sundays . You would appreciate the simple fact that in
order to remain a viable business entity , we must have freedom to
remain open Sundays .
We will monitor and endeavor to assure that our Sunday operation
will not disturb our neighbors . We request this be approved without
Surety Bond or any condition. We will act responsibly and will be
sensitive to our neighbors .
To the best of our knowledge, there are self storage facilities in
Orange and Los Angeles Counties , which are located next to residential
areas . These facilities remain open on Sundays .
In summary , we must have Sunday operation available because :
• . Other service business in neighborhood remain open on Sundays
• . In order to remain competitive and viable business , we must
remain open on Sundays, like our competition .
• . Sunday is very convenient day for storage and moving activity
for households .
• . Self storage activity is inherently very quiet , light and
innocent .
• . In excess of 95 % of our units are located inside concrete
buildings which isolate and insulate the outside environment .
Keeping the sensitivity of our neighbors in mind , in conclusion we
are eager to serve the community and provide badly needed service to
the community of Moorpark and we request your support in achieving
this goal . Please keep in mind that our request would not compromise
existing conditions of DP-348 . For us, SUNDAY OPERATION is absolutely
necessary , to remain a viable business entity without compromising the
intent of DP-348 conditions .
