HomeMy WebLinkAboutMIN 1985 0711 PC REGPLANNING COMMISSION City of Moorpark July 11, 1985 The regular meeting of the Planning Commission of the City of Moorpark, California, was held at City Hall of said City, located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting was call to order at 7:35 p.m., Chairman Holland presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Commission Hartley. 3. ROLL CALL PRESENT: Commissioners Jim Hartley, William LaPerch, Vice -Chair Jeffery Rosen, and Chairman Douglas Holland. ABSENT: Commissioner Tom Schleve. OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Steven Kueny, City Manager; Diane Eaton, Associate Planner; John Knipe, Assistant City Engineer; Mark Wessel, Traffic and Transportation; and Celia LaFleur, Administrative Secretary. 4. APPROVAL OF MINUTES - June 13, 1985 (continued from June 27, 1985) Continued to July 25, 1985 Planning Commission meeting. 5. PUBLIC COMMENTS 5.A. Mike Wedemeyer, owner /operator representing "Studebaker Services ", 52 West Los Angeles Avenue, Moorpark, addressed the Commission expressing concern regarding the processing and expediting of a Conditional Use Permit (CUP). City Manager Steve Kueny, responded, stating that Mr. Wedemeyer has talked with staff and a CUP is required for the relocation in the "M -1" Zone. Approximately 75 days would be required for processing; and that all fees had been paid. The Associate Planner commented that the 75 days are required for an environmental clearance from the other agencies, which the city is required to do under CEQA Guidelines. The City Zoning Ordinance requires the CUP be brought before the Planning Commission and the City Council for a public hearing. PLANNING COMMISSION City of Moorpark July 11, 1985 6. DEVELOPMENT PLAN PERMIT NO. PD -1010 (G.H. Palmer & Associates) Continued to July 25, 1985. 7, DEVELOPMENT PLAN PERMIT NO. DP -324 (F.E. Financial Ltd.) Continued from June 27, 1985. The applicant is requesting approval to construct an office and light industrial facility which would encompass 9,332 square feet. Proposed project is located approximately 450 feet north of Los Angeles Avenue and east of goldman Avenue. The Associate Planner addressed the concerns of the Commission and gave an overview of the circulation pattern along Goldman Avenue and Los Angeles Avenue. A color rendering was also presented the the Commission for review. Testimony was received from the following: Franz Wolf, Jr., representing F.E. Financial, 250 Easy Street, #5, Simi Valley, CA. 93065. Moved by Commissioner Rosen seconded by Chairman Holland and unanimously carried to approve additional Planning Condition to read and follow Condition No. 23. -- Condition No. 24 Prior to occupancy by tenant or subsequent owner that would employ or dispose of toxic or hazardous waste, a Major Modification shall be processed and filed. the Assistant City Engineer gave additional Conditions verbally and the applicant expressed agreement with the proposed conditions. Moved by Commissioner Hartley that Development Plan Permit No. DP -324 be approved as conditioned and that the resolution of approval be placed on the Consent Calendar for the next meeting. Motion seconded by Chairman Holland and carried unanimously. By general consent Items 8 & 9, Tentative Tract No. TR- 3525/RPD -941 & TR- 3019 /RPD /1021 (Warmington Homes) were combined for public hearing at this time. 8. TENTATIVE TRACT NO. TR -3525 & RESIDENTIAL PLANNED DEVELOPMENT NO. RPD -941 (Warmington Homes) Request approval of a 28.9 acre subdivision containing 87 single family lots and companion Residential Planned Development. Located adjacent and south of Williams Ranch Road (Peach Hill Rd.) and west and adjacent of Peach Hill Road. PLANNING COMMISSION City of Moorpark July 11, 1985 9. Tentative Tract No. TR -3019 & Residential Planned Development No. RPD -1021 Request approval of 39.5 acre subdivision containing 130 single family lots and a companion Residential Planned Development. Located adjacent and south of Williams Ranch Road (Peach Hill Rd.), and adjacent and east of the Southern California Edison Co.'s transmission line corridor. Testimony received by the following: Joel Silverman, representing the applicant, 20300 Ventura Bd. Woodland Hills, CA. Lee Newman, Consultant, 31320 Via Colinas, Westlake Village,CA. Bernardo Perez, 4237 Canorio Court, Moorpark, CA. 93021 Keil Kappock, 4214 Tecolote Court, Moorpark, CA. 93021 At the Planning Commission meeting of June 27, 1985 the Commission expressed concerns on the following: -- Schools - Requested a presentation from the Moorpark Unified School -- District regarding their Master Plan, and the timing of additional school facilities. -- Tierra Rejada Road - Review of requiring the road completed prior to or with the completion of the first dwelling units. -- Prohibiting the use of Peach Hill Road for construction traffic access. -- Cul -de -sac "A" Street of TR -3019 at Williams Ranch Road. To be reviewed by City Engineer and the Fire Department. Fire Depart- ment to be at next Planning Commission meeting. -- Consider having the Homeowners Association or the City be responsible for maintenance of natural hillside areas, as well as placing deed restrictions on the use of these areas. --Requiring landscaping for the existing Water Works No. 1 water tank. --Requiring front yards to be landscaped by the developer, at least along Williams Ranch Road. --Existing structures and major trees on both projects to be plotted /, --Review of possible private or public recreation facilities within the projects. PLANNING COMMISSION City of Moorpark July 11, 1985 --Review of the public or private use and historic value of existing structures. --Information on water tank access road, extent of improvements, who will maintain etc. --Recreation and Parks Commission to be requested to re- review their action regarding private recreational facilities and fees in -lieu. --Review of walls by the Planning Commission at a later date along Tierra Rejada Road for continuity. A conflicting comment was made about having wrought iron or other materials to avoid a "tunnel" appearance along the road. -- Consider blocking access to Tierra Rejada Road from "G" Court in Tract 3019. -- Consider 1 or 2 private recreational areas plus financial contribution in addition to Quimby Park funds. 1._ -- -- An interior circulation traffic ananlysis. -- Requiring improvements to Williams Ranch Road with first phase of either tract. -- Quantification of possible environmental impacts upon air quality and construction impacts such as fugitive dust and valley fever. -- Review of drainage effects from hillside areas and also on six adjacent lots on Williams Ranch Road. -- Consider a 4 - Way stop sign at "A" Street and Williams Ranch Road if "A" Street can not be cul- de- saced. -- Review of a financial contribution by the projects toward the improvement of Tierra Rejada Road bridge. -- Phase the project and infrastructure so that infrastructure is in place when dwelling units are completed. -- Consider deleting a sidewalk on Williams Ranch Road. Chairman Holland suggested that the Homes Owners Association responsibilities be extended to provide maintenance for the slope areas. PLANNING COMMISSION City of Moorprak July 11, 1985 By general consent this item is continued to August 8, 1985 to provide the Commission additional information as directed. 11. act No. 4069/4037 - Residential P NE22 -1L Review of subsequent use of the Final Environmental Impact Report for TR -2964 as the Environmental Document for the subject projects. Request approval of 16.84 acre single family subdivision containing 66 lots and a companion Residential Planned Development Subdivision to create one additional parcel. Site location is Southeast and adjacent to intersection of Moorpark Road and Peach Hill Road. Northwest corner of Moorpark Road and Peach Hill Road. Testimony presented by the following: Jerry Sloniker, 2800 28th Street, Santa Monica Eddie Ramseyer, 1881 Knoll Drive, Ventura, CA. Public review June 15, - July 15, 1985. The Planning Division is recommending that the EIR prepared for Tract 2964, which is located east of the project, should be used as the environmental document for the subject project. The document was determined to be appropriate because it adequately covers the environmental effects of the proposed project. The Commission expressed their concerns and directed staff and the applicant to provide the following: -- Site Plans -- Elevation Plans -- Rear and side yard setbacks -- landscape layout -- Design fencing -- Landscape along wall of Peach Hill Road -- Internal circulation -- School District response to bus turnouts Vice -Chair Rosen requested that the staff provide information of the three areas of contribution currently active in the City (Los Angeles Avenue, Tierra Rejada Road, Casey Rd. /Gabbert). Moved by Commissioner Hartley seconded by Vice -Chair Rosen and unamiously carried that this item be continued to the meeting of the Planning Com- mission of August 8, 1985, for consideration of additional concerns. PLANNING COMMISSION City of Moorpark July 11, 1985 10. HOUSING ELEMENT - Programs Presented by Sylvia Holstein, Consultant for Michael Brandman, 3140 Red Hill Ave., Suite 200 Coast Mesa, CA. 92626. Pursuant to the request from the Planning Commissioners at the workshop held on Thursday, June 20, 1985, the chart information was used in the presentation. The charts included Income & Housing Affordability; Comparison of the Regional Housing Allocation Model (RHAM) for both current and future housing needs; and, in response to a question regarding the current ethnic composition of the City of Moorpark, a chart of school population by race was provided to the Commission. It is anticipated that the draft Housing Element will be available for the next meeting of the Planning Commission. 13. COMMISSION POLICY - Continued from June 27, 1985. Continued discussion of an interm policy. Moved by Vice -Chair Rosen and seconded by Chairman Holland and unanmousily carried to adopt a policy that formalized approval (resolution) of development and planning projects be placed on Consent Calendar for final approval before submission to Council. The Commission expressed concern with the vacancy in the position of Director of Community Development. Chairman Holland suggested that a mortorium be placed on all future developments until the position is filled. City Manager responded that the position would be filled by late October of this year and that development could still proceed, since the city does contract for consultant services. Commission concerns: -- Cars parked along Moorpark Road (northeast side); parking time limits should be posted. -- Tractor at Gabbert /Goldman. Moved by Commissioner Hartley seconded by Commissioner LaPerch and unanimously carried that a Resolution of Commendation be presented to Niall S. Fritz, former Director of Community Development. Moved by Commissioner Hartley and seconded by Vice -Chair Rosen to refer recommendation to City Council that the matter regarding proposed amend - ment to the General Plan setting maximum /minimum area for Planned Comm- unity be referred to the Planning Commission for the Commissions input. Motion unanimously carried.
