CALL TO ORDER Chairman Torres called the meeting to order at 7:09 p.m.. 2. PLEDGE OF ALLEGIANCE Commissioner Acosta led the pledge of allegiance. 3. ROLL CALL All Commissioners were present. Staff attending included the Director of Community Development, Jim Aguilera, Senior Planner, Paul Porter, Assistant City Engineer, Dirk Lovett, and Administrative Secretary, Celia LaFleur. 4. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS None. 5. REORDERING OF THE AGENDA None. 6. APPROVAL OF MINUTES MOTION: Commissioner Martens moved and Commissioner Acosta seconded a motion to approve the minutes of the August 28, 1995, Planning Commission Meeting. The motion carried by a 5:0 voice vote. PUBLIC COMMENTS None. 8. CONSENT CALENDAR None. 9. PUBLIC HEARINGS A. Entitlement: CPD90 -2, Major Modification No. 1 Applicant: American Stores Properties, Inc. Proposal: A proposal to modify the previously approved Neighborhood Commercial Shopping Center that consisted of a 45,000 sq. ft. market, 60,400 sq. ft. retail, 5,000 sq. ft. medical office and 12,000 sq. ft. of restaurant uses for a total of 122,400 sq. ft. to the following: Major Modification No. 1 to CPD90 -2 consists of a Neighborhood Shopping Center with 15,000 sf. of retail, 63,300 sf. market, 16,503 sf. shop spaces, two pads of 3,000 and 4,500 sf. and a drug store consisting of 16,480 sf. for a total of 118,873 sf. Location and Parcel Number: The proposed project site is southwest of the Tierra Rejada Road intersection and Mountain Trail Street within the City. The Assessor's Parcel Number is 505- 0- 12 -41. Staff Recommendation• Staff recommends that the Planning Commission direct staff to prepare a resolution recommending to the City Council approval of Commercial Planned Development Permit No. CPD90 -2 requiring a reduction of the drugstore pad from 16,480 square feet to 5,000 square feet, the relocation of the drug store to the area of the market, and any other Planning Commission recommended changes, for City of Moorpark, 799 Moorpark Avenue, Moorpark, CA 93021 (805) 529 -6864, Extension 228 Steven Kueny, City Manager Planning Commission Actions of September 11, 1995 Paqe 3 presentation at the Planning Commission's next regular meeting of September 25, 1995. David McNamara, 4359 Cedardale Road, Moorpark, CA The concerns expressed by the residents were: Hours of Operation Existing pedestrian access Noise (roof top equipment) Trash bins, and waste management Lighting plan Children's safety The size of the market facility Increased traffic Security Twenty -four hour pharmacy Fast food facilities with drive -thru Loitering Staff and the applicant agreed to address the concerns by conditioning the project. MOTION: Commissioner May moved and Commissioner Acosta seconded a motion to recommend to the City Council that the hours of operation for the project site be 6:00 a.m. to 10:00 p.m., and further requests to extend the hours of operation require a minor modification with the proviso that the same notification requirements for a major modification be used. The motion carried by a 5:0 voice vote. MOTION: Commissioner Martens moved and Commissioner Miller seconded a motion to recommend the City Council eliminate pedestrian access from the rear of the project site. The motion carried by a 5:0 voice vote. MOTION: Commissioner May moved and Commissioner Martens seconded a motion to recommend to the City Council to eliminate drive -thru access for restaurants. MOTION: Commissioner Acosta moved and Commissioner Miller seconded a motion to recommend to the City Council the relocation of the drug store to the area of the market. The motion carried by a 5:0 voice vote. MOTION: Commissioner Martens moved and Commissioner May seconded a motion to recommend the City Council that the corner building be two separate buildings at 5,500 square feet each. The motion carried by a 5:0 voice vote. MOTION: Commissioner Martens moved and Commissioner Acosta seconded a motion to recommend to the City Council that the proposed two corner buildings be as proposed in the original site plan. The motion carried by a 4:0 voice vote. Commissioner Miller voted NO. MOTION: Commissioner Martens moved and Commissioner Acosta seconded a motion to recommend to the City Council that the City Engineer review the two left turns at Tierra Rejada Road and the median cut on Tierra Rejada Road for left turn movement. The motion carried by a 5:0 voice vote. MOTION: Commissioner Martens moved and Commissioner Acosta seconded a motion to recommend to the City Council that the Arts in Public Places fee be used for the creation of an on -site public art project. The motion carried by a 5:0 voice vote. MOTION: Commissioner Martens moved and Commissioner Acosta seconded a motion to recommend to the City Council that the truck entrance on Mountain Trail Road originally designed for the drug store be deleted from the project site plan. MOTION: Commissioner Acosta moved and Commissioner Miller seconded a motion to recommend to the City Council that roof equipment not exceed noise levels above 45 dBA at the property line. The motion carried by a 5:0 voice vote. MOTION: Commissioner Martens moved and Commissioner May seconded a motion directing staff and the applicant to reword the condition that identifies the truck route to and from the project site. The motion carried by a 5:0 voice vote. MOTION: Commissioner Torres moved and Commissioner Martens seconded a motion to approve the added conditions as follows: (1) Truck traffic to and from the site may only use Tierra Rejada Road between Mountain Trail Street and Los Angeles Avenue. Violations of this condition will result in citations being issued to the business owner which was the recipient of the truck service. (2) Pad B shall be set back from the right -of -way a minimum of 30 feet with a minimum of 20 feet of landscaping from property line. (3) Lighting Plan: maximum overall height of fixtures shall ve twenty five (25) feet in the main parking area and twenty (20) feet in the rear parking area. (4) Street Improvements: The applicant shall submit to the City of Moorpark for review and approval, revised street improvement plans prepared by a Registered Civil Engineer conforming to City Drawing 491- ML10442; shall enter into an agreement with the City of Moorpark to complete the improvements; and shall post sufficient surety guaranteeing the City of Moorpark, 799 Moorpark Avenue, Moorpark, CA 93021 (805) 529 -6864, Extension 228 Steven Kueny, City Manager Planning Commission Actions of September 11, 1995 Paste 7 construction of the improvements. The improvements shall include concrete curb and gutter, sidewalk, street lights, traffic signal modifications, striping and signing, paving and any necessary transitions to the satisfaction of the City Engineer. All driveway locations shall be as shown on the approved site plan for CPD 90 -2 Major Modification No. 1 and as approved by the City Engineer and Director of Community Development. 10.
