CALL TO ORDER Chairman Torres called the meeting to order at 7:12 p.m.. 2. PLEDGE OF ALLEGIANCE Commissioner Acosta led the pledge of allegiance. 3. ROLL CALL All Commissioners were present. Staff attending included the Director of Community Development, Jim Aguilera, Senior Planner, Debbie Traffensted, Assistant City Engineer, Dirk Lovett, Administrative Secretary, Celia LaFleur, and Steve Craig, EIR Consultant. 4. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS None. 5. REORDERING OF THE AGENDA None. 6. APPROVAL OF MINUTES 1. September 11, 1995 Planning Commission Meeting MOTION: Commissioner Miller moved and Commissioner May seconded a motion to approve the minutes of the September 11, 1995, Planning Commission Meeting. PUBLIC COMMENTS Joseph Latunski, 280 Casey Road, Moorpark. Mr. Latunski was concerned about various entitlement permits that the City approves for development, is never built and later sold by the developer. 8. CONSENT CALENDAR 1. Resolution No. PC -95 -309 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF MAJOR MODIFICATION NO 1 TO COMMERCIAL PLANNED DEVELOPMENT PERMIT NO. 90 -2. MOTION: Commissioner Martens moved and Commissioner May seconded a motion to approve Resolution No. PC -95- 309 which the Planning Commission recommends to the City Council approval of Major Modification No. 1 of Commercial Planned Development Permit No. 90 -2. The motion carried on a 5:0 voice vote. 9. PUBLIC HEARINGS 1. Draft Environmental Impact Report - Moorpark County Club Estates The City's California Environmental Quality Act (CEQA) procedures (City Council Resolution No. 92 -872) require that a Planning Commission public hearing be scheduled for consideration of public comments on a Draft EIR during the public review period. Entitlement: Moorpark Country Club Estates Project (General Plan Amendment No. 94 -1, Zone Change No. 94 -1, Vesting Tentative Tract Map No. 4928, Residential Planned Development (RPD) Permit No. 94 -1, Conditional Use Permit (CUP) No. 94 -1, Parcel Map No. 94 -1 The Draft EIR is available for public review, and the review period is City of Moorpark, 799 Moorpark Avenue, Moorpark, CA 93021 (805) 529 -6864, Extension 228 Steven Kueny, City Manager Planning Commission Actions of September 25, 1995 Paqe 3 from August 23, 1995, to October 9, 1995. Location: The Project site is located in the northern portion of the City, totals 655 acres, and has frontage on both Walnut Canyon Road (State Route 23) to the east and Grimes Canyon Road to the west. The project site northerly boundary is also the northerly boundary for the City limits and is approximately 2,700 feet south of Broadway Road. Applicant: Bollinger Development Corporation Proposal: 223 -lot vesting tentative tract map 4 -lot parcel map for financing purposes 216 single - family dwelling units 218 -hole golf courses and related facilities including driving range and clubhouses, pro -shop, restaurant, bar, snack -bar, golf cart storage and maintenance buildings Public trails, park and equestrian staging area Existing General Plan Designation: Rural Low - 1 Dwelling Unit (DU) /5 Acres Proposed General Plan Designation: Rural High - 1 DU /1 Acre (residential units will be clustered ontoapproximately 170 acres of the total 655 acres). Open the public hearing and accept public testimony on the Draft EIR; and 2. Review and consider the information in the Draft EIR, and identify any Planning Commission comments /concerns to be addressed in the final EIR; and 3. Direct that the Draft Final EIR be prepared following the close of the public review period on October 9, 1995, and that a subsequent Planning commission meeting be scheduled for the purposes of providing the city Council with a certification recommendation; and 4. Direct staff to schedule a Planning Commission special meeting to allow for a field trip to the Project site, on the date selected by the City Council, and to scheduled public hearing for October 30, 1995, for consideration of the Revised Project entitlement (General Plan amendment, zone change, vesting tentative tract map, parcel map, residential planned development permit, and conditional use permit). Reference: Staff Report dated September 19, 1995. The EIR Consultant, Steve Craig spoke about Impacts and Mitigatio Measures as identified in the EIR, pages 3 -1 through 3 -50. He identified that Alternative 5 of the EIR had been revised. PUBLIC HEARING OPENED AT 7:50 p.m. Testimony given by the following: Charles Schwabauer, 12681 Broadway, Moorprak. Mr. Schwabauer's concerns were about the existing agricultural uses and the proposed development. He question if the project proposed a buffer zone. a. Bob Haaland, 351 rolling Oaks Drive, #200, Thousand Oaks. Mr. Haaland, one of the applicants representives had no additional comments, and was there to answer any additional questins. b. Paul A. Bollinger, 28200 Townsgate Road, #200, Thousand Oaks. Mr. Bolinger stated that Alternative 5 had been revised, is adequate and approved staff's presentation. C. Joe Latunski, 289 Casey Road, Moorpark. Mr. Latunski comments centered around traffic, congestion on Gabbert and Walnut Canyon Roads, and if the project provided equestrian trails. d. Tony Hershman, 10817 Alysheba, Moorpark. Mr. Hershman spoke as a representative of the Orchard Downs Homeowners Association. He said his concerns were plenty and listed as follows. 2. Zoning Ordinance Amendment No. 95.2 (Boukhari) - Consider revisions to Section 17.20.060 (Permitted Uses in Commercial and Industrial Zones) of the Moorpark Municipal Code (City of Moorpark Zoning Ordinance) to Allow Automobile Service Stations in Industrial Zones. Staff Recommendation: 1) Determine that the modifications to the City's Zoning Ordinance are categorically exempt pursuant to State CEQA Guidelines Section 15061 (b) (3). 2) Adopt the attached resolution recommending to the City Council that automobile service stations be allowed in the M -1 and M -2 Industrial Zones with a Planning a. Commission approved Conditional Use Permit, if the subject property has frontage on Old Los Angeles Avenue, New Los Angeles Avenue, or Spring Road. 11. ANNOUNCEMENTS or FUTURE AGENDA ITEMS 12.
