California Page 1 Minutes of February 12, 1986 The regular meeting of the Planning Commission was held on February 12, 1986 in the City Council Chambers located at 799 Moorpark Avenue, Moorpark, California 93021. 1. CALL TO ORDER The meeting was called to order at 7 :00 p.m. by Chairman Willian LaPerch. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chairman LaPerch. 3. ROLL CALL PRESENT: Commissioners Dan Claffey, Jim Hartley, Douglas Holland, and Chairman William LaPerch. ABSENT: Jim Keenan (excused). OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Steven Kueny, City Manager; John Knipe, Assistant City Engineer; Diane Eaton, Associate Planner; Steve Rodriguez, consultant, McClelland Engineers; Frank Wein, consultant, Michael Brandman Associates; and Celia LaFleur, Administrative Secretary. 4. A. Amendment No. A -85 -3 Amendment to the Zoning Ordinance Changes to industrial setback requirements (Article 23) and to parking and loading and unloading space requirements (Article 41). RESOLUTION NO. PC -86 -90 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING TO THE CITY COUNCIL OR SAID CITY THAT THE ZONING CODE OF SAID CITY BE AMENDED IN VARIOUS PARTICULARS RELATING TO CHANGES TO INDUSTRIAL SETBACK REQUIREMENTS (ARTICLE 23) AND TO PARKING, LOADING /UNLOADING SPACE REQUIREMENTS (ARTICLE 41). It was the general consensus of the Commission to continued Item 6.A. to the Commissions meeting of February 26, 1986. Staff was directed to modify setback requirement for "M -1" and "M -2" zone (i.e. for each additional foot in elevation one additional foot in setback required. B. Motion passed on a 4:0 vote. 7. COMMISSION ACTION ITEMS A. Decision Makina Resolution RESOLUTION NO. PC- 86 -81. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING TO THE CITY COUNCIL ADOPTION OF A RESOLUTION REGARDING THE PERFORMANCE OF CERTAIN PERMIT APPROVAL PROCESSES BY CERTAIN CITY OFFICIALS. MOTION: Moved by Commission Holland, seconded by Commission Claffey to approve Resolution No. PC- 86 -81. The applicant is requesting approval to construct an industrial facility - 4 structures containing; a) 20,720 sq.ft.; b) 13,780 sq.ft.; c) 10,736 sq.ft.; d) 20,720 sq.ft. The proposed project is located on Commerce 400 feet south of Poindexter Avenue. Staff report presented by the Associate Planner. City Engineer addressed the Commission with an amendment to City Engineer Condition No. 3 to read as follows: That prior to zone clearance, the developer shall submit to the City of Moorpark for review and approval, street improvement plans prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvements; and shall post sufficient surety guaranteeing the construction of the improvements. The improvements shall include concrete curb and gutter, sidewalk, street lights, striping and signing, and paving in accordance with the Ventura County Road Standards. The applicable Road Standard Plates are as follows: Driveways per Ventura County Standard Plate E -2 modified to 10 feet radius curb returns, 30 feet width. Public hearing opened. The applicant spoke in support of the project and concurred with staff recommended conditions. MOTION: Moved by Commissioner Holland, seconded by Commissioner Claffey to approve DP -321 as conditioned, and to recommend to the City Council. approval of DP -322 and DP- 323. m12Feb86 r-- Motion passed on a 4:0 vote. AN P1a_nnng Commission, City of Moorpark, California Minutes of February 12, 1986 Page 5 Request to amend the Land Use Element of the General Plan from "M -L" Residential Medium Low Density, 2.6 du /ac average)., and "C -2" (General Commercial) to "H" (Residential High Density, 7 du /ac average); amend the Circulation Element of the General Plan to delete a bike path and equestrian trail located on the project site, adjacent to the Arroyo Simi; change the existing zoning from "R -1 -13" (Single Family Residential, 13,000 square feet minimum lot size), and "CPD" (Commercial Planned Development, 7 du /ac; create a 62 lot residential subdivision; and construct 62 single family homes for households with very low and low incomes. The applicant is also requesting approval of a project density bonus and the waiver of development standards as permitted by State law for low income housing projects. Located south of Los Angeles Avenue, east of Liberty Bell Road, north and adjacent to the Arroyo Simi. Presented by Steve Rodriguez, Consultant. Staff report dated February 12, 1986. In support of the project. m12Feb86 Plannina Commission, City of Moorpark, California Page 6 Minutes of February 12, 1986 MOTION: Moved by Commissioner Holland, seconded by Commissioner Claffey, to direct staff to prepare a resolution recommending to the City Council that the proposed project will not have a significant effect on the environment and that this body has reviewed and considered the information contained int he Mitigated Negative Declaration and approved the Mitigated Negative Declaration as having been completed in compliance with State CEQA Guidelines. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Holland, seconded by Commissioner Claffey to recommend to the City Council approval of amending the Land Use Element of the General Plan from "M -L" (Residential: Medium Los Density, 2.6 units per acre average) and "C -2" (General Commercial) to "H" (Residential): High Density, (7 units per acre average). Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Holland, seconded by Commissioner Claffey to recommend to the City Council in lieu of amending the Circulation Element of the General Plan pertaining to the deletion of an equestrian trail and bike path on the project site adjacent to the Arroyo Simi, that in conjunction with recordation, the applicant shall offer to dedicate on the Final Map to the City of Moorpark, and easement for the possible future installation of the bike path and equestrian trail as shown on the Circulation Element. There shall be no requirement to install the path and trail improvements at this time; however, the applicant shall record with the deeds of the properties of the subdivision a covenant waiving the right of future home buyers to protest the formation of an assessment district to finance the installation of the equestrian trail and bike path. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Holland, seconded by Commissioner Claffey to recommend to the City Council approval of Tentative Tract Map No. 4147 to subdivide the project site into 62 single family lots subject to the recommended conditions. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Holland, seconded by Commissioner Claffey to recommend to the City Council approval of Residential Planned Development for 62 single family homes for very -low and low- income. The applicant shall designate twenty percent of the project (12 units) which will be reserved for households with very -low and low, incomes, as defined by the Department of Housing and Urban Development, for a period of ten years. These specified units shall be reserved through the application of a deed restriction. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Hartley, seconded by Chairman LaPerch that said deed restriction shall not bind the mortgage holder of the property in the event the mortgage holder reacquires the property. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Hartley, seconded by Commissioner Claffey to recommend to the City Council approval that either prior to the recordation of the Final Tract Map, or the issuance of a building permit, the applicant shall deposit with the City of Moorpark a contribution for the Los Angeles Avenue Improvement Area of Contribution. m12Feb86 r- Planning Commission. California Page 8 Minutes of February 12, 1986 The actual deposit shall be the then current Los Angeles Avenue Improvement Area of Contribution applicable rate at the time the Final Map records or the building permit is issued. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Claffey, seconded by Commission Hartley to recommend to the City Council approval that the reduction in required garage size be accepted, and to approve the waiver of the required lot depth /width ratio due to project design constraints. Motion passed on a 4:0 vote. MOTION: Commissioner Holland, seconded by Claffey that the City Council approve the standard City Engineer condition ( #37) as modified. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Hartley, seconded by Commissioner Claffey that the City Council approve that maintenance of the recreation area and facilities shall be provided by the City Assessment District 85 -1. ninety percent of the cost of the maintenance shall be borne by the homeowners of Tract 4147. This maintenance assessment shall be paid in addition to the required City wide park maintenance assessment. Homeowner participation in the maintenance of the recreation area is encouraged to reduce the amount of the assessment required. The remaining ten percent of the maintenance costs shall be borne by the City of Moorpark and financed with funds from Assessment District 85 -1. That prior to acceptance of the recreation area facilities by the City for maintenance purposes, the applicant shall be responsible for the maintenance of the park to City standards for a period of one year. The ratio of the 10$/908 split in maintenance responsibility shall be reviewed by the City Council on an annual basis. Motion passed on a 4 :0 vote. ml2Feb86 Planning Commission. City of Moorpark. California Page 9 Minutes of February 12, 1986 MOTION: Moved by Commissioner Claffey, seconded by Commissioner Hartley to recommend that the City Council approve that prior to issuance of the first zone clearance, the developer shall submit a plan showing fencing along the side and rear yards of each residential lot. Said fencing plan shall identify the location and materials to be used (wrought iron, plasters, wood, slumpstone, etc. ) Said fencing shall consist of a concrete base and a wooden design of the fence to be approved by the Planning Commission. Said fencing shall be completed prior to the issuance of a certificate of occupancy for the affected lot. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Holland, seconded by Commissioner Claffey to recommend to the City Council that prior to the recordation of the Final Tract Map, the applicant shall submit to the City Manager for review and approval, Conditions, covenants and Restrictions (CC &R's) for the proposed subdivision. Said CC &R's shall set maintenance standards for all properties contained within the subdivision, and shall be enforced by the City. Subsequent to approval by the City Manager, said CC &R's shall be recorded. Motion passed on a 4:0 vote. MOTION: Moved by Commissioner Holland, Claffey to recommend to the City 85 -4 with revised conditions prepare a resolution for consen regular meeting of February 26, Motion passed on a 4:0 vote. C. Housing Element - Final Draft seconded by Commissioner Council approval of GPA- and directed staff to t calendar at their next 1990. For the purpose of considerin approval of the final draft of the Housing Element of the General Plan. MOTION: Moved by Commissioner Holland, seconded by Commissioner Hartley to adjourn Items 8.c.
