April 23, 1986
The regulary scheduled meeting of the Planning Commission of the City of Moorpark,
California, was held in the Council Chambers of said City, located at 799 Moorpark
Avenue, Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:01 p.m., Chairman william LaPerch presiding.
2. PLEDGE OF ALLEGIANCE
The Pledege of Allegiance was led by Chairman LaPerch.
3. ROLL CALL
PRESENT: Chairman William LaPerch,
Him Hartley and Jim Keenan
at 7:28 p.m..
ABSENT: None;
Vice - Chairman Dan Claffey, Commisisoners
. Commissioner Douglas Holland arrived
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Steven Kueny, City Manager;
Richard Morton, Director of Community Development;
John Knipe, Assistant City Engineer;
Diane Eaton, Associate Planner;
and Celia LaFleur, Administrative Secretary.
4. PUBLIC COMMENTS
The following persons spoke in opposition. to Item 6.B. and during their public
comment they were informed by the Chairman that any comments regarding Item
6.B. would have to be heard during the public hearing which was scheduled
later in the agenda. The Director then informed the Chairman that this item
would be continued and renoticed for public hearing at a later date.

5. SPECIAL PRESENTATIONS
Bruce Smith, Supervisor, RMA, General Planning, County of Ventura.
Steve Wood, Associate Planner, RMA, General Planning, County of Ventura
To discuss the Air quality Management Plan and 208 Water Quality Plan.
Bruce Smith gave a brief history of the process of Regional Planning, and how
they were formally incorporated into each of the respective plans (Air Quality
Management Plan and 208 Water Quality Plan)

Steve Wood gave his presentation and history of the Population Forecast, which
first began in 1975 and was adopted in 1978. In his presentation he informed the
Commission that two citizen representatives from each city, public and private
interest groups are appointed as a Sub - Committee and make their recommendations
to the County -Wide Planning Committees. Once a Draft has been prepared, it is
then sent on to each of the cities and presented to their City Council. The most
recent Population Forecast was adopted by the Board of Supervisors in May 1985.
Mr. Wood continued to inform the Commission of the factors considered for the
approved Population Forecast, they were as follows:
Previous Forecast
° Building completion activity since the 1980 Census.
° The General Plan holding capacity to provide the number of dwelling
units that could be accommodated on the land based on each cities
adopted General Plan.
Mr. Smith proceeded with his explanation of the current Air Quality Management Plan,
and the three different types of subject areas, as follows:
° Population dwelling unit projection.
° Industrial sources.
Transposition formation.
The Federal Mandate does not specify that all growth should be eliminated simply
to meet the Air Quality standards. The Federal Law states that each of the cities
must do all they possibly can to achieve clean air quality.
Chairman LaPerch questioned Mr. Smith, could the Commission advise the City
Council that the Population Forecast figures are advisory and are forecast and that
the City could set limits under no penalty by County -Wide Planning.
6. PUBLIC HEARINGS
A. Planned Development Plan Permit No PD -1055 (Robert Feller /Vince Didio)
Requesting approval of a Planned Development to construct a 13,160
square foot facility and also requesting medical office use of 4,200
square feet, combination office and commercial building. Located
east side of Moorpark Avenue approximately halfway between Los Angeles
Avenue and Third Street.

A. Planned Development Plan Permit No. PD -1055 (Robert Feller /Vince Didio)
The Director of Community Development presented his staff report of the revised
development dated April 23, 1986. After extensive discussion the Commission
reached its decision in the matter and recommended the following modifications:
° Condition No. 3 (Planning Department Condition)
That the second floor is limited to office use only, except that
medical offices are permitted only to the extent that parking for
such use is provided on a one space for 200 square feet of Gross Floor
"Area (GFA) basis.
° Condition No. 22 (Planning Department Condition)
That the "hammer- hear" turn -a -round as shown on the plan be clearly
identified as "no parking:or stopping ".
° Condition No. 23 Planning Department Condition)
That the north parking lot be designated for employee parking only.
° Condition No. 2 (Planning Department Condition)
That restaurants or other food facilities will be allowed only when
meeting the parking requirement for such uses.
° Condition No. 24 (Planning Department Condition)
That prior to occupancy the applicant shall request the City to enforce
appropriate vehicle codes on subject property as permitted by Vehicle
Code Section 21107.7.
Moved by Commissioner Holland, seconded by Commissioner Keenan for approval of
Planned Development Permit No. PD -1055 as modified. Motion passed unanimously.
Moved by Commissioner Holland, seconded by Commissioner Hartley to modify Condition
No. 3 and add Condition No. 22 as recommended by staff. Motion passed unanimously.
Moved by Commissioner Holland, seconded by Commissioner Hartley for approval of
Condition No. 23 as recommended by staff. Motion passed unanimously.
Moved by Commissioner Hartley, seconded by Commissioner Holland to approve condition
number 24 as recommended by staff. Motion passed unanimously.
Moved by Commissioner Holland, seconded by Commissioner Keenan to approve PD -1055
subject to modified conditions. Motion passed unanimously.

A. Planned Development Permit No. PD -1055 (Robert Feller /Vince Didio)
Moved by Commissioner Holland, seconded by Commissioner Keenan to waive consent
calendar for approval of resolution. Motion passed unanimously.
B. Play Field Lighting of Peach Hill Park
The City of Moorpark to certify the Environmental document and
approve the Mitigated Negative Declaration.
By general consent Item 6.B. to be continued and re- noticed for public hearing
in order that staff resubmit the Environmental Document for this item.
C. Changes to the General Plan and Zoning Ordinance
To consider changes to the Land Use Element of the General Plan
and of the Zoning Ordinance to: 1) make more explicit, and to
clarify, that maximum density as authorized by the General Plan
and Zoning Ordinance is not an automatic right, but depends upon
!- the property and the design of the project; 2) authorize "density
averaging" in the "Rural" zones subject to certain restrictions;
3) to add the zoning classification. of "CO" (Commercial Office),
"CH" (Commercial Highway), "CPD" (Commercial Planned Development),
and "PC" (Planned Community) to various charts in the Land Use
Element of the General Plan.
The Director of Community Development presented his staff report dated
April 23, 1986, and after extensive discussion the Planning Commission
was unanimously infavor of all the proposed changes exception to the issue
of density averaging. The minority of the Commission was concerned over changing
what has "worked" (maximum density as authorized by the GP) and the majority feel-
ing that the density averaging allowed the Commission and City Council flexibility
in looking at alternatives which could preserve an environmental habitat or provide
for recreational facilities or could reduce the amount of grading required.
Moved by Commissioner Holland, seconded by Commissioner Claffey and by unanimous
vote it was moved that this item be tabled and heard later in the agenda.
D. Amendment to the Land Use Element
To consider adding the words "requires approval of a Specific Plan"
to the "Residential Low Density" of the Land Use Element of the
General Plan on that property bounded on the north by the Arroyo
simi and New Los Angeles Avenue on the west by Moorpark Road, on
the south by Tierra Rejada Road, and on the east by the Highway
23 Freeway.

D. Amendment to the Land Use Element
The Director of Community Development presented his staff report dated April
23, 1986. After review and consideration of the information contained
therein, public testimony was received in support by the following:
Mr. Glen Gessford, Representing Carlsberg Development Company, 2800 Twenty -
Eighth Street, Santa Monica, CA. 90405.
Mr. Gessford stated that they were willing to advance the money for the Specific
Plan but objected to so designating the property on the Land Use Map, since this
removed the option of developing the property, or a portion thereof, at the exist-
ing Residential zoning without the adoption of the Specific Plan.
The Commission felt however, that the property should be so designate and it was
moved by Commissioner Holland, seconded by Commissioner claffey to approve Item 6.D
Amendment to the Land Use Element which would require approval a a Specific Plan
and be combined with a General plan Amendment hearing.
Motion passed unanimously.
Moved by Commission Holland, seconded by Commissioner Claffey that Item 6.C.
be continued for hearing.
6. C. Changes to the General Plan and Zoning Ordinance
The Director proceeded with his staff report and by general consensus of the Commission,
with the majority vote that staff provide a resolution of staff recommended changes
to the General Plan and Zoning Ordinance. This resolution to be presented at the
Planning Commission's meeting of May 14, 1986.
7. INFORMATIONAL ITEMS
A. Capital Improvement Program
By general consent this item continued to April 30, 1986 at 7:00 p.m. for further
discussion to be provided at the joint meeting of the City Council and Planning
Commission.
B. Request for Proposals - city of Moorpark Downtown Plan
The City Manager referred to his memo to the Commission dated April 18, 1986,
requesting comments from the Planning Commission,. Suggestion of the Commission
are as follows:

B. Request for Proposals - City of Moorpark Downtown Plan (continued)
Discussion of alternative mechanism, including advantages
and disavantages of each alternative for financing and
implementing the various recommendations.
Possible use of redevelopment agency.
° Community Development Block Grant funds.
° A specific plan.
Moved by Commissioner Hartley, seconded by Commissioner Holland to approve the
Request for Proposals to the Downtown Plan and include the Planning Commission's
additional recommendations. Motion passed unanimously.
8. COMMISSION COMMENTS
Commissioner Hartley presented the Commission and staff with a slide presentation
of the League of California Cities 1986 Planning Commissioners Institute held in
San Diego.
9. STAFF COMMENTS
Associate Planner presented the Commission with the Residential, Commercial
and Industrial Update (dated March 31, 1986) Status Report,
The Commission requested that staff provide statistics showing population build -out
by dwelling units currently provided under the General Plan. This information to
be provided at the joint meeting of City Council and Planning Commission of April
30, 1986.
10. ADJOURNMENT
There being no further business the meeting was adjourned to April 30, 1986, the
time being 11:30 p.m.
