It is late because there were other work priorities. Those priorities were the preparation of the Planning Commission Agenda packet (1/29 meeting), the City Council Monthly Report, the residential Downtown Survey, Colmer public hearing notice, and the Marketplace courtesy notice. 1- CALL TO ORDER 2. PUBLIC COMI] MNTS None 8. CONSENT CALENDAR None 9. PUBLIC HEARINGS b. Entitlement: Commercial Planned Development No. 95 -2 and Lot Line Adjustment No. 95 -4 Applicant: John Newton and Associates, 165 E. High Street, Moorpark Proposal: Replacement of the existing Mayflower Market with a 3,712 square foot building and to merge three adjacent existing parcels into one parcel. Location: 105 East High Street Staff Recommendation: Conditionally Approve At this point in the meeting Commissioner May excused herself from the dias due to a conflict of interest with the proposed project. Assistant Planner, Craig Malin gave the presentation. Mr. Malin commented that conditions 27, 30, 47, 86 -88 would be modified with replacement language to adapt to the project requirements. Commissioner Martens questioned staff if the project provided handicap parking. Staff replied that one handicap parking space was required and provided in the rear of the project development. Commissioner Miller wanted to know the type and the purpose of the fence and its eight -foot setback requirement. Staff said that the fence materials would City of Moorpark, 799 Moorpark Avenue. Its purpose is to replace the existing fence, (and later removed to expand the market) and that the materials be those to match the market building proposed. Staff mentioned that the applicant would be required to maintain the landscaping. The public hearing opened at 7:30 p.m. John Newton, 165 High Street, representing the applicant, addressed the Commission and gave his description of the proposed project. The public hearing closed at 7 :40 p.m.. Commissioner Acosta and Martens complimented staff and the applicant on the project proposed. Chairperson Torres mentioned that this project and project area would be ideal for mixed use zoning, as in a second story residence. MOTION: Chairperson Torres moved and Commissioner Martens seconded a motion to approve Resolution No. PC -96- 317 with modifications to condition numbers 27, 30, 47, 86 -88. Motion passed with a unanimous voice vote. a. Entitlement: Moorpark Country Club Estates Project (General Plan Amendment No. 94 -1, Zone Change No. 94 -1, Vesting Tentative Tract Map No. 4928, Residential Planned Development (RPD) Permit No. 94 -1, Conditional Use Permit (CUP) No. 94 -1, Parcel Map No. 94 -1 Location: The Project site is in the northern portion of the City, totals 655 acres, and has frontage on both walnut Canyon Road (State Route 23) to the east and Grimes Canyon Road to the west. The project site northerly boundary is also the northerly boundary for the City limits and is approximately 2,700 feet south of Broadway Road. ACT Steven Kueny, City Manager Planning Commission Actions of January 22, 1996 January 26, 1996 Page 4 Proposal: 225 -lot vesting tentative tract map 3 -lot parcel map for financing purposes 216 single- family dwelling units 2 18 -hole golf courses and related facilities including driving range and clubhouses, pro -shop, banquet facilities, bar, snack -bar, golf cart storage and maintenance buildings Public multi -use trail, park and equestrian staging area Existing General Plan Designation: Rural Low - 1 Dwelling Unit (DU) /5 Acres Proposed General Plan Designation: Rural High - 1 DU /1 Acre (residential units will be clustered onto approximately 202 acres of the total 655 acres) Existing Zoning: Rural Exclusive (RE) - 5 Acres Proposed Zoning: RPD -.35 DU /Acre Staff Recommendation: Continue the public hearing to January 29, 1996 Senior Planner, Debbie Traffenstedt gave the presentation. Paul Bollinger, 2820 Townsgaate Road, Westlake, as the applicant, addressed the Commission to inform them that his representatives were present to provide comments on the proposed project. He said that although a meeting was scheduled with staff on the day after the meeting, he had concerns regarding some of the conditions of approval. Commissioner Acosta responded to Mr. Bollinger and said that perhaps rather than commenting on the dispute of the conditions, staff and the applicant meet and return to the Commission with confirmed conditions. Joe Morreale, 5490 Lemonwood Drive, addressed the Commission by saying that he fully supported the proposed development and the greenbelt proposed to protect the existing rural area. ACT Steven Kueny, City Manager Planning Commission Actions of January 22, 1996 January 26, 1996 Paae 5 Commissioner Miller asks Mr. Morreale if he had any concerns with the massive grading that this project would undertake. Mr. Morreale said no. Patty Waters, 10865 Broadway, addressed the Commission and said she was overall supportive of the project proposed. She submitted a letter to staff that outlined her issues of farming, traffic and density of the residential units proposed. But she had a concern about accessing the driveways on those residential units. Commissioner Martens ask where Ms. Waters property was in relation to the Bollinger development. Chip Johnson, 5490 Lemonwood, addressed the Commission and said that he fully supported the development. Bob Haaland, 351 Rolling Oaks Drive, #200, Thousand Oaks, addressed the Commission with his concerns of the timing tied to the golf course construction. He said it was critical to have a spring 1997 opening. Commissioner Miller reiterated Mr. Haaland's intent to develop Phase I as two golf courses and the construction of "C" Street before the development of any residential homes. Mr. Haaland concurred. The Commission discussed and confirmed other issues of school facility fees, equestrian trails and Area of Contribution fees. At this point in the meeting the Commission concurred to continue the meeting to January 29, 1996. 10. DISCUSSION ITEMS The Director informed the Commission of the upcoming League of California Cities Conference. 11. ANNOUNCEMENTS or FUTURE AGENDA ITEMS None 12.
