CALL TO ORDER The meeting was called to order at 7:11 p.m., Vice - Chairman William LaPerch presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Commissioner LaPerch. 3. ROLL CALL PRESENT: Commissioners Dan Claffey, Jim Hartley, and Vice - Chairman William LaPerch; ABSENT: Chairman Douglas Holland, Commissioner Jim Keenan; OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Steven Kueny, City Manager; Richard Morton, Interim Director of Community Development; John Knipe, Assistant City Engineer; Diane Eaton, Associate Planner; Julie Hunt, Consultant for McClelland Engineers; Carl Rowley, Consultant for Hawks & Associates; Celia LaFleur, Administrative Secretary. 4. APPROVAL OF MINUTES None. 5. PUBLIC COMMENTS 5.A. John Galloway, 338 Sierra Avenue, Moorpark, addressed the Planning Commission on behalf of the residents in opposition to Development Plan Permit No. DP -1014. The concerns expressed were; traffic circulation; and drainage. Vice -Chairman William LaPerch commented that Mr. Galloway's concerns could be addressed at the public hearing of DP -1014 and that no further comments could be addressed at this time. 6. SPECIAL PRESENTATIONS A. Letter of Commendation - Debbie Ryono, Enterprise Newspaper. Vice - Chairman LaPerch read and presented to Debbie Ryono, reporter for the Enterprise Newspaper writing those events of the City of Moorpark since incorporation. STAFF REPORTS OF ACTION ITEMS A. Planned Development Permit No. PD -1010 (Palmer) Applicant is requesting approval of revised plan of 370 apartment units on 19.75 acres. PD- 1010 /LDM -3 is bound by Los Angeles Avenue (Highway 118) to the north, Moorpark Avenue to the west and the Arroyo Simi to the south. Moved by Commissioner Hartley seconded by Commissioner Claffey to continue this item to the next scheduled meeting of the Planning Commission, passed on a 3 - 0 vote. 8. PUBLIC HEARINGS H. Planned Development Permit No. PD -1014 (MacCleod Construction) To consider Draft EIR for PD- 1014 /PM -3920, and Planned Development Permit No. PD- 1014 /PM -3920. The division of the site into two parcels, with the southern portion of the site (south of the extension of Lassen Avenue) to be developed for commercial uses. The northern portion of the site (16.2 acres, gross) to be developed (proposed PD -1014/ PM -3920) with 316 apartment units. Moved by Commissioner Claffey seconded by Commissioner LaPerch that this item be postponed as requested by the applicant and taken off calendar until submittal of a new applicant could be presented. Motion passed on a 3 - 0 vote. D. Planned Development Permit No. PD -1048 (Co Applicant is requesting approval to construct a 9,325 square foot commercial retail center. No specific tenant. The proposed project is located on the northwest corner of High Street and Moorpark Avenue. Moved by Commissioner Hartley seconded by Commissioner Claffey to continue this item to the next scheduled meeting as requested by the applicant. Motion passed 3 - 0. C. Tentative Tract Permit No. TR -4170 Major Modification Residential Planned Development Permit No. RPD -857 Minor Modification, TR -4170 replaces TR -3070 (U.S. Approval of Major Modification to recorded tract map. C. improvements, lot configuration, and to building configuration. (Minor Modification approved August 13, 1985) Located north and adjacent to the intersection of Campus Park Drive and Princeton Avenue. Moved by Commissioner Claffey seconded by Commissioner Hartley to continue TR -4170 as requested by the applicant to the next scheduled meeting of the Planning Commission. Passed 3 - 0 vote. 7. CONSENT CALENDAR A. General Plan Amendment No. 85 -1, Tentative Tract Map No. 3963, Residential Planned Development No. RPD -1041 and Zone Chanae No. ZC -2801 ° An amendment to the Moorpark General Plan (Land Use Element) to redesignate approximately 253.7 acres from Rural High Density Residential 9one dwelling unit per acre) to Medium Low Density Residential 2.6 dwelling units per acre average); ° A zone change of the property from "R- E -lAc" (Rural Exclusive, one acre minimum) to "R- P- D -2DU" (Residential Planned Development, two dwelling units per acre); ° A tentative tract map to subdivide the property into 484 single family lots, 5 estate lots, and park and school sites; ° A residential planned development permit for the construction of the single family units; Approval of Resolution No. PC -85 -65 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, REGARDING THE APPLICATION OF GRIFFIN DEVELOPMENT COMPANY FOR GENERAL PLAN AMEND- MENT NO. GPA -85 -1, TENTATIVE TRACT NO. TR -3963, ZONE CHANGE NO. ZC -2801, AND PLANNED DEVELOPMENT PERMIT NO. PD- 1041. ASSESSORS PARCEL NOS. 500- 28- 87,- 89,- 09, -40, 500- 42 -27. Moved by Commissioner Hartley seconded by Commissioner Claffey for approval of Resolution No. PC- 85 -65, recommending approval of GPA -85 -1, subject to the following modifications and revised conditions. Passed unanimously. Page 4 of 9 PLANNING COMMISSION City of Moorpark November 14, 1985 7. A. GPA -85 -1 continued Paragraph four of page three Resolution No. PC -85 -65 to read as follows: 4. That Lots 1 through 5 (estate lots) shall be deleted and this area, in conjunction with Open Space Los 492 shall be redesignated on the Moorpark General Plan (Land Use Element) from "RH" (Rural High Density Resid- ential, one dwelling unit per acre) to "O -5 -1" (Open Space, 10 to 40 acres per dwelling unit), and rezoned from "R- E -lAc" (Rural Exclusive, one acre minimum lot size) to "0 -5 -10 Ac" (Open Space, ten acre minimum lot size). Tentative Tract Map No.3963 - Conditions: 22. That prior to recordation of the fina II and IV, the oil drilling easements shall be relocated to locations where fere with developed areas or streets, from the property, as approved by the Development. 1 map for Phases I, within those phases they will not inter - or shall be eliminated Director of Community 32.d.From just south of Benwood Drive to intersection with Campus Park Drive - shall be constructed to have (from west to east), a 10 foot parkway with a 5 foot sidewalk adjacent to the curb (existing), a 14 foot travel lane (southbound - through/ right), a 12 foot travel lane (through /left), a 10 foot left turn lane, two 12 foot travel lanes (northbound), a 5 foot bike lane, and a 6} foot parkway with a 5 foot sidewalk adjacent to the curb. 75. That all flag lots shown on the tentative map shall be deleted, unless replaced with non -flag lots. Planned Development Permit No. 1041 - Conditions 25. That two private recreational facilities shall be provided in the location shown on the tentative map (Parcels R -1 and R -2). These facilities shall be improved with a pool, jacuzzi, tot lot with play equipment, fencing (wrought iron and slump - stone), drinking fountains, barbeques, picnic tables, half -court basketball, an area partially enclosed (on two sides) with a solid roof, kitchen facilities including, but not limited to stovetop, double sink with disposal, drop -in oven and cupboards, and landscaped open space are. A third private recreational facility, to be landscaped only, shall be provided in the location shown on the tentative map (Parcel R -3). Prior to issuance of the first zone clearance for Phases IV (Parcels R -3 and R -2) and V )R -1), the developer shall Page 5 of 9 PLANNING COMMISSION City of Moorpark November 14, 1985 7. A. GPA 85 -1 continued. 25. submit to the Community Development Director a plan of the recreational facility within that phase for review and approval by the Parks and Recreation Commission. All landscaping and improvements on Parcel R -3 shall be com- pleted in conjunction with the improvement of the "E" Street/ Collins Drive intersection. Landscaping and improvements to Parcels R -2 shall be completed and the facilities available prior to occupancy of the 299th unit and 409th unit, respect- ively. 40. That pedestrian /bicycle trails shall be provided within the open space areas. Prior to issuance of the first zone clearance for each phase, three sets of a landscaping plan showing the location of the trails within the phase shall be submitted to the Planning Director for review and approval by the Parks and Recreation and Planning Commission. The Sheriff's Department shall also review the proposed location of the trail system. Installation of the trails shall be completed prior to the issuance of the last certificate of occupancy for the affected phase. B. Residential Planned Development Permit No. RPD -851 Major Modification to Residential Planned Development Permit ] relating to model home sales complex, change of models (elevation and floor plans) and Conditions of permit. The developer is requesting modification to a Residential Planned Development Permit originally approved by Ventura County and subsequently ratified by the City Council of the City of Moorpark by Resolution No. 83 -50. Approval of Resolution No. PC -85 -66 A RESOLUTION OF THE PLANING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING APPROVAL OF MODIFIED CONDITIONS TO CITY COUNCIL RESOLUTION NO. 83 -50, ON APPLICATION FILED BY (PACIFIC &) PARDEE. ASSESSOR PARCEL NO. 517- 16 -09. Testimony received by the following: Mary Gayle, Counsel for Pardee Construction Company, 350 N. Lantana St., Suite 217, Camarillo, CA. 93010. Mary Gayle in support of RPD -851 presented the Commission with a letter requesting postponement of modifications; by general consent it was moved by Commissioner Hartley seconded by Commissioner Claffey that Page 6 of 9 PLANNING COMMISSION City of Moorpark November 14, 1985 7. CONSENT CALENDAR B. Residential Planned Development Permit No. RPD -1 the hand delivered letter would not be accepted for consideration on RPD -851. Moved by Commissioner Hartley seconded by Commissioner LaPerch for approval of RPD -851 Major Modification as presented. Motion passed 2 - 1, Commissioner Cla£fey abstaining. 8. PUBLIC HEARINGS: A. Planned Development Permit No. PD -1047 (Anthony Annotti) The applicant is requestion approval to construct a 9,370 square foot neighborhood shopping center. No specific tenant has been identified. Located at the southwest intersection of Park Lane and Los Angeles Avenue. the site fronts on Los Angeles Avenue. Continued from October 24, 1985. Testimony received by the following: H.E. Spencer, c/o Park Lane I, Ltd., 6355 Topanga Canyon, #428, Woodland Hills, CA. Marc Annotti, 9010 Corbin Avenue, Northridge, CA.91324 Mr. Spencer spoke having no opposition to the project; stated he did not receive notice of hearing, but that he had ascertained information that address shown on assessors roll was not current. B. Planned Development Permit No. PD -966 (Mash Associates) Approval to construct a neighborhood shopping center containing 55,280 square feet of retail and office space. The principal structure will contain 46,280 square feet. The balance of the 55280 square feet will be assigned to financial structure and two food establishments. Continued from October 10, 1985. By general consent condition #17 page 10 to read as follows: "Developer shall post appropriate signs to prohibit left turns out of the driveway fronting New Los Angeles Ave. (Highway 23)." Moved by Commissioner Hartley seconded by Commissioner Claffey for approval of PD -966 as amended. Motion passed on a 3 - 0 vote. E. Lot Division (Moorpark) Permit No. LDM -7 (Gershenberg) To divide a 11.95 acre parcel into approximately two equal parts. Located on the north side of Los Angeles Avenue approximately 3600 feet west of Gabbert Road. Development Plan Permit No. DP -302 was approved on the eastern half. Testimony received by the following: Steven D. Perlman, 5528 Everglades St. Suite A, Ventura, 93003, in support of PD -966. Jerry Gershenberg, applicant. Moved by Commissioner Hartley seconded by Commissioner Claffey to delete City Engineer conditions numbered 32 & 33 and approve lot split as modified. Motion passed unanimously on a 3 - 0 vote. F. Tentative Tract Map Permit No. TR -4081 (Chadwick) Applicant is requesting approval to subdivide a 111 acre parcel into 21 home sites, each containing 5 acres or more. Located approximately 5,000 feet north of Los Angeles Avenue,adjacent and east of Grimes Canyon Road. The tract is adjacent to the most westerly boundary of the City of Moorpark. Moved by Commissioner LaPerch seconded by Commissioner Claffey for approval of TR -4081 as presented. Motion passed on a 3 - 0 vote. G. Development Plan Permit No. DP -325 (NHD Partners) The applicant is requesting approval to construct industrial facilities - three structures - containing approximately 33,360 square feet. Located generally east of Moorpark Road, south and adjacent to Flinn Avenue. The site is rectangular in shape. The eastern boundary of the site is the Arroyo Simi. Moved by Commissioner Hartley seconded by Commissioner LaPerch that the Planning Commission recommend to the City Council "that traffic control at the intersection of Flinn and Moorpark Road be considered in the annual review of the Five Year Capital Improvement Plan." Moved by Commissioner Claffey seconded by Commissioner Hartley for approval of DP -325 as presented. I. Amendment No. A -85 -3 Amendment to Zoning Ordinance Changes to industrial setback requirements (Article 23) and to parking and loading and unloading space require- ments (Article 41).
