January 8, 1986
The regular meeting of the Planning Commission of the City of
Moorpark, California, was held at City Hall of said City, located
at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:00 p.m., Chairman Douglas
Holland presiding.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by chairman Holland.
3. ROLL CALL
PRESENT: Commissioners Dan Claffey, Jim Hartley, Douglas Holland,
Jim Keenan, and William LaPerch;
ABSENT: None;

REORGANIZATION OF THE COMMISSION
Remarks of outaoina Chairman
Chairman Douglas Holland stated that it had been a pleasure serving
on the Planning Commission during the past year and commended
Richard Morton for his services as Interim Director of Community
Development.
Nomination and Selection o€ Chairman
Moved by Commissioner Hartley seconded by Commissioner Holland
for the nomination of William LaPerch as Chairman. Motion passed
unanimously.

Chairman William LaPerch presiding. Nominations for Vice - Chairman
opened. Moved by Commissioner Hartley seconded by Commissioner
Keenan for the nomination of Commissioner Dan Claffey as Vice- Chair-
man. Motion passed unanimously.
Chairman LaPerch by general consent call for a five minute recess.
4. PUBLIC COMMENTS
John Newton representing Asadurian Construction Company requesting
that the Commission consider improvements to property owners request
for a boardwalk fronting 95 E. High Street. No specification had been
considered at this time to the concerns of maintenance & liability.
Moved by Commissioner Keenan seconded by Commissioner Holland to
request that staff prepare a report and submit it to the Planning
Commission meeting of February 12, 1986 to include the following
information:
• Liability
• Maintenance of the boardwalk
• Adjoining property owners.
• City Engineer Conditions
• Materials
° Methods of installation and drainage.
5. COMMISSION ACTION ITEMS
A. Use of "Net" vs "Gross" Area In Determining Density
Presented by Mr. Morton and after extensive discussion testimony received
by the following in opposition to the use of "Net" area in determining
density.

Phil Vein, representing U.S. Condominium, P.O. Box 276, Moorpark,

Moved by Commissioner Holland seconded by Commissioner Keenan to
recommend to City Council to continue gross acreage. Motion passed
4 - 0 - 1, Commissioner Hartley, NO.

By general consent Item 5.B continued to the next regularly scheduled

6. PUBLIC HEARINGS
A. Conditional Use Permit No. CUP -4502 (Sun Exploration &
Production Company)
Applicant is requesting approval of conditional use permit
to drill one (1) exploratory oil well. Located 6,000 feet
southwest of the intersection of Los Angeles Avenue and
College View Avenue.
Presented by Frank Wein, presentation by Stan Bolsen, representing
Sun Exploration. Public testimony received in opposition to the
development was received by the following:

Moved by Commissioner Keenan seconded by Commissioner Holland to recommend
to City Council denial of Conditional Use Permit No. CUP -4502.
Conditional Use Permit No. CUP -4502 does not meet the proposed findings.
Motion passed unanimously.
B. General Plan
No. 85 -2 and
General Plan Amendment 85 -2 is comprised of two componets;
the first is a request for a land use change from Light
Industrial to General Commercial (Caren) and the second is
a request for the conversion of property designated for
residential to light industrial uses (Carlsberg). The
applicants are also requesting companion zone changes to
rezone the properties consistent with the proposed land use
designations. An Environmental Impact Report which addresses
the potential project- specific and cumulative environmental
impacts of both components was prepared and reviewed.

Moved by Commissioner Hartley, seconded By Commissioner Holland to
continue Item 6.B to the next scheduled meeting (1/15/86).
Motion passed 4 - 1, Commissioner Claffey, NO.
C. Amendment No. A -85 -3 Amendment to the zoning Ordinance
Changes to industrial setback requirements (Article 23) and
to parking and loading and unloading space requirements.
Presented by Richard Morton, and after extensive discussion the following
motion was made:
Moved by Commissioner Holland seconded by Commissioner Keenan to
recommend to the City Council approval of the amended Industrial
Setback requirements to the Zoning Code of the City of Moorpark.
Motion passed 4 - 1, Commissioner Claffey abstain. Amendments are
as follows:
A. That the setbacks in industrial zones be as follows:
Major Streets - (Los Angeles Avenue, Moorpark Road,
Gabbert Road, Poindexter Avenue)
Front - 30 feet
Side - 20 feet
All Other Streets
Front - 20 feet
Side - 10 feet
Side & Rear Yard
30 feet one side - side and rear can be zero except
adjacent to residential or a public use.
Moved by Commissioner Keenan second by Commissioner LaPerch to continue
Item 6.C. re Parking loading and unloading requirements to the regularly
scheduled Planning Commission meeting of January 22,'1986. Motion
passed unanimously.

Moved by Commissioner Holland seconded by Commissioner Keenan to
continue this item until such study re Gisler Field is completed.

6. PUBLIC HEARINGS
D. Zone Change No. ZC -2807, Vesting Tentative TRACT No. TR -4140
& Residential Planned Development Permit No_ RPn -1052 mrhan
The applicant is requesting approval of the following:
1) Zone Change No. 2807 to rezone a 56.19 acre parcel from
the "PC" (Planned Community) to the "RPD- 3.65U" (Residential
Planned Development 3.65 Units to the Acre) Zone;
2) Vesting Tentative Tract Map No. 4140 to subdivide a 56.19
acre site into 205 lots (203 homesites, 2 recreation
lots) and;
3) Residential Planned Development Permit No. 1052 to
construct 203 single family homes and two neighborhood
recreation complexes.
E. Zone Change No. ZC -2808, Vesting Tentative Tract No. TR -4141
& Residential Planned Development No. RPD -1053 (Urban West
1) Zone Change No. 2808 to rezone a 54.3 acre parcel from the
"PC" (Planned Community) to the "RPD -5U" (Residential
Planned Development 5 Units to the Acre) zone;
2) Vesting Tentative Tract Map No. 4141 to subdivide a 54.3
site into 234 lots (231 homesites, 2 recreation lots and
one park site, South Village Park) and;
3) Residential Planned Development Permit No. 1053 to construct
231 single family homes and two neighborhood recreation
complexes.

The applicant is requesting approval of the following:
1) Zone Change No. 2809 to rezone a 128.8 acre parcel from
the "PC" (Planned Community) to the "RPD -2.2U" (Resident-
ial Planned Development 2.2 Units to the Acre) zone;
2) Vesting Tentative Tract Map No. 4142 to subdivide a
151.5 acre site into 286 lots (283 homesites, 2 recreat-
ion lots and a lot reserved for future high density
residential development) and;
3) Residential Planned Development permit No. 1054 to
construct 283 single family homes and two neighborhood
recreation complexes.
By general consent items 6.D.E. & F. heard as one item.
Presented by Randy Richardson, and after extensive discussion this item
opened to public testimony:
Mr. Eugene V. Iwach, 923 Larker Avenue, Los Angeles, CA. 90042,
spoke -in opposition to the development (reference letter dated
12/17/85 addressed to the Director of Community Development).

Moved by Commissioner Holland seconded by Commissioner Keenan that
modifications be made to TR -4142, they read as follows:
"Approve the waiver of the required lot dept /width ratio
due to topography ".
"Final location of private recreation areas shall be as determined
by the Director of Community Development ". "Tentative Tract Map
No. TR -4142, one of the three private recreational areas shall
be approximately located at lots 266 or 280 ".
"Major slopes within Tentative Tract Map No. TR -4142 are to
be designated for ownership and maintenance by the Home Owners
Association ". "Slopes in excess of 208 which shall be determined
by the Director of Community Development prior to recordation
of the final map, are regarded as major slopes ".
Motion passed unanimously.
