HomeMy WebLinkAboutMIN 1984 0918 PC REGMoorpark, California September 18, 1984 The regular meeting of the Planning Commission of the City of Moorpark, CA. was called to order at 7:13 p.m.. All members were present with the exception of Commissioner Preito. Item 4 - PUBLIC COMMENTS There were no public comments. Item 5 - COMMISION COMMENTS There were no Commission comments. 6 - ZONE CHANCE NO—Z-2704; TENTATIVE TRACT MAP NO.'TR -3998: and Request to develop 31 acres into 139 single- family and one recreational lot. Following a presentation of the project by City staff and by Randy Richardson of the Ventura County Planning Division, testimony was received by, applicant's representative: Tom Zanic (Urban West Communities) 3030 S. Bundy Drive, Los Angeles, CA. The Commission reviewed the staff recommendations to require side and rear yard fencing, and to require the developer to form a Community Facilities District, along with the following issues: -- Water and�ewer improvements service. -- Location in parking for the recreation center. -- Timing of the improvement of the south half of Tierra Rajada Road. -- Roofing materials. -- Cutters and down spouting. -- Single or double dead bolt locks. -- Fencing for the recreation lot. -- Electric garage door openers. At the close of the public hearing and after Commission discussion, it was moved by Commissioner Miller to approve the recommended action on the subdivision incorporating the errata sheet and to follow the recommended action on the Planned Development permit and the Zone Change, with the following changes to the PD: - Condition No. 23 to be kept,requiring block wall on side and rear yard fencing. -- That the PD have conditions added to require single cylinder dead bolt locks and gutters on the front of the homes. -- The designation of parking on the street at the recreation center. -- To recommend to they council that a Community Facilities District be reviewed by the Council prior to imposing it. Also, it was indicated that compliance with Condition No. 5 of the tract map and Conditions 22, 23, of the PD had been made. The motion was seconded by Commissioner Weak and unanimously passed. -1- Moorpark, California September 18, 1984 Item 7 - APPEAL NO. 4 (Newhart) Appeal by the applicant of a Planning Commission decision regarding Condition>-, No. 45 and 48 of PD -992. Refered by City Council. Following a presentation by staff and Commission discussion, the public hearing was opened. The applicant was represented by: John M. Williamson (attorney) 5775 Los Angeles Avenue Suite 228, Simi Valley,CA. Mr Williamson indicated that applicant was withdrawing his appeal of Condition No. 45. He also took exception to the City Attorney's opinion that any planned development permit could have a time limits placed upon it. Commissioner Miller inquired to the length of time necessary to recover the capital investment involved with the project. Mr. Williamson indicated that 15 to 20 years were necessary. Commissioner Schleve indicated that a five year approval time period was necessary and that the use was not compatible with the area. A desire was expressed to have the City Attorney present for futher discussion. Commissioner Miller indicated that staff had orginally recommended a ten -year time period and that clearly a five -year limitation was not feasible. However, a time limit was needed approve the project and since one was not feasible, the application should be denied. It was indicated that there were other locations in the community more appropriate for this use. Commissioner Weak indicated that he felt the applicant had met the required ordinance findings. Chairman Hartley asked the applicant if a 15 -year time limit was acceptable. The applicant, Ed Newhart. responded that it would be. Following the close of the public hearing a motion was made by Commissioner Miller to deny the permit. The motion died for lack of a second. A motion was made by Commissioner Schleve to continue the item to the Commission's next meeting to discuss the re- design of the project and to consider a monitoring program. The motion died for lack of a second. A motion was then made by Commissioner Weak to recommend to the City Council that the five -year time limit be deleted. Chairman Hartley passed the gavel to Vice -chair Miller and seconded the motion. The motion failed 2 - 2. A motion was made by Commissioner Weak to continue the item to the following meeting in order to have the City Attorney present to more fully discuss the ramifications and parameters of the Commission's deliberation. The motion was seconded by Commissioner Schleve and adopted 3 - l,with Commissioner Miller dissenting. Item 8 - PD-980 (JANSS CORPORATION) Review of storefront signing criteria. The applicant was represented by Larry Cariganan ( Janss Corporation) 11075 Santa Monica B1., Los Angeles, CA. The proposed signing criteria was reviewed and comments made that letter styles should be included. It was indicated by Mr. Cariganan that the Janss Corporation was considering limiting the colors used on the signs and that all signs be -2- Moorpark, California September 18, 1984 Item 8 - PD-980 (JANSS'CORPORATION) cont. illuminated from one master switch. It was moved by Commissioner Weal to accept thesicp criteria with changes indicated and that letter styles be limited. The revised criteria to be returned for Commission review at the next meeting. The motion was seconded and adopted 4 - 0. Item 9 - STAFF COMMENTS There were no staff comments. Item 10 - ADJOURNMENT There being no further business before the Commission, Chairman Hartley adjourn the meeting at 12:24 a.m.. Chairman -3- Secretary
