BACKGROUND /DISCUSSION
Conditional Use Permit No. 706 for a concrete batch plant at 13950 Princeton Avenue
(formerly Los Angeles Avenue) was originally issued to Valleywide Ready Mixed Concrete
Corporation on January 21, 1958 by the County of Ventura Board of Supervisors. This
permit was transferred to Conejo Ready -Mixed Concrete, Inc. in 1973. Time extensions for
the use were approved by the County in 1961, 1964, 1967 and 1981. In 1981, the Permit
was extended through May 21, 1991. At the direction of the City Council, Minor
Modification No. 4 was approved by the Community Development Director on April 13,
1992 for a ten -year time extension through May 21, 2001. The applicant submitted an
application for Minor Modification No. 5 to CUP 705 on November 22, 2000 to extend the
expiration date of the use consistent with the Community Development Department's
practice at that time. This practice ceased in 2002 and the applicant applied for a new
Conditional Use Permit. On May 2, 2008 the applicant amended the request to include
permanent stockpiling and crushing of unused hardened concrete that can be used for
road base, or re -mixed into new concrete.
The applicant is unavailable for this meeting and has requested that this public hearing be
continued to the next available Planning Commission meeting. Since staff is
recommending cancellation of the Planning Commission meeting on July 28, 2009, the
next available meeting would be August 25, 2009.

SUBJECT: Consider Zoning Ordinance Amendment No. 2009 -01 — Amending in
Moorpark Municipal Code Section 17.32.025: High Street Area
Requirements, to Amend the Parking Percentage Required and
Revise Parking Standards for Eating and Drinking Places
DISCUSSION
In June 2007, the City Council amended and updated the City's Parking Ordinance in its
entirety. Since that time the amended ordinance has worked well with the exception of
the High Street area. While the Council's amendments to the parking ordinance
reduced the required parking in the High Street area to fifty percent (50 %) if an in -lieu
fee was paid, the cost of the in -lieu fee has discouraged any "buy- downs" of parking to
the 50% standard. Additionally, parking for eating and drinking places is substantially
higher than for retail sales and service places making it very difficult to attract new
eating and drinking places in the High Street area or to see expansions of those eating
and drinking places that are already on High Street.
This proposed amendment reduces the parking standard in the High Street area from
seventy -five percent (75 %) of the required parking to fifty percent (50 %) and makes the
required parking for eating and drinking places in the High Street area the same as
those for retail shops and services. The current citywide parking requirement for eating
and drinking places is one parking space per 100 square feet of floor area. The current
citywide parking requirement for retail shops and services is one space per 300 square
feet of floor area. Given the availability of street parking and public parking lots, an
effective standard for the High Street area of one space per 600 square feet of retail
shops and restaurants would provide sufficient off - street parking and allow for the
downtown to develop with a flexible mix of restaurants and retail uses. It should be
noted that any reduction in parking below the citywide standard would require parking
areas to be unreserved and available for all visitors to downtown. The attachment to
the resolution shows the changes in legislative format.

ENVIRONMENTAL DETERMINATION
In acccrdance with the city's environmental review procedures adopted by resolution,
the Planning Director determines the level of review necessary for a project to comply
with the California Environmental Quality Act (CEQA). Some projects may be exempt
from review based upon a specific category listed in CEQA. Other projects may be
exempt under a general rule that environmental review is not necessary where it can be
determined that there would be no possibility of significant effect upon the environment.
A project which does not qualify for an exemption requires the preparation of an Initial
Study to assess the level of potential environmental impacts.
The Director has reviewed this project and found it to qualify for a General Rule
Exemption in accordance with Section 15061 of California Code of Regulations (CEQA
Guidelines). No further environmental documentation is required.
STAFF RECOMMENDATION
Open the public hearing, accept public testimony and close the public hearing.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF ZONING ORDINANCE AMENDMENT NO. 2009 -01,
AMENDING SECTION 17.32.025 HIGH STREET AREA PARKING
REQUIREMENTS OF CHAPTER 17.32 OFF- STREET PARKING
REQUIREMENTS OF TITLE 17 (ZONING) OF THE MOORPARK
MUNICIPAL CODE
WHEREAS, at its meeting of June 23, 2009, the Planning Commission
conducted a duly- noticed public hearing on Zoning Ordinance Amendment No. 2009-
01, amending Section 17.32.025 High Street area parking requirements of Chapter
17.32 Off - street Parking of Title 17 (Zoning) of the Moorpark Municipal Code, received
public testimony on the proposed amendments, and after receiving oral and written
public testimony, closed the public hearing and reached a decision; and
WHEREAS, the Planning Commission concurs with the Planning Director's
determination that this project is exempt from the provisions of the California
Environmental Quality Act by the general rule that CEQA only applies to projects that
may have a significant effect on the environment.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. GENERAL PLAN AND SPECIFIC PLAN CONSISTENCY: The
Planning Commission finds Zoning Ordinance Amendment No. 2009 -02 to be
consistent with the City of Moorpark General Plan and all adopted Specific Plans.
SECTION 2. RECOMMENDATION: The Planning Commission recommends
to the City Council approval of Zoning Ordinance Amendment No. 2009 -02, to amend
Section 17.32.025 High Street area parking requirements of Chapter 17.32 Off - street
Parking of Title 17 (Zoning) of the Moorpark Municipal Code as recommended by staff
and shown in Exhibit A, attached.
SECTION 3. CERTIFICATION OF ADOPTION: The Planning Director shall
certify to the adoption of this resolution and shall cause a cause a certified resolution to
be filed in the book of original resolutions.

A. Commercial development on High Street is unique within the city
and its parking must be addressed in a manner different than parking for other
commercial development. The Downtown Specific Plan establishes standards
for development which are unique to the downtown and High Street in particular.
Parking in the High Street area (from Moorpark Avenue on the west to Spring
Road on the east and Walnut Street from High Street to Charles Street) must
meet seventy five fi_j[ (7 -550 %) percent of the required parking pursuant to
Section 17.32.010 of this chapter. In addition, eating and drinking places in the
High Street area shall have the same required parking as retail shops and
services in the High Street area. In -lieu of meeting the required parking, the
applicant may pay a fee to reduce the required on -site parking to fifty forty
(5040 %) percent of the required parking pursuant to Section 17.32.020. The city
council shall establish the fee by resolution to be used to offset a portion of the
cost required to construct public parking facilities in the downtown area.
B. Driveways installed on High Street must provide reciprocal
vehicular access to the parking area. All parking spaces provided above the
seveRty five fifty (7--550 %) percent standard may be designated as reserved
parking. Reserved spaces become reciprocal a#er between 6:00 p.m. and 2:00
a.m. so that those spaces are available for off -peak parking. Reserved parking
signs must include the time restrictions. All signing must be in conformance with
Chapter 17.40 Sign Regulations. Reciprocal parking spaces are required in
accordance with the following table.

For example, if Section 17.32.020 requires one - hundred (100) parking spaces

BACKGROUND
On May 4, 2009 the Area Housing Authority of Ventura County submitted an
application for a Residential Planned Development Permit for a two -story, twenty
unit apartment building with underground parking, on approximately 0.9 acres,
located at 396 — 436 Charles Street. The site is currently owned by the Moorpark
Redevelopment Agency. The project also requires a Disposition and Development
Agreement with the Moorpark Redevelopment Agency and a Housing Agreement
with the City.
DISCUSSION
Project Setting
Existing Site Conditions:
The approximately 0.9 acre site currently consists of three adjacent lots which are
currently unimproved. The site is located on the south side of Charles Avenue, east
of Magnolia Street and west of Spring Road. The site slopes generally from the
northeast corner to the southwest corner.

Previous Applications:
On May 12, 2006, Efrain Lopez and Victor Llamas submitted an application for
Residential Planned Development Permit No. 2006 -01, to build four (4)
condominiums (two buildings with two units each) on 436 Charles Street. The
application was deemed incomplete and the property was subsequently purchased
by Toll Brothers, along with 396 Charles Street and deeded to the City of Moorpark
to partially meet their affordability requirements for Tract No. 5463.

General Plan and Zoning Consistency:
Multiple Family Residential development is consistent with the High Density
Residential General Plan land use designation and the Residential Planned
Development (RPD) zoning designation of the site.
The property is zoned Residential Planned Development (7 -14 dwelling units per
acre). Although this project exceeds the maximum allowable density by
appi,oximately 59 percent, this exception would be permitted through the use of
Density Bonus allowances for affordable housing, as permitted by State law and
Title 17.64 of the Moorpark Municipal Code under the density bonus General Plan

and Downtown Specific Plan amendments adopted by the City Council on June 17,
2009, and the density bonus Zoning Ordinance amendment introduced by the City
Council on June 17,2009 and scheduled for second reading and adoption on July 1,
2009. This issue is discussed in the Analysis section below.
Project Summary
Residential Planned Development Permit No. 2009 -01:
The twenty unit rental apartment building consists of fourteen 2- bedroom units and
six 3- bedroom units with six different floor plans. Each unit includes one bathroom
and a private balcony or deck ranging from 89 to 128 square feet. Additionally,
each unit includes an assigned private storage cabinet inside of a semi -
subterranean garage. All of the units would be affordable to and rented by very-low
and low- income households.
The project includes a number of common amenities, including an outdoor roof
deck, a ground level courtyard, a community room, a computer lab, a common
laundry room, and an office for an on -site manager.
An elevator provides access from the semi - subterranean garage to the first and
second floors.
Proposed Project
Arch itectu re:
The proposed architecture is of a "Craftsman" style, with a combination of exterior
cement plaster and fiber cement siding. Fiber cement shingles, and cultured stone
veneer accent the building. The main colors of the buildings are a combination of
beige /tan, mustard /gold, green /sage and accent colors in a range from off -white to
brown. The roof material consists of architectural quality asphalt shingles. The
style, colors, and materials are consistent with the surrounding area, and with the
requirements of the Downtown Specific Plan.
The City requires that affordable housing units provided by a density bonus and
developed in conjunction with a market -rate housing development must be of similar
design and quality as the market -rate units. Exteriors and floor plans of affordable
units must be similar in colors and materials to the market -rate units. Although this
project is not developed in conjunction with a market -rate housing development, the
interior and exterior design is indistinguishable from a comparable market -rate
development.
Setbacks:
The Downtown Specific Plan and the Zoning Code call for the Residential Planned
Development zone to provide a flexible regulatory zone to encourage creative and
innovative design and to act as a transition between Single Family Residential and
the Old Town Commercial Buildings. As such, there are no specific setback

requirements for this zone. Building design in a Residential Planned Development
is "form based ", meaning that building design should address the relationship
between building facades and the public realm, the form and mass of buildings in
relation to one another, and the scale and types of streets and blocks.
This building has been designed to be consistent with the setbacks and building
separations that are typically found in this neighborhood. A 32 -foot front setback is
provided, giving the building appropriate scale in relation to Charles Street. A 22-
foot rear setback is provided to give appropriate separation from the commercial
area on High Street.
In addition to appropriate setbacks, the building has been designed with "four- sided"
architecture and appropriate articulation on all sides.
Circulation:
There is one driveway entrance to the project that leads to the surface parking and
semi- subterranean garage. A "hammerhead" is provided at the south end of the
surface parking area to allow easier turnaround of larger vehicles. The semi -
subterranean parking area as proposed is unsecured. Staff thinks that this is not
appropriate, as there are many opportunities for safety and security problems in
enclosed garages. A condition of approval has been added that requires all large
openings to be secured, and a remote operated gate be provided at the entrance to
the garage. This will not interfere with circulation if appropriately designed.

This project does not meet the full parking requirements per the City's parking
ordinance. A deficit of five (5) parking spaces (ten (10) percent of the required
spaces) has been proposed. A reduction of required parking can be granted by the
City Council for affordable housing. This issue is discussed in detail in the Analysis
section of this report.
Landscaping:
The landscaping plan provides for three distinct landscaped areas. The perimeter
landscaping includes many medium to large evergreen and deciduous trees within a
"riparian" type setting. This includes a dry "streambed" that functions as surface
drainage. To further emphasize this concept a pedestrian bridge extends from the
sidewalk to the entry courtyard. The entry courtyard is mostly hardscape, but
provides benches and low- maintenance landscaping within a shady common area.

The final landscaped area is the roof deck, which is a sunny common area with
several potted flowering plants. The entire landscape concept is generally low -
maintenance and low -water usage.
Site Improvements and National Pollution Discharge Elimination Standards
Requirements (NPDES):
The City Engineer has conditioned the project to provide for all necessary on -site
and off -site storm drain improvements including the imposition of National Pollution
Discharge Elimination System (NPDES) requirements. "Passive" Best Management
Practices Drainage Facilities are required to be provided so that surface flows are
intercepted and treated on the surface over biofilters (grassy swales), infiltration
areas and other similar solutions.
Air Quality:
According to the 2000 Ventura County Air Quality Assessment Guidelines, the
proposed project will produce less than the allowable 25 pound threshold of NOX,
providing a conclusion that there will be an impact on regional air quality. As is
required with all commercial /industrial projects, staff incorporates a standard
condition requiring a contribution to the Moorpark Traffic Systems Management
Fund to off -set air pollutants, consistent with the 2000 Ventura County Air Quality
Assessment Guidelines.
ANALYSIS
Issues
Staff analysis of the proposed project has identified the following areas for Planning
Commission consideration in their recommendation to the City Council:

• Parkin
Density:
The Downtown Specific Plan allows for increased density, up to fourteen (14)
dwelling units per acre when lots are consolidated. Lot consolidation allows for
gre&ter flexibility in site design, potential for reduction in the number of driveways
serving the consolidated property and opportunities to more quickly improve a
neighborhood. In this case, three lots have been consolidated to create one site of
37,000 square feet in order to qualify for the maximum density allowed by the
Downtown Specific Plan
As proposed, this project exceeds the maximum allowable density of fourteen (14)
dwelling units per acre by approximately fifty three (53) percent. This exception is
permitted through the use of Density Bonus allowances for affordable housing, as
permitted by State law.

On June 17, 2009, the City Council introduced Ordinance No. 376 which amends
Section 17.64 addressing density bonuses and incentives for provision of affordable
housing. This ordinance allows a density bonus up to a maximum of one hundred
percent (100 %) greater than the density allowed by the existing zoning of a housing
development when one hundred percent (100 %) of the units in a housing
development are restricted to be affordable to low and very low income households.
Under the current maximum allowable zoning, up to 13 dwelling units could
potentially be built. The density bonus would allow up to 26 dwelling units.
Parking:
Due to the topography of the site, it was not possible to design a semi - subterranean
garage that could accommodate the required number of parking spaces. The
density bonus provisions allow for additional concessions and /or incentives which
result in identifiable cost reductions, in addition to merely increasing residential
density. The only development concession that the developer has requested is a
ten (10) percent reduction in the number of required parking spaces, for a total
reduction of five (5) parking spaces. This reduction is appropriate for a housing
project of this nature. It can be anticipated that many of these households will not
own more than one vehicle. In addition, the project is located close to shopping and
public transit, reducing the need to drive. Finally, the frontage on Charles Street
has an ample amount of on- street parking available. These factors in combination
demonstrate that the project has sufficient off - street parking.
Findings
A. The site design, including structure location, size, height, setbacks, massing,
scale, architectural style and colors, and landscaping, is consistent with the
provisions of the general plan, the downtown specific plan, the zoning
ordinance, and any other applicable regulations in that the building has been
designed to be architecturally consistent with the requirements of the City of
Moorpark Downtown Specific Plan which stipulates that new buildings must
architecturally compatible with existing surrounding buildings and the
character of the Downtown Specific Plan area ; and, the project has been
designed and conditioned to be consistent with all required safety codes,
including the California Building Code and City of Moorpark Zoning
Ordinance.
B. The site design would not create negative impacts on or impair the utility of
properties, structures or uses in the surrounding area in that the project has
been designed to meet appropriate setback, parking, and design
requirements.

the low end of the range the approving authority shall make all of the following
additional findings:

opportunities for all economic segments of the community. This project
provides twenty housing units restricted for lower income households. The
density of this project is consistent with Chapter 5.1 of the Land Use Element
of the General Plan, which states that "The City Council may approve a
density bonus over the otherwise maximum residential density, consistent
with the State Density Bonus Law (Section 65915 et seq. of the California
Government Code) and any density bonus provisions contained in the City
Municipal Code."
B. The project is consistent with the City's Zoning Ordinance and the
development requirements and design standards of the Downtown Specific
Plan in that the building has been designed to be architecturally consistent
with the requirements of the City of Moorpark Downtown Specific Plan which
stipulates that new buildings must architecturally compatible with existing
surrounding buildings and the character of the Downtown Specific Plan area.
C. The project is compatible with existing and planned surrounding land use
and development in that the building has been designed to be architecturally
consistent with the surrounding residential properties in scale, colors, and
materials; and conditioned to be consistent with all required safety codes,
including the California Building Code and City of Moorpark Zoning
Ordinance.
D. The project is superior to a lower density design in that the increased density
affords the ability develop the steep lot in a manner that provides additional
housing opportunities that meet the overall development standards of the
surrounding area, provides a superior architectural product, and provides
adequate parking and recreational facilities.

PROCESSING TIME LIMITS
Time limits have been established for the processing of development projects under the
Permit Streamlining Act (Government Code Title 7, Division 1, Chapter 4.5), the
Subdivision Map Act (Government Code Title 7, Division 2), and the California
Environmental Quality Act Statutes and Guidelines (Public Resources Code Division 13,
and California Code of Regulations, Title 14, Chapter 3). Under the applicable provisions
of these regulations, the following timelines have been established for action on this
project:

ENVIRONMENTAL DETERMINATION
In accordance with the City's environmental review procedures adopted by resolution, the
Planning Director determines the level of review necessary for a project to comply with the
California Environmental Quality Act (CEQA). Some projects may be exempt from review
based upon a specific category listed in CEQA. Other projects may be exempt under a
general rule that environmental review is not necessary where it can be determined that
there would be no possibility of significant effect upon the environment. A project which
does not qualify for an exemption requires the preparation of an Initial Study to assess the
level of potential environmental impacts.
Based upon the results of an Initial Study, the Director may determine that a project will not
have a significant effect upon the environment. In such a case, a Notice of Intent to Adopt
a Negative Declaration or a Mitigated Negative Declaration is prepared. For many projects,
a Negative Declaration or Mitigated Negative Declaration will prove to be sufficient
environmental documentation. If the Director determines that a project has the potential for
significant adverse impacts and adequate mitigation can not be readily identified, an
Environmental Impact Report (EIR) is prepared.
The Director has reviewed this project and found it to be Categorically Exempt in
accordance with Section 15332 (Class 32, Infill Projects) of the California Code of
Regulations (CEQA Guidelines). No further environmental documentation is required.

Open the public hearing, accept public testimony and close the public hearing.

STANDARD AND SPECIAL CONDITIONS OF APPROVAL
FOR RESIDENTIAL PLANNED DEVELOPMENT 2009 -01
STANDARD CONDITION OF APPROVAL
The applicant shall comply with Standard Conditions of Approval for Planned
Development Permits as adopted by City Council Resolution No. 2009 -2799 (Exhibit A),
except as modified by the following Special Conditions of Approval. In the event of
conflict between a Standard and Special Condition of Approval, the Special Condition
shall apply.
SPECIAL CONDITIONS
1. This planned development permit will expire two (2) years from the date of its
approval unless the use has been inaugurated by issuance of a building permit
for construction. The Community Development Director may, at his /her
discretion, grant up to two (2) additional one -year extensions for use inauguration
of the development permit, if there have been no changes in the adjacent areas
and if the applicant can document that he /she has diligently worked towards use
inauguration during the initial period of time. The request for extension of this
planned development permit shall be made in writing, at least thirty (30) days
prior to the expiration date of the permit and shall be accompanied by applicable
entitlement processing deposits.
2. Prior to issuance of a building permit for this project, a housing agreement
consistent with Chapter 17.64 of the Zoning Ordinance in a form acceptable to
the City Council is required as part of the granting of a density bonus.
Affordability shall be maintained for the life of the project.
3. An automatic security gate is required at the entrance to the subterranean
garage. A minimum clear open width of fifteen (15') feet in each direction must
be provided for separate entry /exit gates and a minimum twenty feet (20') for
combined entry /exit gates. A Knox Box system must be installed or an EKey
system, subject to the approval of the Community Development Director and the
City Engineer. The method of gate control, including operation during power
failure, is subject to review by the Fire Protection District. Gate plan details must
be submitted to the Fire Protection District for approval prior to installation. A final
acceptance inspection by the Fire Protection District is required prior to placing
any gate into service.
4. The openings and ventilation on the subterranean garage must be designed such
that a person can not enter or exit except through proper accesses. Such design
can include decorative bars, or other methods, subject to the review and
approval of the Planning Director.

5. Adequate interior security lighting must be provided within the subterranean
garage. Such lighting shall be subject to the review of the City's Lighting
Consultant and approval of the Planning Director and Police Chief.
6. Full accessibility must be provided to the upper outdoor deck, subject to the
satisfaction of the Building Official.
7. The elevator must be designed to accommodate a gurney or stretcher, consistent
with Chapter 30 of The California Building Code (Elevators and Conveying
Systems)
8. Storage units must be assigned to the individual apartment units or reserved for
guests in a manner to the satisfaction of the Planning Director.
9. Parking spaces must be assigned to the individual apartment units or reserved
for guests in a manner to the satisfaction of the Planning Director.
10. Parking spaces must be maintained to be accessible for parking operable
vehicles at all times.
11. Roof appurtenances are limited to necessary vents, and must be the same color
as the roofing material and must be to the satisfaction of the Planning Director.
12. Downspouts must either be internal (not visible from the exterior of the building),
or of an architectural design that complements the overall design of the buildings
to the satisfaction of the Planning Director.
13. All windows on the apartment building must have decorative trim. Window
surrounds adjacent to accessible areas must be constructed out of durable
materials and may not have foam cores to the satisfaction of the Planning
Director.
14. Window design must be consistent with the plans as submitted. Any mullions
must be external.
15. All ground mounted utility boxes must be screened with landscaping and all gas,
electric, and water meters must also be screened to the degree allowable by the
utility companies, to the satisfaction of the Planning Director. The Planning
Director may require that the meters and /or boxes be painted to match the
exterior color of the building.
16. Any required railing at the top of slopes or retaining walls must be decorative,
with detailed plans to be submitted for review and approval of the Planning
Director prior to issuance of building permits.
17. Storage on the balconies, except for that which is integral to the design of the
unit, is prohibited and to be enforced by the apartment manager.
18. Native trees, including but not limited to sycamores and other native trees, must
be incorporated into the landscape plan, especially along the trail. None of the
prohibited plants indicated in the Provisionally Acceptable Plant List and the

19. All requirements of the Disposition and Development Agreement shall apply. If

20. Prior to the issuance of a building permit a Lot Line Adjustment shall be
submitted to and approved by the City of Moorpark merging the three existing

BACKGROUND
On August 8, 2008, Todd Manner (Fiedler Group) for the Moorpark Redevelopment
Agency submitted an application for Conditional Use Permit No. 2008 -05 and Industrial
Planned Development No. 2008 -01, a request to construct a new commercial fueling
facility consisting of one (1) building and two (2) canopies on the south side of Princeton
Avenue, just east of the SR -118 freeway overpass. The Planning Director has determined
that the mass of the canopies proposed at 2,410 square feet along with the proposed
building exceed the 2,500 square foot limitation and require a planned development permit
instead of an Administrative Permit. This fueling station would replace the existing Pacific
Pride fueling station on High Street to allow for future redevelopment of the site.
DISCUSSION
Project Setting
Existing Site Conditions:
The entire site is 98,224 square feet in area. Approximately 34,800 square feet of the site
is within the Arroyo Simi floodway, and is not buildable. The Arroyo Simi floodway is
managed by the Ventura County Watershed Protection District, however, no easement
currently exists on the site for flood control purposes. Site design issues related to flood
control are discussed in the analysis section below.
The irregular shaped site is otherwise relatively flat and is slightly below the grade of
Princeton Avenue.

with four (4) gas pumps, one canopy with five (5) gas pumps, a trash enclosure, an
equipment enclosure, a generator enclosure, and two (2) underground storage tanks.
Proposed Project
Architecture /Building Design:
The proposed building and canopies are of a contemporary style, and are proposed to be
constructed of conventional on -site construction. The main building is proposed to be
finished with exterior stucco and includes a clay tile roof. The canopies and accessory
structures will also be roofed with clay tile. The structures are designed to be
architecturally compatible with the adjacent residential uses to the east. The proposed
colors are generally neutral earth tones.
The roof height for the proposed office building is thirteen (13) feet, six (6) inches. This
height is consistent with the height and scale of nearby homes. The proposed canopies
are 19 feet in height. This height allows for the clearance of large trucks under the
canopies. The height of these structures is below the maximum allowable height of forty
(40) feet allowed in the M -2 Zone.

Setbacks:
The building and canopies comply with the required front setback of thirty (30) feet. Interior
setbacks for commercial buildings adjacent to residential properties are set by the
Industrial Planned Development permit. In this case, the applicant is proposing a seven (7)
foot setback from the small office building. This proposed setback is appropriate due to
the mass of the building, and additionally, the building will provide a buffer between the
residence and the gas pumps /canopies.
Circulation:
Access to and from the site is provided from Princeton Avenue, with one entrance -only
driveway and one exit -only driveway. On site circulation has been designed to
accommodate the turning radius of large commercial vehicles.

As depicted on the above table, the available parking provided meets ordinance
requirements of one space per pump island plus 1 space per 300 sq. ft. of office. If
necessary, there is sufficient area to accommodate additional parking spaces without
redesigning the site. Prior to issuance of a building permit, Building and Safety will review
the construction drawings for compliance with Americans with Disabilities Act (ADA)
requirements for parking and access.
Landscaping:
This project proposes on -site parkway landscaping along Princeton Avenue and internal
parking lot and boundary landscaping. The applicant has shown conceptual plant types in
appropriate areas. Plants that are on the City's invasive plant list will not be approved for
this site, given its proximity to the Arroyo Simi. There are several areas on site that are
proposed to be paved, but serve no functional purpose to the service station. These areas,
generally in the southwest and southeast corners of the site should instead be landscaped
with low- maintenance plantings and trees. This would provide for additional pervious area
on the site, improving drainage and reducing site discharge. This is further discussed in
the analysis section below.

A Mature Tree Report has been prepared for the project. The overall site contains eight (8)
trees, two (2) of which are within the development area, and one (1) of which is not large
enough to be designated as a mature tree. The two trees within the development area
include a Eucalyptus tree and a California Pepper tree. The valuation of these trees is
$7,720.00. The Municipal Code requires that, where trees are proposed for removal that
are associated with a proposal for urban development, an appraisal of the value of said
trees is to be prepared and the resulting value shall be applied to upgrading the size of tree
plantings associated with the project.
A condition of approval has been added to this effect.
Site Improvements and National Pollution Discharge Elimination Standards Reguuirements
NPDES :
The City Engineer has conditioned the project to provide for all necessary on -site and off -
site storm drain improvements including the imposition of National Pollution Discharge
Elimination System (NPDES) requirements. "Passive" Best Management Practices
Drainage Facilities are required to be provided so that surface flows are intercepted and
treated on the surface over biofilters (grassy swales), infiltration areas and other similar
solutions.
The applicant has proposed an underground retention basin. The City has typically
discouraged this type of system on new development projects due to long -term
maintenance concerns. This is discussed further in the analysis section below.
Air Quality:
According to the 2000 Ventura County Air Quality Assessment Guidelines, the proposed
project will produce less than the allowable 25 pound threshold of NOX, providing a
conclusion that there will be an impact on regional air quality. As is required with all
commercial /industrial projects, staff incorporates a standard condition requiring a
contribution to the Moorpark Traffic Systems Management Fund to off -set air pollutants,
consistent with the 2000 Ventura County Air Quality Assessment Guidelines.
ANALYSIS
Issues
Staff analysis of the proposed project has identified the following issue for Planning
Commission consideration in their recommendation to the City Council:
• Floodway, Drainage, and Landscaping
The floodway, drainage, and landscaping issues related to this project are interconnected.
As mentioned above, the southern portion of the site is within the Arroyo Simi floodway. To
ensure continuity of maintenance of this floodway, an irrevocable offer of dedication to the
Ventura County Watershed Protection District (VCWPD) in a form to the satisfaction of the

City is recommended. The dedication substantially affects the shape and size of the area
available for development. The remaining developable area of the site is not currently
within the 100 -year floodplain. Due to the adjacency to the Arroyo Simi, drainage from the
site is of concern. The applicant has proposed an underground retention system topped
with asphaltic paving. This type of solution is typically used in very large paved areas such
as mall parking lots, and in urban infill environments, where there are few options for
passive surface solutions. In this case, there are several areas on site that are proposed to
be paved, but serve no functional purpose to the service station. These areas, generally in
the southwest and southeast corners of the site, can be redesigned to provide passive
water retention for water quality, with landscaping consisting of low- maintenance plantings
and trees. This would provide for additional pervious area on the site, improving drainage
while clarifying and reducing site discharge. Conditions of approval have been added to
the project redesign the drainage and landscaping on site.
Findings
Planned Development Findings:
1. The site design, including structure location, size, height, setbacks, massing,
scale, architectural style and colors, and landscaping, is consistent with the provisions of
the general plan, any applicable specific plans, zoning ordinance, and any other applicable
regulations in that all applicable standards of these regulations would be met by the
proposed development and the design of the buildings;
2. The site design would not create negative impacts on or impair the utility of
properties, structures or uses in the surrounding area in that the proposed uses are
compatible with surrounding land uses and the circulation system provides for logical
connections with Princeton Avenue; and
3. The proposed use is compatible with existing and permitted uses in the
surrounding area in that the zoning anticipates this type of development and it is consistent
with criteria specified in applicable City Codes.
Conditional Use Permit Findings:
1. The proposed use is consistent with the provisions of the general plan,
zoning ordinance, and any other applicable regulations in that it furthers Goal 10 of the
Land Use Element of the General Plan as follows: "Goal 10: Provide for a variety of
industrial uses which are located and designed in a compatible manner with surrounding
land uses ";
2. The proposed use is compatible with both existing and permitted land uses in
the surrounding area in that the property is properly zoned and the buildings have been
designed to minimize any new impacts on the surrounding area ;

neighboring property or uses in that the canopies and building have been sited to mitigate
impacts on the residential uses to the east; and
5. The proposed use would not be detrimental to the public health, safety,
convenience, or welfare in that the canopies and building have been sited to mitigate
impacts on the residential uses to the east, the Arroyo Simi, and Princeton Avenue.
PROCESSING TIME LIMITS
Time limits have been established for the processing of development projects under the
Permit Streamlining Act (Government Code Title 7, Division 1, Chapter 4.5), the
Subdivision Map Act (Government Code Title 7, Division 2), and the California
Environmental Quality Act Statutes and Guidelines (Public Resources Code Division 13,
and California Code of Regulations, Title 14, Chapter 3). Under the applicable provisions
of these regulations, the following timelines have been established for action on this
project:

Upon agreement by the City and Applicant, one 90 -day extension can be granted to the
date action must be taken on the application.
ENVIRONMENTAL DETERMINATION
In accordance with the City's environmental review procedures adopted by resolution, the
Planning Director determines the level of review necessary for a project to comply with the
California Environmental Quality Act (CEQA). Some projects may be exempt from review
based upon a specific category listed in CEQA. Other projects may be exempt under a
general rule that environmental review is not necessary where it can be determined that
there would be no possibility of significant effect upon the environment. A project which
does not qualify for an exemption requires the preparation of an Initial Study to assess the
level of potential environmental impacts.

Based upon the results of an Initial Study, the Director may determine that a project will not
have a significant effect upon the environment. In such a case, a Notice of Intent to Adopt
a Negative Declaration or a Mitigated Negative Declaration is prepared. For many projects,
a Negative Declaration or Mitigated Negative Declaration will prove to be sufficient
environmental documentation. If the Director determines that a project has the potential for
significant adverse impacts and adequate mitigation can not be readily identified, an
Environmental Impact Report (EIR) is prepared.
The Director has reviewed this project and found it to be Categorically Exempt in
accordance with Section 15332 (Class 32 — Infill Development) of the California Code of
Regulations (CEQA Guidelines). No further environmental documentation is required.
STAFF RECOMMENDATION
1. Open the public hearing, accept public testimony and close the public hearing.
2. Adopt Resolution No. PC -2009- recommending to the City Council conditional
approval of Conditional Use Permit 2008 -05 and Industrial Planned Development
2008 -01.

WHEREAS, at a duly noticed public hearing on June 23, 2009, the Planning
Commission considered Conditional Use Permit No. 2008 -05 and Industrial Planned
Development No. 2008 -01 on the application of Todd Manner (Fiedler Group) for the
Moorpark Redevelopment Agency to construct a new commercial fueling facility
consisting of one (1) building and two (2) canopies on the south side of Princeton
Avenue, just east of the SR -118 overpass; and
WHEREAS, at its meeting of June 23, 2009, the Planning Commission
considered the agenda report and any supplements thereto and written public
comments; opened the public hearing and took and considered public testimony both
for and against the proposal, closed the public hearing, and reached a decision on this
matter; and
WHEREAS, the Planning Commission concurs with the Planning Director's
determination that this project is Categorically Exempt from the provisions of CEQA
pursuant to Section 15332 as a Class 32 exemption for Infill Development.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. PLANNED DEVELOPMENT FINDINGS: Based upon the
information set forth in the staff report(s), accompanying studies, and oral and written
public testimony, the Planning Commission makes the following findings in accordance

STANDARD AND SPECIAL CONDITIONS OF APPROVAL
FOR CONDITIONAL USE PERMIT 2008 -05 AND
INDUSTRIAL PLANNED DEVELOPMENT 2008 -01
STANDARD CONDITIONS
The applicant shall comply with Standard Conditions of Approval for Planned
Development Permits and Conditional Use Permits as adopted by City Council
Resolution No. 2009 -2799 (Exhibit A and B), except as modified by the following
Special Conditions of Approval. In the event of conflict between a Standard and Special
Condition of Approval, the Special Condition shall apply.
SPECIAL CONDITIONS
1. The permittee's acceptance of this permit and /or commencement of construction
and /or operations under this permit are deemed to be acceptance of all
conditions of this permit.
2. The development must be in substantial conformance with the plans presented in
conjunction with the application for Conditional Use Permit 2008 -05 And
Industrial Planned Development 2008 -01, except any modifications as may be
required to meet specific Building Code and Zoning Code standards or other
conditions stipulated herein.
3. The applicant must provide color and material samples prior to issuance of a
Zoning Clearance. Final colors and materials shall be subject to approval of the
Planning Director.
4. Prior to occupancy, the applicant shall irrevocably offer to dedicate the street
frontage on Princeton Avenue in accordance with the City's ultimate right -of -way
improvements for that location to the satisfaction of the Planning Director, Public
Works Director /City Engineer, and City Attorney, and be reviewed and accepted
by the City Council.
5. Prior to issuance of a Zoning Clearance for construction, the applicant must
provide additional landscaping and drainage areas in the southeast and
southwest corners of the site to the satisfaction of the Planning Director and
Public Works Director.
6. As part of the landscape and irrigation plan, the applicant must upgrade the size
of tree plantings associated with the project by a valuation equal to or greater
than $7,720.00. Such upgrading may be in a combination of increased tree sizes
and additional tree plantings

7. Prior to issuance of a Zoning Clearance for construction, the applicant must
irrevocably offer the southern portion of the site within the Arroyo Simi floodway
to the Ventura County Watershed Protection District (VCWPD) for flood control
purposes in a form to the satisfaction of the Public Works Director /City Engineer
and City Attorney.
8. On -site water detention area(s) may not be so deep, or the sides so steep, as to
require fencing, as determined by the Planning Director and City Engineer, prior
to issuance of a grading permit. Underground stormwater detention is not
permitted.
9. All signage must conform to the City's sign requirements and an approved sign
program. A monument sign may be constructed consistent with the sign
requirements and a sign program as approved by the Planning Director.
10. During construction, perimeter lighting must be installed at a minimum of 150 foot
intervals and at height not less than fifteen (15) feet from the ground. The light
source used must have a minimum light output of 2,000 lumens, be protected by
a vandal resistant cover, and be lighted during the hours of darkness.
Construction lighting is subject to review and approval of the Planning Director
and Chief of Police.
11. Prior to the commencement of construction, including grading, fencing not less
than six (6) feet in height, which is designed to preclude human intrusion, must
be installed along the perimeter boundaries of the construction site and shall be
secured with chain and Fire District padlocks for emergency vehicle access.
Alternatively, a uniformed security guard, licensed pursuant to Chapter 11 of the
Business and Professions Code of the State, shall be utilized to continually patrol
the construction site during the hours when construction work has ceased.
12. The hours of operation for the facility are limited to between 6:00 a.m. and 10:00
p.m. Monday through Saturday and between 7:00 a.m. and 7:00 p.m. on Sunday.
The Planning Director may further modify the hours of operation when in his /her
opinion limits on hours of operations are necessary to maintain compatibility with
nearby residential uses. Any exterior maintenance, cleaning, sweeping,
landscape work, and refilling of fuel tanks may only be performed between 7:00
a.m. and 7:00 p.m. Monday through Saturday.
13. Final architectural and site plan design and detailing, including parking lot,
landscaping and lighting design is subject to review and approval of the Planning
Director.
14. Non - reflective glass must be used on all exterior walls of the building, with
specific glass locations to the satisfaction of the Planning Director.
15. The applicant shall prohibit truck parking or storage overnight in the parking lot
area. Limited truck parking, when in association with a permitted use, is allowed,
but in no case shall there be overnight parking.

16. Prior to the issuance of a Zoning Clearance, the applicant shall pay the project's
pro -rata share of the cost of intersection improvements at Spring Road and High
Street /Princeton Avenue and Spring Road and Los Angeles Avenue. The actual
contribution (pro -rata share shall be based upon the additional traffic added to
the intersection). The applicant's traffic engineer shall provide the City Engineer a
"Fair Share Analysis" of the projects added traffic for calculation of the pro -rata
( "fair share ") amount.
17. In conjunction with the preparation of precise grading and landscape plans, the
sight distance shall be reviewed and approved at project access points per City
standards.
18. The applicant shall install stop signs, stop bars, and stop legends at project
access points. Signage to limit the ingress of trucks to the westerly driveway and
the egress of trucks to the easterly driveway must also be provided.
19. If the use is abandoned in excess of one - hundred and eighty (180) days, the
property owner shall be responsible for the removal of the underground tanks
and removal of the pumps in accordance with local and state requirements.

OVERVIEW & BACKGROUND
On a yearly basis the City is required to update the seven -year Capital Improvement
Program (CIP) for the Department of Public Works. Staff has prepared a draft of the
updated CIP for FY 2008/09 — FY 2014/15. A copy of the draft CIP has been distributed
to the City Council and the Planning Commission by separate Memo.
As in past years, prior to City Council action approving the CIP, it is necessary that the
Planning Commission first review the document and render a finding with regard to its
conformity with the Circulation Element of the Moorpark General Plan, as required by
Section 65401 of the Government Code of the State of California. This staff report
summarizes the recommended changes from last year's CIP, and requests that the
Planning Commission render its finding with regard to General Plan conformity.
Also included in this report is a description of certain projects which require acquisition
of additional street right -of -way, and a request that said acquisitions are also in
conformance with the Circulation Element of the Moorpark General Plan, as required by
Section 65402 of the Government Code of the State of California.

A. General Plan Conformity
Public Works, Engineering and Community Development staff has reviewed the
draft CIP and have confirmed the following:
1) All of the future streets and other Public Works projects listed in the Circulation
Element and other elements of the Moorpark General Plan have been included
in the CIP.
2) The Circulation Element of the Moorpark General Plan designates Moorpark
Avenue to be a two lane local collector. Project 113: Moorpark Avenue
Widening calls for the widening of Moorpark Avenue to more than two (2)
lanes. Said project is, therefore, inconsistent with the provisions of the
Circulation Element of the Moorpark General Plan.
3) Except as noted above, the projects listed in the subject draft CIP are in
conformance with the Moorpark General Plan.
Staff is currently working to update and revise the Circulation Element. Staff will
present this document to the City Council within the next fiscal year. It is the intent
of staff to include in the recommended changes, a different designation for
Moorpark Avenue which will allow for more than two (2) lanes of traffic.

A. Introduction
This is the updated Seven Year Capital Improvement Program [CIP] for both the City of Moorpark,
Moorpark Redevelopment Agency (MRA) and for development projects -for the period covering FY
2008/09 through FY 2014/15.
The primary purpose of this CIP is to provide the City Council with a framework for identifying,
planning and prioritizing needed municipal capital improvements. The year each project is
recommended to be funded, is an indication of the priority given to each project. The figures cited in
the FY 08/09 column, should be identical to the appropriations approved in the FY 2008/09 Budget for
capital improvement projects for (8000 series).
Projects have been organized into the five (5) Sections noted below. The projects identified in this
program include both City funded projects as well as major projects which are likely to be constructed
by land developers. The projects listed in Section 100 include future streets which are identified in the
Circulation Element of the Moorpark General Plan. The projects listed in Section 500 include future
needed storm drains identified in the Moorpark Master Drainage Study. Also included in Section 500
this year are certain projects of importance to the City which are planned to be constructed by the
Ventura County Watershed Protection District.
A brief description of the contents of this program is as follows:

Project Description
Bi- annual Slurry seal /ARAM project. Resurfacing of one -third of the City's streets every other year. Past
Slurry Seal Projects are listed in Appendix W. The scope of work often includes the removal and
replacement of pavement in poor condition, and the application of crack filler where needed. The Budget
amount shown below for FY 2008/09 is for residual costs related to a major (51.9 million) slurry seal
project undertaken and completed in the Spring of 2007. The next slurry seal project is scheduled for
Summer 2009.

Construction of improvements and modifications to Spring Road, from a point south of Los Angeles
Avenue northerly to Flinn Avenue. This project requires the acquisition of additional street right -of -way,
widening, new curb, gutter and sidewalk along the east side of the street. Ultimate improvements will
include four (4) travel lanes, six feet (6') wide bike lanes, a fourteen feet (14') wide landscaped median and
a double left -turn lane southbound on Spring Road. The project extends south of Los Angeles Avenue to
accommodate a shift of the centerline to the east. The project also includes new signal poles at the northeast

Widening, realignment and reconstruction of Princeton Avenue from a point east of Spring Road easterly
to South Condor Drive. Additional street right -of -way is being acquired to provide an eighty -eight feet
(88') wide corridor — sufficient to allow for future widening of the road to four lanes. The current project
design provides for only one lane in each direction with a paved median and paved shoulders. The project
plans call for the realignment and reconstruction of the street pavement, the construction of storm drains
and the construction of retaining walls as required. Current efforts are for the acquisition of required
additional street rights -of -way.

The construction of a new east -west arterial street north of Casey Road. The westerly end of the street is
proposed to connect to Los Angeles Avenue, via a future railroad undercrossing, at a point west of Butter
Creek Road. Currently, the easterly terminus of this new street will be the northerly extension of Spring
Road. Segments of this project will be constructed by developers (Tract 5147, Tract 5130, Tact 5045, Hitch
Ranch, and Centex) and other segments funded by the Citywide Traffic Mitigation Fund.

Project Description
Prior Year costs are for the Arroyo Simi Trail Study. That study evaluated options for the possible future
development of a trail system, generally along the levee road of the Arroyo Simi, from the westerly City
Limit easterly to Madera Road in the City of Simi Valley. Future expenses are for projects to implement
segments of that system. FY 08/09 costs are for the design of "trail ramps" at the Tierra Rejada Road
Bridge. Ramps at the Spring Road bridge are included in the design for the channel improvements planned
by the Ventura County Watershed Protection District.

This project is to provide for the construction of a trail extending from the east end of Campus Park Drive,
across the watercourse referred to Drain No. 2, then south under the freeway through an existing access
tunnel to Los Angeles Avenue. Prior year costs were for the development of a feasibility study to determine
access and design requirements. Review and finalization of the study has been placed on hold. Future costs
are for the acquisition of those access rights, preparation of the design and construction of the project. Cost
estimates for this project have not yet been developed and the funding for future year projects has not yet
been determined.

The existing Ventura County Watershed Protection District [VCWPD] facilities within the Gabbert Canyon
and Walnut Creek watersheds are inadequate. This project calls for the construction of new detention,
diversion and capacity enhancement improvements to those existing facilities. The 2006 cost estimate for

Project Description
Construction of a storm drain to serve the residential area north of the intersection of Los Angeles Avenue
and Shasta Avenue, as identified in the City's Master Drainage Study. No funding source has been

Construction of a storm drain similar in function to that identified in the City's Master Drainage Study as
the "Freemont Drain ", located north of the intersection of Los Angeles Avenue and Millard Street. The
current design concept for this project anticipates a storm drain running easterly along the north side of Los
Angeles Avenue from the existing Los Angeles Avenue culvert to Millard Street and then northerly along
the east side of Millard Street for a short distance.

Project Description
There is a culvert under Arroyo Drive at the entrance to the Villa Del Arroyo Mobile Home Park, which
connects to a storm drain pipe owned by the Mobile Home Park. This "private" drain line extends southerly
to the arroyo. It has been determined that the function of that storm drain is impaired and that remedial
action must be taken in order to provide adequate drainage for both the City street and the Mobile Home
Park. Consistent with the provisions of a Settlement Agreement between the City and the Mobile Home
Park, the property owner is required to take corrective action to remedy this problem.

Capital Improvement Program
D. Congestion Management Program
The purpose of the Ventura County Transportation Commission's (VCTC) Congestion Management
Program (CMP) is to monitor certain street segments and/or intersections on the CMP Road Network
(see Map), to confirm that the Level of Service (LOS) [a measurement of the level of congestion] on
those segments, or at those intersections, does not deteriorate below certain stipulated levels. Increased
traffic generated by development is one of the major causes of increased traffic congestion and,
therefore, the deterioration of the LOS. The CMP requires each Agency to identify projects designed to
increase capacity and /or otherwise improve the efficient and effective movement of traffic. The
projects set forth in this seven year program, which are on the CMP Road Network and which could
reduce congestion, are listed on the following page.

5. PRESENTATION /ACTION /DISCUSSION:
A. Consider High Street Streetscape Concepts. Staff Recommendation: Set
the May 6, 2009 Council meeting for action on a selected concept for High
Street Streetscape.

Mr. Hogan provided background on two prior community meetings held at
the Moorpark Chamber of Commerce to solicit comments and suggestions
from High Street property owners, and the Redevelopment Agency
meeting of March 18, 2009, where the Council directed this joint meeting
take place.
Mr. Hogan presented the special features of the two proposed streetscape
designs.
Planning Commission concerns and suggestions included: 1) Limited
available parking; 2) Coordinating the Aszkenazy Development plans with
this proposal; 3) Safety concerns at pedestrian crosswalks and angled
intersections; 4) Slowing traffic on High Street; 5) Two arches are
sufficient and consider placement of the western arch set back from the
corner to make it more visible and not block the doorway at 17 East High
Street; 6) Cobblestones are preferable over painted intersections; 7)
Removing planter proposed at the entrance to the Theater to provide an
open area; and 8) When sidewalks are replaced consider including
artwork in the new pavement.
Audience participants' concerns and suggestions included: 1) Addition of
maintenance costs in the proposal; 2) Safety for pedestrians crossing High
Street; 3) Acknowledging additional parking will be available offsite at the
western end of High Street; 3) Four arches are excessive for such a short
street; 3) Cobble stone intersections are preferred over painted; 4) Brick
pavers with names of donors for sidewalks; and 5) Incorporate
opportunities to show the history of the downtown area in art form.
Council comments included: 1) Safe parking and safe access as a
priority; 2) Including the Arts Commission in early stages of planning for
art in public places; and 3) During conceptual process, concentrate on the
possibilities, not the cost.
Captain Nelson stated statistics show that angled parking and the bulging
corners at intersections do slow traffic.
CONSENSUS: It was the consensus of the Agency /Council to continue this item
to the regular City Council meeting of June 3, 2009.
