WOZNIAK Counalmember Nmod on Rwyr 0 Pape' MINUTES OF THE CITY COUNCIL Moorpark, California May 17, 1993 A Special Joint Meeting of the City Council and Planning Commission of the City of Moorpark was held on May 17, 1993 in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the City Council to order at 7:12 p.m. Chairman Wesner called the Planning Commission to order at 7:12 p.m. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Lillian Hare. 3. ROLL CALL: Present: Staff Present: 4. ACTION /DISCUSSION: A. Councilmembers Hunter, Montgomery, Perez, Wozniak and Mayor Lawrason Commissioners Brodsky, May, Miller, Torres and Chairman Wesner Steven Kueny, City Manager; Jim Aguilera, Director of Community Development; and Lillian Hare, City Clerk Mayor Lawrason indicated that the Council had previously determined to hold a joint. meeting with the Planning Commission every year. He stated that communication was very important and that the: Council was moving towards the Planning Commission taking more responsibility. Councilmember Wozniak indicated that he believed that communication was ninety -nine percent of the Planning Commission's job. He said he believed there had been significant progress in communication and that the concerns and comments of the Planning Commission were being conveyed to the City Council. He said he credited Mr. Aguilera with this improvement. He said that changes to a report after coming from the Planning Commission are now out of the ordinary. He said he would like to thank the Commission for the hours of 'work they expend on the City's behalf. Minutes of the City Council Moorpark, California May 17, 1993 chairman Wesner said he would like to "echo" the sentiments of Mayor Lawrason and Councilmember Wozniak. He thanked both the City Manager and Mr. Aguilera for the job staff is doing in relating information back to the Council from the Planning Commission. He said, however, he would like the Council to "pick up the phone" more often and call Planning Commissioners. He also asked how each of the Councilmembers analyze Planning Commission recommendations. Commissioner Brodsky said he believes staff has done an excellent job in communicating from the Planning Commission to the Council. He said the Planning Commission appreciates direction from the Council. He said there were examples of certain matters that did not come to the Planning Commission and that the Planning Commission didn't hear about until presented to the City Council; for example, the distance change for the proposed adult facilities ordinance, and the drainage problem with the McDonald's project related to Caltrans. Mr. Kueny explained the background on Caltrans' concerns regarding McDonald's project drainage and indicated that there was nothing that the Planning Commission could have done differently regarding this issue. Councilmember Perez indicated that. relative to the adult facilities ordinance the Community Development Committee considered the same 500 foot distance recommended by the Planning Commission and that revision to this distance occurred during Council discussions. He said it was a policy issue. He said as far as the analysis done by the Council relative to Planning Commission recommendations, consistency in decisions was important and conformity to the goals and policies that the City already has in place. He also said that sometimes applicants bring forward additional information to the Council that wasn't presented to the Planning Commission. He indicated that applicants who do so are to be sent back to the Planning Commission. Chairman Wesner thanked the Council for sending applicants back when additional information needed to be provided. He said this lets applicants know that the Planning Commission has the responsibility for the "nuts and bolts" review. Minutes of the City Council Moorpark, California May 17, 1993 Commissioner Miller indicated that the developers did not always give the Planning Commission the "full ball of wax ". He indicated his desire and hope that the Council would send these developers back to the Planning Commission. Commissioner May said she was more comfortable with the new Director, that information was being transferred from the Planning Commission to the City Council. She said often it was true that more public comment was made at the City Council level, but that was just a part of the process and did not bother her. Commissioner Torres said he felt confident that things have improved 100 percent. He asked whether the Council would be interested having a Commissioner present at all City Council meetings to answer questions. He said the Commission was feeling more useful and had a more definite purpose. Chairman Wesner said the Planning Commission feels like the technical reviewing body. Councilmember Perez said it might be helpful to have a Planning Commissioner present at a City Council meeting on an item that had generated great public interest. Councilmember Wozniak indicated that when the Planning Commission felt strongly about an item that it was within their right to make a presentation at the City Council meeting and that that had been done in the past. He questioned the Commission as to whether or not it was a stumbling block to them not having the City Attorney present at their meetings. Chairman Wesner replied that they needed an expansion of the City Attorney involvement on some very sensitive issues such as the Adult Entertainment Facilities Ordinance. He said the Commission needed to know their "boundaries ". He said more background information from the City Attorney would be helpful. Mayor Lawrason explained that he had some concerns in creating undue influence on Commissioners by calling them and discussing a certain issues. He indicated that he wanted Commissioners to feel free to formulate their own recommendations. Councilmember Wozniak concurred with the Mayor. Minutes of the City Council Moorpark, California May 17, 1993 Mr. Kueny said staff can include the Planning Commission on the distribution for the monthly staff report to the City Council. He also said it would be beneficial for the Planning Commission and the City Council to meet in joint meetings on specific plans and for a tour of the Carlsberg property. Commissioner Torres said he believes the Council and the Commission were heading in the right direction in the streamlining process and said he would appreciate the Council letting applicants know that their project will be delayed if they don't give the Planning Commission all the information needed. MOTION: Councilmember Perez moved and Councilmember Montgomery seconded to adjourn the City Council. The motion carried by unanimous voice vote.
