CALL TO ORDER Chairperson Torres called the meeting to order at 7:12 p.m. 2. PLEDGE OF ALLEGIANCE Commissioner Miller led the pledge of allegiance. 3. ROLL CALL All Commissioners were present. Staff attending the meeting included the Director of Community Development, Jim Aguilera, Senior Planner, Debbie Traffenstedt, Assistant City Engineer, Dirk Lovett, and Administrative Secretary, Celia LaFleur. Consultants attending the meeting included Steve Craig, (The Planning Corporation)for the Bollinger project, and Jone Kelly, (Michael Brandman Associates)for the Hidden Creek Ranch project. 4. PROCLAMATIONS COMMENDATIONS AND SPECIAL PRESENTATIONS None. 5. REORDERING OF THE AGENDA MOTION: Commissioner Miller moved and Chairperson Torres seconded a motion to reorder the agenda to consider Item 9.B, before Item 9.A. The motion passed with a unanimous voice vote. 6. APPROVAL OF MINUTES None. PUBLIC COMMENTS No public comments received at this meeting. 8. CONSENT CALENDAR A. Resolution of Approval - PC -95 -312 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL FOR VESTING TENTATIVE TRACT MAP NOS. 4973 AND 4974 ON THE APPLICATION OF C.T. FINANCIAL (ASSESSOR PARCEL NOS. 500- 35 -15, 500 -35- 33, 512- 15 -60, 513- 05 -11, 500 -35 -041). Commissioner Miller questioned staff about Condition No. 73, that referenced signalization improvements. Commissioner Miller was concerned that without signalization improvements traffic circulation would be forced onto Peach Hill Road. After reviewing Conditions Nos. 73 -77, Commissioner Miller found that Condition No. 77 adequately addressed his concern. MOTION: Chairman Torres moved and Commissioner Martens seconded a motion to approve Resolution No. PC -95 -312, recommending approval to the City Council of Vesting Tentative Tract Map Nos. 4973 and 4974 on the application of C.T. Financial. Motion passed with a unanimous voice vote. 9. PUBLIC HEARINGS B. Entitlement: Moorpark Country Club Estates Project (General Plan Amendment No. 94 -1, Zone Change No. 94 -1, Vesting Tentative Tract Map No. 4928, Residential Planned Development Permit No. 94 -1, Conditional Use Permit (No. 94 -1, Parcel Map No. 94 -1) The Draft EIR is available for public review, and the review period is from August 23, 1995, to October 9, 1995. Location: The Project site is located in the northern portion of the City, totals 655 acres, and has frontage on both Walnut Canyon Road (State Route 23) to the east and Grimes Canyon road to the west. The project site's northerly boundary is also the northerly boundary for the City limits and is approximately 2,700 feet south of Broadway Road. Open the public hearing and accept public testimony on the Draft EIR; and ii. Review and consider the information in the Draft EIR, and identify any Planning Commission comments /concerns to be addressed in the final EIR; and iii. Direct that the Draft Final EIR be prepared following the close of the public review period on October 9, 1995, and that a subsequent Planning Commission meets be scheduled for the purposes of providing the City Council with a certification recommendation; and iv. Direct staff to schedule a Planning Commission special meeting to allow. for a field trip to the Project site, on the date selected by the City Council, and to scheduled public hearing for October 30, 1995, for consideration of the Revised Project entitlement (General Plan amendment, zone change, vesting tentative tract development el permit, and conditional nd tionallanuse permit). Steve Craig spoke about the public comments received on the project since the October 9th Planning Commission meeting. He said that the public concerns were addressed in an addendum to the EIR. Commissioner Miller said he was concerned about the impact the project would have on Walnut Canyon Road, and made reference to Transit Mix, a company that has access to Walnut Canyon Road, and which proposes City of Moorpark, 799 Moorpark Avenue, Moorpark, Califomia (805) 529 -6864, Extension 228 PC951030.ACT Steven Kueny, City Manager October 31, 1995 Planning Commission Actions of October 30, 1995 PaQe 5 an increase of (1200) vehicle trips per day onto Walnut Canyon Road. Bob Haaland, Haaland Group (Civil Engineering) gave an overview of the project and grading. He mentioned that the Haaland Group worked on the Wood Ranch Golf Course where 3 million cubic yards of grading had taken place. Testimony received by the following: Ruth A. Bersbacii, 8350 Fruitvale Avenue, Moorpark. Ms. Bersbacii was concerned about additional traffic (created by the proposal) on Grimes Canyon Road. Eddie Bergfield, 7505 Walnut Canyon Road, Moorpark. Mr. Bergfield's concerns were about the lots identified as Lot 216 and 217, and their setback requirements to the adjacent residential properties. The other concern that Mr. Bergfield expressed was the use and control of reclaimed water. Steve Craig said that they would address setback requirements at the time of public hearing on the project, and that concern of use and control of reclaimed water would be addressed by the Regional Board & Water District. The Planning Commission directed staff and consultant to continue their work in preparing responses, and to return to the next regular Planning Commission meeting with a resolution recommending to the City Council certification of the Draft EIR. A. Draft Environmental Impact Report - Hidden Creek Ranch Specific Plan At this point in the agenda Commissioner Martens, due to a possible conflict of interest with Item 9. A., step down from the dias and left the room. Entitlement: Hidden Creek Ranch Specific Plan (A general Plan Amendment No. 93 -1, Pre -Zone No. Z -93 -3, and Specific Plan No.SP- 93 -1). The Draft EIR is available for public review, and the review period is from September 12,1995, to October 30, 1995. Location: The Project site is in the northern portion of the City's Area of Interest, totals 4,322.58 acres. The project lies directly north of the City of Moorpark and east and south happy Camp Canyon Regional Park. Applicant: Hidden Creek Ranch Partners Proposal: 3,221 Residential Dwelling Units on 1,359.4 gross acres Retail Centers Three school sites One 18 -hole golf including driving snack -bar, golf buildings Public staging area course and related facilities range and clubhouses, pro -shop, cart storage and maintenance trails, parks and equestrian 1,825 Acres of permanent Open Space _Existing General Plan Designation: County of Ventura -- Open Space City -- Specific Plan Proposed General Plan Designation: Rural High - 0 to 0.5 DU/ Acre (278.9 ac.) Open the public hearing and accept public testimony on the Draft EIR; and vi. Review and consider the information in the Draft EIR, and identify any Planning Commission comments /concerns to be addressed in the final EIR; and vii. Direct that the Draft Final EIR be prepared following the close of the public review period on October 30, 1995, and that a subsequent Planning Commission scheduled a meeting for the purposes of providing the city Council with a certification recommendation. Senior Planner, Debbie Traffenstedt summarized the Hidden Creek Ranch project and status or public comments. Testimony received from the following: Patrick Martin, 15155 -B Marquette Street, Moorpark. Mr. Martin's comments were about the long term impacts of the project, the use of heavy equipment during construction, noise pollution, vehicle access, and the increase of traffic. Maurice Lacour, 6890 N. Auburn Circle, Moorpark. Mr. Lacour concerns were about impacts to the City's City of Moorpark, 799 Moorpark Avenue, Moorpark, California (805) 529 -6864, E#ension 228 PC951030.AC1- Steven Kueny, City Manager October 31, 1995 Planning Commission Actions of October 30, 1995 Pace 8 viewshed, noise /air pollution, Campus Park Drive access, and the decrease of property values. Vince Nardi, 15569 Kernvale Avenue, Moorpark. Vince Nardi's concerns were about the increases in traffic, destroying wildlife /oak trees, and that the wildlife that migrates to Moorpark would be replaced with new homes and development. Steve Nardi, 15569 Kearnvale Avenue, Moorpark. Mr. Nardi, a frequent user of the Happy Camp Park area since 1983 protested the development because of increase traffic, noise /air pollution. He commented that the losses did not outweigh the impact that this project would bring. Ralph M. Sinclair, 6440 N. Berkeley Circle, Moorpark. Mr. Sinclair said he had reviewed the information related to traffic in the EIR, but has little time to comment. He commented on the intrusion to Happy Camp Park, deed restrictions on the proposed development, the Lagoon interchange proposing mitigation of Campus Park Drive, and construction traffic. Timothy Kelly, 14357 E. Cambridge, Moorpark. Mr. Kelly requested that the Commission consider extending the public comment period to be certain that all interested parties could respond to the proposed development. He questioned how the EIR was processed. He compared the review period of the EIR to Initial Study, Notice of Preparation review periods. He questioned staff if they had noticed the Environmental Coalition. Mr. Kelly also had questions about Unocal, drilling, oil rights, and transportation of hazardous materials. Raymond John Kristorpaitis, (no address listed). Mr. Kristorpaitis, opposed the development said that he frequently visited the Happy Camp Park area and that the change would destroy the park. Alice Tsang, 6801 Trojan Court, Moorpark. Ms. Tsang had several concerns that related to adequately City of Moorpark, 799 Moorpark Avrnue, Moorpark, California (805) 529 -6864, Eslension 228 PC951030.ACT Steven Kueny, City Manager October 31, 1995 Planning Commission Actions of October 30, 1995 Paae 9 addressing the City's General Plan, air quality levels being reduced to less than adequate, costal sage, water resources, habitat, solid waste, oak trees, increase in refuge and landfill sources, and asked that the public comment period be extended. Ralph E. Gifford, 15660 Trollope Court, Moorpark. Mr. Gifford's concerns were traffic circulation, and that the City consider building residential units on a vacancy rate. Roseann Mikos, 14371 E. Cambridge Street, Moorpark. Ms. Mikos, representing the Environmental Coalition had the following concerns. Extending the comment period, traffic, water resources, that water pipeline issues had not yet been settled, threats to wildlife, an assumption that Open Space areas would remain within the development, and the concern of building on prime agricultural land. Commissioner May commented that the Happy Camp Park issue had never been addressed. Commissioner May questioned Ms. Mikos, what she thought would be the ideal plan for a Happy Camp Park access. Ms. Mikos went on to further state her oppositions. Impacts on the viewshed, changes in drainage, providing a commitment to Open Space, annexation of the lower part of Happy Camp Park, and to consider a greenbelt area north of SR118. Karen Bill, 14411 Cambridge Street, Moorpark. Ms. Bill's concerns were that the proposed development was overwhelming, vehicle traffic and their impacts on Campus Park Drive, children's safety, hours of construction proposed (7:00 a.m. to 7:00 p.m. Monday through Saturday). Break at 9:10 p.m. - Reconvene at 9:28 p.m. David Weiss, 15100 -D Marquette Street, Moorpark. Mr.Weiss acknowledged the prior concerns addressed to the Commission. Mr. Weiss said that a population increase of 10,000 over 15 years was equitable, as City of Moorpark, 799 Moorpark Avenue, Moorpark, California (805) 529 -6864. Unlike Simi Valley, Moorpark has the opportunity to provide conscientious planning. Lisa Dragan, 15382 Braun Court, Moorpark. Ms. Dragan's concerns were about water resources, public health /safety (emergency response), Open Space, and Measure F. Jim Aguilera commented that LAFCO requested that the public review and comment period be extended to November 17, 1995. At this point in the meeting the Commission discussed how long the public review and comment period would be. The Commission concurred that a 30 -day extension would be adequate for additional comments. They extended the review and comment period to November 27, 1995. MOTION: Chairman Torres moved and Commissioner Acosta seconded a motion to close the public hearing, and extend the public review and comment period to November 27, 1995. The motion passed with a 5:0 unanimous voice votes. The Commission's final comments on the Hidden Creek Ranch development were that the following be reviewed: Moorpark Community College comments; Spring Road /SP 8 connector at SP 2 project site; Traffic impact to the Collins intersection; General Plan Circulation Element is not adequately addressed; Deny the Campus Park Drive access; Update the Circulation Element; MUSD concerns. Measure F Ordinance Amendment - Consider adoption of a resolution recommending approval of an ordinance amending Measure F to extend the termination date to December 31, 1996, and to provide for additional annual residential development allotments for the extended time. Staff recommendation. Staff Recommendation: Adopt a resolution recommending City Council approval of an ordinance amending Measure F. The Commission discussed development allotments and questioned staff about how many allotments would be permitted at this time. Staff said that on January 1996, 270 allotments would be added to the unexpended pool. The Commission also questioned staff about the number of projects that could be built if Measure F was not extended, but a new growth measure was adopted within the next year. Staff responded that in their estimation none of the project currently being processed could conceivably be ready to get a building permit within that time frame. Public Hearing Opened at 10:20 p.m. Testimony received by the following. Roseann Mikos, 14371 E. Cambtidge Street, Moorpark. Ms. Mikos commented that Measure F was originally intended to control residential planned development. MOTION: Commissioner Martens moved and Commissioner May seconded a motion to close the pubic hearing and recommend to the City Council that Measure F not be extended. The motion passed with a unanimous voice vote. 10. DISCUSSION ITEMS None.
