Subject: PLANNING COMMISSION ACTIONS OF JANUARY 23, 1995
The Planning Commission meeting of January 23, 1995, was held in
the City Council Chambers, 799 Moorpark Avenue, Moorpark,
California 93021.
1. CALL TO ORDER
The meeting was called to order at 7:11 p.m., Chairperson
Torres presiding.
2. PLEDGE OF ALLEGIANCE
Vice Chairperson May led the pledge of allegiance.
3. ROLL CALL
Commissioner Miller was absent. All other Commissioner's were
present. Staff attending the meeting included the Director
of Community Development, Jim Aguilera and Administrative
Secretary, Celia LaFleur.
None.

Motion: Commissioner Martens moved and Commissioner May
seconded a motion to approve the December 12, 1994
minutes with a modification to item 6 of the
December 12, 1994 minutes. The motion passed with
a 4:0 voice vote. Commissioner Miller was absent.
None.

g presented the staff report dated
December 15, 1994, to the Commission. Staff's recommendations
for garage conversions which occurred before City
incorporation included the following:
1. That the property owners prove to the satisfaction of
the Community Development Director that the conversion
was done prior to City incorporation. (This could be
done by submitting materials such as dated photographs,
affidavits from neighbors, receipts for contractors'
work, etc.).
2. That the property owners agree that the converted garage
will not be used as sleeping quarters (i.e., playroom,
den exercise room, etc.), and that if the use as
sleeping quarters currently exists, that it will cease
immediately.
3. That the property owner pay for the cost to record a
cloud on the title requiring the conversion back to a
garage (or in another manner comply with current code
requirements) prior to sale or transfer of the property.

4. That the property owner shall enter into an agreement
with the City not to use the converted garage area for
sleeping quarters.
5. That if the garage is used for sleeping quarters after
the property owner enters into an agreement with the
City, the property owner must convert the structure back
to a garage immediately (or otherwise comply with code
requirements).
The Commission's discussions centered on the methods used in
reaching compliance. Commissioner Acosta commented that
converted garages used for rental purposes could create lengthy
compliance recovery, because of the difficulty in evicting
renters (tenants) from the premises. Commissioner Acosta
suggested that garage conversion information be recorded to the
CC &R's of the development.
The Commission recommended that sleeping quarters be defined.
The Commission also requested that staff change the section
dealing with compliance to allow for a four week period and to
allow extensions of that time frame if the Director thought it
was necessary due to building permit and design requirements.
Public testimony from the following.
Eloise Brown, 13193 Annette Street, Moorpark, CA. Ms. Brown
commented on those property owners who would have difficulty in
proving that their conversions were allowed and approved by the
County of Ventura before the City's incorporation. The reason
for this difficulty was that some cases records may have been
lost or failed to be transferred to the City upon
incorporation. Ms. Brown also stated that the process places a
financial hardship on the property owners.
The Director said that the violations of garage conversions
that meet this criteria were a small percentage of the
complaints received or Code Enforcement field observations.
MOTION: Chairperson Torres moved and Commissioner Martens
seconded a motion to direct staff to prepare a
revised ordinance that defines sleeping quarters,
time not to exceed clause (to reach compliance), and
property owners request for a time extension to reach
compliance. The ordinance and resolution approving
the recommendations of the Planning Commission be

provided for the Commission's approval at their next
regular meeting. The motion passed with a 4:0 voice
vote, Commissioner Miller was absent.
10. DISCUSSION rmEMR
The Commission and staff discussed the City of Thousand Oaks
vs. Cohn case. The Commission heard a presentation by
Chairman Acosta that the City of Thousand Oaks problems were
related to the lack of following procedures and violating the
Brown Act.
The Director provided the Commission a status report on the
following:
Happy Camp Golf course - The County of Ventura's original
applicant (QUOR) abandoned their proposal. The County had
sent out Request for Proposals and received a proposal
from a Mr. Ralph Mahan from which a meeting is scheduled
for February 6, 1995, with Mr. Mahan and the Community
Development Committee.
Bollinger Development - The Director did not give a report
on this item because of the Special Meeting scheduled for
January 25, 1995
• Status of Upcoming Projects - a
• The commercial property in the Mountain Meadows
development was recently sold to American Stores. It is
uncertain when the site will be developed.
Albertson Market - The applicant for Albertsons Market is
working toward a November 1995 deadline.

SDI - SDI is a corporation that has considered relocating
to the City of Moorpark and will employ 1000 plus
employees.
Colmer Development - The applicant is proposing an 18 unit
subdivision on property located on Los Angeles Avenue,
east of Shasta Drive.
Downtown Plan - The City received four proposals which are
currently being reviewed by staff. Staff expects to have
this item before the City Council for their review at the

February 1, 1995 meeting.
Mayflower Market - The City has received 5 proposals to
rebuild the Mayflower Market. The Community Development
Block Grant funds will provide money for the City to hire
an architect. Staff expects to have this item before the
Planning Commission for a request of a Commercial Planned
Development in two to three months.
Specific Plan 9 - Braemar expects to file a pre -
application for their proposal of single family homes.
Specific Plan 1 - Staff expects to review the Screencheck
EIR within four weeks and may be scheduled for a Planning
Commission June 1995 meeting.
Specific Plan 8 - Staff expects to have this item before
the Planning Commission in November or December 1995.
11. AMQUNCEMENT or F rrr R A A ITEM
Chairperson Torres suggested that the items which appeared as
Discussion Items on this agenda be provided monthly to the
Commission on their future agendas for a status report.
