1. CALL TO ORDER

The meeting was called to order at 7:22 p.m., Chairman Holland presiding.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Chairman Holland.
3. ROLL CALL
Present: Commissioners Jim Hartley, William LaPerch, Tom Schleve,
Vice Chairman Jeffery Rosen, and Chairman Douglas Holland.
Absent: None.
Other City Officials and Employees Present:
Steven Kueny, City Manager; Lt. Mike Brown, County Sheriff's
Department; John Knipe, Assistant City Engineer; Diane
Eaton, Associate Planner; and Celia LaFleur, Administrative
Secretary.
By general consent Item 4. was temporarily tabled.
Moved by Chairman Holland and second by Vice Chairman Rosen, and
unanimously carried that no new items shall be heard by the Commission
after 10:30 p.m.
4. APPROVAL OF MINUTES
Moved by Chairman Holland, second by commissiner Hartley and unimously
carried that the minutes of the regular meeting of June 13, 1985
be approved.
5. PROCLAMATIONS /COMMENDATIONS /SPECIAL PRESENTATIONS
A Resolution of Commendation - Niall Fritz
Chairman Holland read a Resolution of Commendation for Niall S.
Fritz, who had recently resigned from the position of Director of
Community Development with the City of Moorpark. The Resolution
of commendation had been signed by all members of the Planning Commission
and would be delivered to Mr. Fritz.

Moved by Chairman Holland seconded by Commissioner Hartley and unanimously
carried to approve the Resolution of Commendation.
6. PUBLIC COMMENTS
None.
7. CONSENT CALENDAR
A. DP -324 (F.E. Financial Ltd.) Approval oY Reso. No. PC -85 -46
Moved by Chairman Holland and seconded by Vice -Chair Rosen and unanimously
carried to adopt PC -85 -46 approving DP -324 subject to changes in and
addition of the following conditions.
Plannning Division Conditions:
-- Condition No. 5 That prior to the occupancy or change of
occupancy of this building by any tenant, either the owner
or prospective tenant shall file a modification application
for this permit. The purpose of the modification shall
determine if the proposed use is compatible with the existing
zoning and terms and conditions of this permit. Also,
that staff shall review proposed occupancy to determine
if the request will be a minor or major modification.
-- Condition No. 19 Roof design and construction shall include
a minimum 18" (inch) extension of the parapet wall above
the highest point of the roof.
-- Condition No. 23 That disposal of all potentially hazardous
wastes shall be by means approved by the Ventura County
Environmental Health Division, and to include State and
Federal agencies.
Additional Planning Condition to follow Condition No 23
-- Condition No. 24 Prior to occupancy by tenant or subsequent
owner that would employ or dispose of toxic or hazardous
waste a Major Modification shall be processed and filed.
City Engineer Conditions:
-- Condition No. 65 That prior to issuance of a zoning clearance
developer shall submit to the City of Moorpark for review and
approval, street improvement plans prepared by a registered
Civil Engineer; shall enter into an agreement with the City
of Moorpark to complete the improvements; and shall post
sufficient surety guaranteeing the construction of the
improvements.

-- Condition No. 65. (cont.)
The improvements shall include concrete curb and gutter, sidewalk,
street lights, striping and signing, and paving in accordance
with the Ventura County Road Standards. Applicable road
standard plates are as follows:
1. Driveway on Goldman Avenue shall be per Plate E -2 having
a total width of 30 feet.
2. Driveway on Tejada Street shall be per Plate E -2 having
a total width of 30 feet and modified to have a 10 foot
radius curb return.
-- Condition No. 73. Developer shall obtain access easements
from the property to the east and south of sufficient width
to allow for semi -truck traffic turning movements. Easements
for street improvements in Tejada Street shall be obtained
prior to the construction of said improvements.
By general consent Item 8.A. (Public hearing for DP -1010, G.H. Palmer
& Associates) was temporarily tabled the Commission considered Item 11.
11. Commission Comments
A. Highway 118 /Goldman
Commissioner Rosen presented his letter, dated July 15, 1985, expressing
his concerns regarding lack of highway improvements on Highway 118,
and proposed an effort to provide some measure of added safety along
Highway 118 i future development.
City Manager gave an overview regarding the Commission's concerns and stated
that a re- distribution of the "Proposed Design Engineering Agreement
Los Angeles Avenue Widening" may address the concerns of the Commission.
Testimony was received from the following:
Louise Rise - Lawson, Building Industry Association, 601 Daily
Drive, Camarillo.
Marc Annotti, 9010 Corbin Avenue, Northridge, CA. 91324.
Commissioner Rosen suggested that because of the continual growth in the
industrial area along Highway- 31-8 -, --and the traffic impact, circulation,
as well as impact on neighboring intersections, the Commission direct
staff to inform the City Council that the Planning Commission will not
favorably review any new applications for development on, or exiting
onto Highway 118.

City Manager reiterated that the Commission avail themselves of the
opportunity to review the plans for improvement on the Los Angeles
Avenue Widening project, which will encompass many private improvements
that would have been required or are now bonded. Also, widening could
be extended to additional properties. This information could be provided
by staff to the Commission at the Planning Commission meeting of
August 8th.
Moved by Chairman Holland and seconded by Commissioner Hartley to continue
this item. Motion unanimously carried.
Moved by Commissioner Hartley and seconded by Commissioner Schleve
for a two week continuance. Motion carried 3 - 1 - 1

11. B. Infrastructure Capacity Limits
The Commission discussed the matter of the infrastructure, as addressed
in Commissioner Rosen's letter in which he stated that the primary
difficulty which arises when considering applications, whether singly
or as a combined unit, is the sense of the cumulative impact upon the
development of the City. Concern was expressed that without a completed
General Plan and adequate data, approval of further developments can
not be made until the infrastructure capacity is more specifically
defined in the areas of traffic, circulation, sanitation, schools, and
water supply.
Testimony received from the following:
Louise Rice - Lawson, Building Industry Association, 601 Daly Drive,
Camarillo.
Greg Fowler, Waterworks District No. 1, 7150 Walnut Canyon,
Moorpark, CA. 93021.
Mr. Fowler presented the Commission a bar chart of Moorpark Sewer System,
(Wastewater Flow) for residential, commercial and industrial capacity,
showing existing "will serve ", "approved" and "proposed flow ".

Moved by Commissioner Hartley seconded by Commissioner Schleve that
the matter be continued for two weeks to provide Waterworks District
No. 1 totals for residential, commercial, and industrial projects to
establisha time frame to show capacity levels accurately. Motion carried
by the following roll call vote:
AYES: Commissioner Hartley, LaPerch, Schleve
Noes: None.
ABSTAING: Chairman Holland, Commissioner Rosen.
8. PUBLIC HEARINGS
A. Development Plan Permit No DP -1010 (G .H. Palmer)
The applicant is requesting construction of a 400 apartment
unit located at the southeast corner of Moorpark Avenue and
Los Angeles Avenue.
Presented by Frank Wein, Consultant, Michael Brandman Associates.
Mr. Wein addressed the Commission concerns to the Draft EIR in the
responses to the comments made by the Commission at their May 9, 1985
hearing. The action before the Planning Commission is to recommend
certification of the Final EIR.
Testimony was received by the following:
Dan Palmer, G.H. Palmer 7 Associates, 10952 Roebling Avenue,
Suite 52, Los Angeles, CA. 90024.
Mr. Palmer addressed the concerns of the Parks and Recreation Commission's
recommendations, as stated in the City Managers memo dated July 19,
1985. They read as follows:
-- Condition No. 2. Add barbeques to pool areas.
-- Condition No. 4. Add a fourth pool to be located in the area
south of Majestic court..
-- Conditions No. 5 Amended to read. Two (2) pools to be a minimum
of -20x 40 feet with spa facilities. At least one pool on
each side to have sufficient dept (9 feet) to permit spring
board diving.
-- Condition No. 6. Combine tennis court facility with currently
proposed basketball court. The combination court to be fenced
and lighted.
-- Condition No. 7. Add barbeques and picnic tables to compliment
the active play area.

-- Condition No. 8. Pathways, tot lots and pool areas to be fenced
and lighted to provide appropriate security.
-- Condition No. 9. Construct bicycle and equestrian trails along
the Arroyo Simi.
-- Condition No. 10. No access to buildings 4, 5 and 6 from Los
Angeles Avenue..
-- Condition No. 11. An appropriate setback from Los Angeles
Avenue for buildings 4,5 and 6. (the Parks & Recreation Commission
was concerned with the setback on the Regal project to the
east and is recommending a larger setback for this project.)
Mr. Palmer stated to the Commission that the Roos Legislatiory AB1151,
states "that if developer is willing to set aside 258 of the total
number of units in order to levels affordable to the local median income,
the City shall either give on of two options ;(1) a density bonus of
not less than 258(2) Bonuses greater than 258 are discretionary and
508 is the most common policy.
The City Manager stated that it was Parks and Recreation Commission':,
recommendation to apply Quimby Fees; that the Circulation
Element requires footbridge and trails be provided and that the only
question is whether recreation facilities provided by the developer
would be sufficient credit and whether or not Quimby Fees may or may
not apply. The Parks & Recreation Commission also recommended that
the developer provide half the cost of the footbridge, and the City
would have the option of requiring that they install the bridge and
would be reimbursed by future developers for } of the cost.

Moved by Commissioner Hartley seconded by Commissioner Rosen an
unanimously carried to continue this item to the meeting of August 1,
1985; also to supply the Commission with site and elevation plan, and
further discussion of Quimby Fees to be applied.
13. Adjournment
By general consent the meeting was adjourned to 7:00 p.m., August 1,
1985, the time being 11:50 p.m..
